In that report, Defining Death: Medical, Legal and Ethical Issues in the Determination of Death, the President's Commission forwarded a uni form determination of death act, which laid heavy accent on the signifi cance of the brain stem in determining whether an individual is alive or dead: An individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions, or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead. A determination of death must be made in accordance with accepted medical standards ([1], p. 2). The plausibility of these criteria is undermined as soon as one confronts the question of the level of treatment that ought to be provided to human bodies that have permanently lost consciousness but whose brain stems are still functioning.

Studies directed specifically at the cellular and molecular mechanisms of brain death, on the other hand, remain scarce. Brain Stem Death chronicles the first comprehensive effort to fill this knowledge void. The 30-year journey of the author and his colleagues began with a serendipitous discovery of a novel biomarker that is related to the functional integrity of the brain stem and inevitably disappears in patients confirmed with brain death. That this life-and-death signal undergoes waxing and waning in animal models suggests that the progression towards brain stem death successively exhibits pro-life and pro-death phases. Systematic search from a brain stem neural substrate where this biomarker originates revealed that it is the outcome of interplays between pro-life and pro-death cellular and molecular programs and the transition from oxidative stress to nitrosative stress that determine the final fate of the individual. Given that brain stem death is irreversible, this book provides mechanistical hints for the development of strategies to prevent critically ill patients from shifting from the pro-life phase to the pro-death phase. This book is particularly recommended to specialists in critical care medicine, neurology, transplantation, and translational medicine.

There is no global consensus in diagnostic criteria, and the guidelines and protocols regarding the confirmation of brain death vary from country to country. This article is based on the protocol applied in Finland. Declaration of brain death follows a certain set of tests that demonstrate the complete absence of brain function (brain stem function in the UK). Provided that the cause of the irremediable brain damage is known and the absence of all cranial nerve reflexes has been confirmed with clinical tests, death can be declared whilst the heart continues to beat. At least two physicians, of specified status and experience, are required to act together to diagnose brain death.

If every possible confounder has been excluded and all possible treatments have been tried or considered, irreversible loss of brain function is clinically recognized as the absence of brainstem reflexes, verified apnea, loss of vascular tone, invariant heart rate, and, eventually, cardiac standstill. This condition cannot be reversed – not even partly – by medical or surgical intervention, and thus is final. Many countries in the world have introduced laws that acknowledge that a patient can be declared brain-dead by neurologic standards. The U.S. law differs substantially from all other brain death legislation in the world because the U.S. law does not spell out details of the neurologic examination. Evidence-based practice guidelines serve as a standard. In this chapter, I discuss the history of development of the criteria, the current clinical examination, and some of the ethical and legal issues that have emerged. Generally, the concept of brain death has been accepted by all major religions. But patients’ families may have different ideas and are mostly influenced by cultural attitudes, traditional customs, and personal beliefs. Suggestions are offered to support these families.
