Book excerpt: This series of HANDBOOKS OF LINGUISTICS AND COMMUNICATION SCIENCE is designed to illuminate a field which not only includes general linguistics and the study of linguistics as applied to specific languages, but also covers those more recent areas which have developed from the increasing body of research into the manifold forms of communicative action and interaction. For "classic" linguistics there appears to be a need for a review of the state of the art which will provide a reference base for the rapid advances in research undertaken from a variety of theoretical standpoints, while in the more recent branches of communication science the handbooks will give researchers both an overview and orientation. To attain these objectives, the series aims for a standard comparable to that of the leading handbooks in other disciplines, and to this end strives for comprehensiveness, theoretical explicitness, reliable documentation of data and findings, and up-to-date methodology. The editors, both of the series and of the individual volumes, and the individual contributors, are committed to this aim. The language of publication is English. The main aim of the series is to provide an appropriate account of the state of the art in the various areas of linguistics and communication science covered by each of the various handbooks; however no inflexible pre-set limits will is imposed on the scope of each volume. The series is open-ended, and can thus take account of further developments in the field. This conception, coupled with the necessity of allowing adequate time for each volume to be prepared with the necessary care, means that there is no set time-table for the publication of the whole series. Each volume is a self-contained work, complete in itself. The order in which the handbooks are published does not imply any rank ordering, but is determined by the way in which the series is organized; the editors of the whole series enlist a competent editor for each individual volume. Once the principal editor for a volume has been found, he or she then has a completely free hand in the choice of co-editors and contributors. The editors plan each volume independently of the others, being governed only by general formal principles. The series editors only intervene where questions of delineation between individual volumes are concerned. It is felt that this (modus operandi) is best suited to achieving the objectives of the series, namely to give a competent account of the present state of knowledge and of the perception of the problems in the area covered by each volume. It offers not only a biography, but explores large and previously unused and largely unknown collections of more than 500 papers from the legal practice, written by the Leipzig Ordinarius. Based on this unique material the book examines for the first time spheres of influence, circles of clients and occupational fields of an individual late medieval german jurist. Legal opinions (“consilia”) and pleadings, but as well working tools for the emerging learned practice of “Common Saxon Law” made by Dietrich von Bocksdorf, provide deep insights into the beginnings of the epochal change from the traditional-archaic jurisdiction of the Middle Ages to the scholarly and written practice of law in the early modern world.

This band of white wool encircling the shoulders had been a papal insigne and liturgical vestment since late antiquity. It grew in prominence when the popes began to bestow it regularly on other bishops as a mark of distinction and a sign of their bond to the Roman church. Bonds of Wool analyzes how, through adroit manipulation, this gift came to function as an instrument of papal influence. It explores an abundant array of evidence from diverse genres - including chronicles and letters, saints' lives and canonical collections, polemical treatises and liturgical commentaries, and hundreds of papal privileges - stretching from the eighth century to the thirteenth and representing nearly every region of Western Europe. These sources reveal that the papal conferral of the pallium was an occasion for intervening in local churches throughout the West and a means of examining, approving, and even disciplining key bishops, who were eventually required to request the pallium from Rome.

Book excerpt: Aron Zysow's 1984 Ph.D. dissertation, "The Economy of Certainty," remains the most important, compelling, and intellectually ambitious treatment of Islamic legal theory (usul al-fiqh) in Western scholarship to date. It continues to be widely read and cited, and remains unsurpassed in its incisive analysis of the most fundamental assumptions of Islamic legal thought. Zysow argues that the great dividing line in Islamic legal thought is between those legal theories that require certainty in every detail of the law and those that will admit probability. The latter were historically dominant and include the leading legal schools that have survived to our own day. Zahirism and, for much of its history, Twelver Shi'ism, are examples of the former. The well-known dispute regarding the legitimacy of juridical analogy is only one feature of this fundamental epistemological division, since probability can enter the law in the process of authenticating prophetic traditions and in the interpretation of the revealed texts, as well as through analogy. The notion of consensus in Islamic legal theory functioned to reintroduce some measure of certainty into the law by identifying one of the competing probable solutions as correct. Consequently consensus has only a reduced role, if any, in those systems that reject probability. Another, more radical, means of regaining certainty was the doctrine that regarded the legal reasoning of all qualified jurists on matters of probability as infallible. The development of legal theories of both types, that of Zahirism no less than that of Hanafism, was to a large extent shaped by theology and, most significantly, by Mu'tazilism, and subsequently by Ash'arism and Maturidism. Zysow's important work is published here in full, for the first time, with updated references and some further reflections by the author.

Erich Ludendorff created for himself a persona that secured his place as one of the most prominent (and despicable) Germans of the twentieth century. With boundless energy and an obsession with detail, Ludendorff ascended to power and solidified a stable, public position among Germany's most influential. Between 1914 and his death in 1937, he was a war hero, a dictator, a right-wing activist, a failed putschist, a presidential candidate, a publisher, and a would-be prophet. He guided Germany's effort in the Great War between 1916 and 1918 and, importantly, set the tone for a politics of victimhood and revenge in the postwar era. Dragonslayer explores Ludendorff's life after 1918, arguing that the strange or unhinged personal traits most historians attribute to mental collapse were, in fact, integral to Ludendorff's political strategy. Lockenour asserts that Ludendorff patterned himself, sometimes consciously and sometimes unconsciously, on the dragonslayer of Germanic mythology, Siegfried—hero of the epic poem The Niebelungenlied and much admired by German nationalists. The symbolic power of this myth allowed Ludendorff to embody many Germans' fantasies of revenge after their defeat in 1918, keeping him relevant to political discourse despite his failure to hold high office or cultivate a mass following after World War I. Lockenour reveals the influence that Ludendorff's postwar career had on Germany's political culture and radical right during this tumultuous era. Dragonslayer is a tale as fabulist as fiction.
