Book excerpt: A history of legal emotions in William Blackstone’s England and their relationship to justice William Blackstone’s masterpiece, Commentaries on the Laws of England (1765–1769), famously took the “ungodly jumble” of English law and transformed it into an elegant and easily transportable four-volume summary. Soon after publication, the work became an international monument not only to English law, but to universal English concepts of justice and what Blackstone called “the immutable laws of good and evil.” Most legal historians regard the Commentaries as a brilliant application of Enlightenment reasoning to English legal history. Loving Justice contends that Blackstone’s work extends beyond making sense of English law to invoke emotions such as desire, disgust, sadness, embarrassment, terror, tenderness, and happiness. By enlisting an affective aesthetics to represent English law as just, Blackstone created an evocative poetics of justice whose influence persists across the Western world. In doing so, he encouraged readers to feel as much as reason their way to justice. Ultimately, Temple argues that the Commentaries offers a complex map of our affective relationship to juridical culture, one that illuminates both individual and communal understandings of our search for justice, and is crucial for understanding both justice and injustice today.

For the founders, the pursuit of happiness was the individual right to pursue a life lived in harmony with the law of nature and a public duty to govern in accordance with that law. Upon the two principles of inconvenience and hazard, compared together, different nations have, at different times, established different rates of intereit. Our law establishes one standard for all alike, where the pledge of security itself is not put in jeopardy; lest, under the general pretense of vague and indeterminate hazard, a door should be opened to fraud and usury; leaving specific hazards to be provided against by specific insurances, by annuities for lives, or by 1 upon respondentia or bottomry. But as to the rate of legal interest, it has varied and decreased for two hundred years past, according as the quantity of specie in the kingdom has increased by accessions of trade, the introduction of paper credit, and other circumstances. By the statute 12 Anne, st. 2, c. Hi, it was brought down to five per cent, yearly, which is now the extremity of legal interest that can be taken. But yet, if a contract which carries interest be made in a foreign country, our courte will direct the payment of interest according to the law of that country in which the contract was made. Unless the money lent shall be known at the time to exceed the value of the thing in pledge; in which case also to prevent usurious contracts at home under colour of such foreign securities, the borrower shall forfeit treble the sum so borrowed.
