Book The Internationalization of Palace Wars

Download or read book The Internationalization of Palace Wars written by Yves Dezalay and published by University of Chicago Press. This book was released on 2010-02-15 with total page 347 pages. Available in PDF, EPUB and Kindle. Book excerpt: How does globalization work? Focusing on Latin America, Yves Dezalay and Bryant G. Garth show that exports of expertise and ideals from the United States to Argentina, Brazil, Chile, and Mexico have played a crucial role in transforming their state forms and economies since World War II. Based on more than 300 extensive interviews with major players in governments, foundations, law firms, universities, and think tanks, Dezalay and Garth examine both the production of northern exports such as neoliberal economics and international human rights law and the ways they are received south of the United States. They find that the content of what is exported and how it fares are profoundly shaped by domestic struggles for power and influence—"palace wars"—in the nations involved. For instance, challenges to the eastern intellectual establishment influenced the Reagan-era export of University of Chicago-style neoliberal economics to Chile, where it enjoyed a warm reception from Pinochet and his allies because they could use it to discredit the previous regime. Innovative and sophisticated, The Internationalization of Palace Wars offers much needed concrete information about the transnational processes that shape our world.

Book excerpt: "The After the JD project will track the professional lives of more than 5,000 lawyers during their first ten years after law school. Whilemost of the project will unfold in coming years, the data presented here provide a first snapshot of the stratified random national sample, based on questionnaires administered two to three years into the new lawyers' careers. The findings presented here will be elaborated and augmented through face-to-face interviews with a sub-sample of roughly 10% of the survey respondents. Building on this first wave, the future work of AJD will employ follow-up questionnaires and personal interviews six and ten years into the respondents' careers. When completed, it will be the first national study of the factors -- personal and professional -- that account for the wide spectrum of legal careers and experiences"--Introduction

Available in PDF, EPUB and Kindle. Book excerpt: This work comprises 24 linked essays by leading transatlantic scholars in international law and the social sciences examining the sociolegal aspects of multi-jurisdictional legal techniques and trans-jurisdictional social phenomena. The contributors bring a range of disciplinary expertises including anthropology, economics, law and sociology to bear on key questions raised by transnational legal processes. The pieces explore legal developments in multiple territories including Africa, Asia, Latin America and the United States. The volume is designed as a general reader for courses on law and globalisation and related studies. The collection is made up of four parts, each addressing a central theme in transnational law and legal action (law-making and compliance), human rights, commerce and governance. The essays discuss such diverse problems as: the role of foreign actors in the ethnic conflicts of Kosovo and Rwanda; the power the United States and the UK wield over international capital markets; and the adaptability of existing public international law to deal with the challenges wrought by globalisation.

Book Gender Myths V Working Realities

Download or read book Gender Myths V Working Realities written by Theresa M Beiner and published by NYU Press. This book was released on 2005 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: Both the courts and the public seem confused about sexual harassment—what it is, how it functions, and what sorts of behaviors are actionable in court. Theresa M. Beiner contrasts perspectives from social scientists on the realities of workplace sexual harassment with the current legal standard. When it comes to sexual harassment law, all too often courts (and employers) are left in the difficult position of grappling with vague legal standards and little guidance about what sexual harassment is and what can be done to stop it. Often, courts impose their own stereotyped view of how women and men “ought” to behave in the workplace. This viewpoint, social science reveals, is frequently out of sync with reality. As a legal scholar who takes social science seriously, Beiner provides valuable insight into what behaviors people perceive as sexually harassing, why such behavior can be characterized as discrimination because of sex, and what types of workplaces are more conducive to sexually harassing behavior than others. Throughout, Beiner offers proposals for legal reform with the goal of furthering workplace equality for both men and women.

Book The Constitution of Interests

Download or read book The Constitution of Interests written by John Brigham and published by NYU Press. This book was released on 2000-07 with total page 239 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many of America's most important social and political movements--abolition, women's suffragette, civil rights, women's liberation, gay and lesbian rights--have organized in the shadow of the law. All are based in their theoretical opposition to the law. Yet at the same time, they are dependent on the laws that prohibit them. Law is thus formed as much through the dynamic tensions that govern how these laws are received as through their official decree. Legal forms such as contracts, property, and rights also constitute social and political life because they structure our world. John Brigham here focuses on four ideological movements and their strategies, among them the struggle over the closing of gay bathhouses in the early years of the AIDS crisis and the radical feminist use of rage and radical consciousness in anti- pornography campaigns. The effect of law on politics, Brigham convincingly reveals, is pervasive precisely because political life finds its expression in a surprising variety of legal forms.

Book excerpt: All I Eat Is Medicine charts the lives of individuals and the operation of institutions in the thick of the AIDS epidemic in Mozambique during the global scale-up of treatment for HIV/AIDS at the turn of the twenty-first century. Even as the AIDS treatment scale-up saved lives, it perpetuated the exploitation and exclusion that was implicated in the propagation of the epidemic in the first place. This book calls attention to the global social commitments and responsibilities that a truly therapeutic global health requires.

Book Toward A Theory of Immigration

Download or read book Toward A Theory of Immigration written by P. Meilaender and published by Springer. This book was released on 2001-12-13 with total page 269 pages. Available in PDF, EPUB and Kindle. Book excerpt: Changes in the global political order have combined with dominant trends in liberal political philosophy to spark increasing scholarly criticism of the state's traditional right to regulate immigration according to its own national identity. In the face of these political and scholarly trends, Meilaender offers a strong yet thoughtful defense of that right, arguing that, within broad limitations, states may legitimately exercise wide discretion in crafting immigrations policies that reflect their own particular visions of political community. The concrete issue of immigration thus serves as a lens through which to focus on abiding dilemmas of politics and culture that lie at the heart of political philosophy.
