Most of this dictionary is written in ordinary English. Most of the words that lawyers use in writing and talking about the law are the ordinary words that fill the dictionaries of the English language. They have a place in this dictionary when the law gives them a specialized sense; or to emphasize that there is none. Too often an apparent change in sense results not from the law but from bad grammar or redundancy; or from an unsorted host of possible meanings jumbled together and left to the vagaries of interpretation. At the other extreme, individual cases, each walled in by its own distinctive facts and law, may give an immaculately narrowed sense, but neither generalized definition nor standards for the gradation of sense that is the essence of clear usage. A small number of citations to cases of special relevance to word usage are included in this dictionary. The citation count does not measure the indebtedness of this dictionary to old and current sources of American legal usage. The definitions and examples of usage in this dictionary have roots in the law reports of thousands of litigated cases; in law writings formal and informal, profound and trivial; in the talk of lawyers and judges in court and out--the formal and the informal--colloquial and slangy, talk that is precise and talk that is mush; in a long line of dictionaries past and present--law dictionaries, and dictionaries of English and its usage. And something has been added. This dictionary is designed to sort out the words used in the law, and to identify the different senses in which each is used, and can be used. With cross-reference, it tells how words are related to each other and separated for each other, so that discrimination and choice of usage are possible. Words are grouped together as identical, similar, disparate, departing from or paralleling the usages of ordinary English. Where usage is not uniform, the dictionary comments on what is better, best, and worst. The dictionary concentrates on general legal usage for a profession practicing in the American common law tradition . . . Crises of its own making--ranging from clergy sexual abuse and its cover-up to the church's complicity in colonialism, empire, and patriarchy--coupled with societal shifts beyond the church's control, have eroded its credibility. A much-deserved decline is well underway. And yet, churches remain content to continue with business as usual. The causes of this state of crisis are manifold and complex, and no one solution could resolve them all. But so long as the church remains in a state of division, no solutions will be forthcoming. Division is no mere regrettable shortcoming or inconvenience; it is a contradiction of the church's foundation. After all, Jesus prayed that his followers would be one so the world could believe he was sent by God. Faced with a crisis of credibility, the church finds no way forward because a divided church renders the gospel message not credible. Ruptured Bodies is a systematic theological account of the divided church. It argues that no adequate ecclesiology can ignore division, because in doing so, it will fail to describe the church that actually is. Such an understanding must integrate the reality of division, while also refusing to blunt its sharp edge--neither dismissing, excusing, nor minimizing it. What must the church be, given the fact of its division? Schlesinger presents a systematic ecclesiology of the divided church despite that idea's seeming impossibilty, because such an ecclesiology is precisely what we need.

Book excerpt: The relationship between the Syrian Orthodox Church in the Ottoman Empire and the Church of England developed substantially between 1895 and 1914, as contacts between them grew. As the character of this emerging relationship changed, it contributed to the formation of both churches’ own ‘narratives of identity’. The wider context in which this took place was a period of instability in the international order, particularly within the Ottoman Empire, culminating in the outbreak of the First World War, effectively bringing this phase of sustained contact to an end. Narratives of Identity makes use of Syriac, Garshuni, and Arabic primary sources from Syrian Orthodox archives in Turkey and Syria, alongside Ottoman documents from the Başbakanlık Osmanlı Arşivi, Istanbul, and a range of English archival sources. The preconceptions of both Churches are analysed, using a philosophical framework provided by the work of Paul Ricoeur, especially his concepts of significant memory (anamnesis), translation, and the search for mutual recognition. Anamnesis and translation were extensively employed in the formation of ‘narratives of identity’ that needed to be understood by both Churches. The identity claims of the Tractarian section of the Church of England and of the Ottoman Syrian Orthodox Church are examined using this framework. The detailed content of the theological dialogue between them, is then examined, and placed in the context of the rapidly changing demography of eastern Anatolia, the Syrian Orthodox ‘heartland’. The late Ottoman state was characterised by an increased instability for all its non-Muslim minorities, which contributed to the perceived threats to Ottoman Syrian Orthodoxy, both from within and without. Finally, a new teleological framework is proposed in order to better understand these exchanges, taking seriously the amamnetic insights of the narratives of identity of both the Syrian Orthodox Church and the Church of England from 1895 to 1914.

This book traces the evolution of what the diaries reveal as the statesman's central intellectual preoccupations, theology and classical scholarship, as well as the groundwork of his early Conservatism and his mature Liberalism. In particular it examines the ideological sources of Gladstone's youthful opposition to reform before scrutinizing his convictions in theology. These are shown to have passed through more stages than has previously been supposed: he moved from Evangelicalism to Orthodox High Churchmanship, on to Tractarianism and then further to a broader stance that eventually crystallized as a liberal Catholicism. His classical studies, focused primarily on Homer, also changed over time, from a version that was designed to defend a traditional worldview to an approach that exalted the depiction of human endeavour in the ancient Greek poet. An enduring principle of his thought about religion and antiquity was the importance of community, but a fresh axiom that arose from the modifications of his views was the centrality of all that was human. The twin values of community and humanity are shown to have conditioned Gladstone's rhetoric as Liberal leader, so making him, in terms of recent political thought, a communitarian rather than a liberal, but one with a distinctive humanitarian message. As a result of a thorough scrutiny of Gladstone's private papers, the Victorian statesman is shown to have derived a distinctive standpoint from the Christian and classical sources of his thinking and so to have left an enduring intellectual legacy. It becomes apparent that his religion, Homeric studies and political thought were interwoven in unexpected ways. The evolution of Gladstone's central intellectual preoccupations, with religion and Homer, is the theme of this book. It shows how the statesman developed from Evangelism to Orthodox High Churchmanship, on to Tractarianism and then further to a broader stance that eventually crystallized as a liberal Catholicism. It demonstrates also that his Homeric studies developed over time. Neither aspect of his thinking was kept apart from his politics. Gladstone's early conservatism emerged from a blend of classical and Christian themes focusing on the idea of community. While that motif persisted in his speeches as Liberal leader, the category of the human emerged from his religious and Homeric ideas to condition the presentation of his Liberalism. In Gladstone's mind there was an intertwining of theology, Homeric studies and political thought.
