Book Public Access to Documents in the EU

Download or read book Public Access to Documents in the EU written by Leonor Rossi and published by Bloomsbury Publishing. This book was released on 2017-01-12 with total page 384 pages. Available in PDF, EPUB and Kindle. Book excerpt: All litigants before the General Court of the EU (GC), the Court of Justice of the EU (ECJ) or indeed before any EU body or agency will need to have full access to the documents held by the European Union. Though the legislation regulating the field, Regulation 1049/2001, has been in force for some time, it is a complex field for all would-be litigants. In this book the authors, both experienced practitioners in the area, clearly set out the documentation, access requirements and processes. They include a helpful glossary of terms, tables and appendices setting out the relevant legislation. This will be the seminal text for all practitioners who need to access documentation held by the EU.

Book Access to EU documents

Download or read book Access to EU documents written by Great Britain: Parliament: House of Lords: European Union Committee and published by The Stationery Office. This book was released on 2009-06-18 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: Openness is an important principle on which the European Union is founded. Regulation 1049/2001 regarding public access to European Parliament, Council and Commission documents sets out a code for access to documents held by these institutions. It is the EU equivalent of the freedom of information regimes found in the UK and other states. The Commission has proposed a revision of this Regulation. This report highlights the extent to which the proposal would preclude disclosure both of documents submitted to courts in the course of litigation and documents arising in the course of investigations, even in the face of a strong public interest in disclosure. The Committee feels such an exclusion is, in principle, justified in respect of court documents where the court itself can make provision for disclosure. A controversial issue is how far confidentiality is required for formulating policy (particularly to ensure that policy makers receive frank and open advice) and for negotiating legislation. The report looks at the relevant provisions of the proposal, particularly in the light of recent judgments by the European Court of Justice, and highlights the differences in the approaches of the European Parliament and the Government. These documents should not be given absolute immunity from disclosure but should be protected subject to any overriding public interest. The Committee also concludes that the effect of the proposal to amend the rules on disclosure by the institutions of documents which they hold but which originate from Member States would significantly reduce the existing right of access.

Book excerpt: This book, which takes account of legal developments until June 2012, describes in detail the EU law affecting the transparency of the institutions as well as the actual practice of the European Commission, the Council and the European Parliament. The relevant practice of other institutions and bodies is also considered. Among the topics covered are: the scope and extent of public access to documents under Regulation 1049/2001; the impact on public access of Regulation 1367/2006 (the ‘Aarhus Regulation’); the procedure for applying for public access; rules on classified information; data protection and public access; the openness of decision-making, the relationship of Regulation 1049/2001 and other rules on access to documents; the law pertaining to the Official Journal; other aspects of transparency of EU decision-making, such as languages, quality of drafting and the involvement of lobbyists; remedies in Court and before the Ombudsman. Fulfilling the clear need for a practical guide to the nuts and bolts of the law and practice on transparency in the EU's institutional system, this book is written for the practitioner and indeed any party with an interest in availing of his or her rights under EU law. It is the only legal resource that serves this function and does so with élan and a matchless clarity.

Book Access to Information in the European Union

Download or read book Access to Information in the European Union written by Herke Kranenborg and published by ISBS. This book was released on 2005 with total page 146 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the last 15 years, transparency has been one of the central themes in the European integration process. By providing more openness about its activities, the European Union tries to bring itself closer to its citizens. Transparency is considered one of the main methods to relieve the 'democratic deficit'. One way of increasing transparency is to grant citizens a right to access information. Another way is to actively publish information. Transparency is not an exclusive feature of European integration. On the contrary, inspiration for policies on access to information is mostly drawn from the sometimes longstanding experiences of the member states. Access to Information in the European Union provides for a detailed and useful overview of EC and member state legislation in the field of access to information, highlighting the similarities and differences between national legislation of different member states.

Book Historical Dictionary of the European Union

Download or read book Historical Dictionary of the European Union written by Finn Laursen and published by Rowman & Littlefield. This book was released on 2015-10-30 with total page 371 pages. Available in PDF, EPUB and Kindle. Book excerpt: The current European Union (EU) has existed since 1 November 1993. It emerged from the Treaty of Maastricht largely negotiated during 1991. But the history of European integration goes further back. The Schuman Declaration of 9 May 1950 led to the creation of the European Coal and Steel Community (ECSC) in 1951, and in 1957 the two Treaties of Rome created the European Economic Community (EEC) and the European Atomic Energy Community (EAEC or EURATOM), which started operating from 1 January 1958. For some years the EEC was often referred to as the Common Market. The Merger Treaty of 1965 (in force since 1967) created a single executive, the European Commission, and a single Council of Ministers. The three Communities from the beginning in 1958 shared the Parliamentary Assembly and European Court of Justice (ECJ). Although these Communities still had separate treaties, they were increasingly seen as the European Community (EC). This new edition of Historical Dictionary of the European Union has a chronology, an introductory essay, appendixes, and an extensive bibliography. The dictionary section has over 400 cross-referenced entries on important personalities, member states, internal policies, external relations, basic theories, treaties, and law. This book is an excellent access point for students, researchers, and anyone wanting to know more about the European Union.

Book Handbook on European data protection law

Download or read book Handbook on European data protection law written by Council of Europe and published by Council of Europe. This book was released on 2018-04-15 with total page 402 pages. Available in PDF, EPUB and Kindle. Book excerpt: The rapid development of information technology has exacerbated the need for robust personal data protection, the right to which is safeguarded by both European Union (EU) and Council of Europe (CoE) instruments. Safeguarding this important right entails new and significant challenges as technological advances expand the frontiers of areas such as surveillance, communication interception and data storage. This handbook is designed to familiarise legal practitioners not specialised in data protection with this emerging area of the law. It provides an overview of the EU’s and the CoE’s applicable legal frameworks. It also explains key case law, summarising major rulings of both the Court of Justice of the European Union and the European Court of Human Rights. In addition, it presents hypothetical scenarios that serve as practical illustrations of the diverse issues encountered in this ever-evolving field.
