Book The Defence of Obedience to Superior Orders in International Law

Download or read book The Defence of Obedience to Superior Orders in International Law written by Yoram Dinstein and published by OUP Oxford. This book was released on 2012-10-25 with total page 302 pages. Available in PDF, EPUB and Kindle. Book excerpt: The first comprehensive monograph on the defence of superior orders after the second world war, which remains pre-eminent in the field, the republication of this highly-sophisticated work once again makes this book available to scholars and students in the field. First published in 1965, Yoram Dinstein set the standard for future analysis of this issue, providing a ground-breaking interpretation that integrated domestic and international law to provide a subtle and nuanced challenge to the countervailing perceptions of the time, shaped as they were by the Nuremburg and Eichmann trials. The recent jurisprudence of the ad hoc Tribunals has shown remarkably similar analyses to those offered by Dinstein in this book, demonstrating that this key work remains relevant today. Reviewing the relevant precedents that existed at the time, this book shows that superior orders were not, in and of themselves, a defence, but that orders were relevant to other defences, and therefore should not be entirely ignored. Assessing the issue on a conceptual and practical level, and offering an extraordinary level of detail, this is a is a seminal work in international criminal law. It makes required reading for scholars, students, and practitioners of international criminal law.

Download or read book The Heart of Torah Volume 1 written by Shai Held and published by U of Nebraska Press. This book was released on 2017-09-01 with total page 399 pages. Available in PDF, EPUB and Kindle. Book excerpt: In The Heart of Torah, Rabbi Shai Held’s Torah essays—two for each weekly portion—open new horizons in Jewish biblical commentary. Held probes the portions in bold, original, and provocative ways. He mines Talmud and midrashim, great writers of world literature, and astute commentators of other religious backgrounds to ponder fundamental questions about God, human nature, and what it means to be a religious person in the modern world. Along the way he illuminates the centrality of empathy in Jewish ethics, the predominance of divine love in Jewish theology, the primacy of gratitude and generosity, and God’s summoning of each of us—with all our limitations—into the dignity of a covenantal relationship.

Book excerpt: "Rivals the major systematic theologies of this century."--Baptist History and Heritage Journal, July 1996"One of the characteristics of Garrett's system that needs especially to be noted is its balanced, judicious, and nearly invariably objective presentation of materials. While holding true to the teachings of his own Baptist faith, Garrett so carefully and judiciously presents alternatives . . . that teachers and students from other confessional and denominational positions will find his work instructive."--Consensus, 1997"If one is searching for an extensive exposition of the biblical foundations and historical developments of the various loci of systematic theology, there is no more complete presentation in a relatively short work than this . . . Pastors will especially find this feature to be a real help in teaching theology . . . The prodigious research that must have gone into the preparation of this volume is truly mind-boggling."--Faith and Mission, Fall 1991"Garrett has provided a massive and scholarly systematic theology from a thoroughly conservative and comprehensive viewpoint. The work is well documented in both biblical and historical scholarship and will prove to be a classic."--William Hendrickson, Southern Baptist Theological Seminary"One of the most comprehensive, concise books of its type available; it should receive wide use in the classroom and in the study."--Robert H. Culpepper, Southern Baptist Theological Seminary

Book Early Modern Jesuits between Obedience and Conscience during the Generalate of Claudio Acquaviva 1581 1615

Download or read book Early Modern Jesuits between Obedience and Conscience during the Generalate of Claudio Acquaviva 1581 1615 written by Silvia Mostaccio and published by Routledge. This book was released on 2016-05-13 with total page 219 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Society of Jesus was founded by Ignatius Loyola on a principal of strict obedience to papal and superiors’ authorities, yet the nature of the Jesuits's work and the turbulent political circumstances in which they operated, inevitably brought them into conflict with the Catholic hierarchy. In order to better understand and contextualise the debates concerning obedience, this book examines the Jesuits of south-western Europe during the generalate of Claudio Acquaviva. Acquaviva’s thirty year generalate (1581-1615) marked a challenging time for the Jesuits, during which their very system of government was called into doubt. The need for obedience and the limits of that obedience posed a question of fundamental importance both to debates taking place within the Society, and to the definition of a collective Jesuit identity. At the same time, struggles for jurisdiction between political states and the papacy, as well as the difficulties raised by the Protestant Reformation, all called for matters to be rethought. Divided into four chapters, the book begins with an analysis of the texts and contexts in which Jesuits reflected on obedience at the turn of the seventeenth century. The three following chapters then explore the various Ignatian sources that discussed obedience, placing them within their specific contexts. In so doing the book provides fascinating insights into how the Jesuits under Acquaviva approached the concept of obedience from theological and practical standpoints.
