For some, such judicial intervention has trivialized and impoverished democratic politics. For others judges have contributed to a dynamic and healthy dialogue between the different spheres of the constitution, removed from pressures imposed on elected representatives to respond to popular sentiment. This book provides a critical evaluation of ongoing debates surrounding the judicial role in protecting fundamental human rights, focusing in particular on legislative/executive abridgment of a core freedom in western society - namely, liberty of expression. A range of types of expression are considered, including expression related to electoral processes, political expression in general and sexually explicit forms of expression.

Book excerpt: Secularism is usually thought to contain the project of self-deification, in which humans attack God’s authority in order to take his place, freed from all constraints. Julie E. Cooper overturns this conception through an incisive analysis of the early modern justifications for secular politics. While she agrees that secularism is a means of empowerment, she argues that we have misunderstood the sources of secular empowerment and the kinds of strength to which it aspires. Contemporary understandings of secularism, Cooper contends, have been shaped by a limited understanding of it as a shift from vulnerability to power. But the works of the foundational thinkers of secularism tell a different story. Analyzing the writings of Hobbes, Spinoza, and Rousseau at the moment of secularity’s inception, she shows that all three understood that acknowledging one’s limitations was a condition of successful self-rule. And while all three invited humans to collectively build and sustain a political world, their invitations did not amount to self-deification. Cooper establishes that secular politics as originally conceived does not require a choice between power and vulnerability. Rather, it challenges us—today as then—to reconcile them both as essential components of our humanity.

Out of the Cloister is an organizational analysis of the structural and ideological changes that took place in Catholic religious orders of women in the United States. Many nuns today dress in street clothes, choose their own jobs, have a degree of financial independence from the larger order, and may not be recognized by their coworkers as nuns. What might once have been defined as a "total institution" has become, within the span of a few years, a type of voluntary organization where members join together loosely to achieve a common purpose. Helen Rose Fuchs Ebaugh approaches religious orders as utopian communities and examines how contact with the larger society has affected the distinctiveness and solidarity that hold such groups together. She analyzes the patterns occurring within orders with particular focus on the relationship between organizational change and membership loss. Since changes have been introduced into religious orders at different rates, and since orders vary in such characteristics as size and educational level of members, it is possible to analyze relationships between exit rates and other organizational variables. The complex interplay of education and membership loss is one of the organizational dilemmas the author examines. Although she is no longer a part of organized religious life, Ebaugh spent ten years as a nun and during that time collected much of the data presented in this book. As a nun she also helped conduct a number of self-studies and evaluations involved with the post-Vatican II reform and renewal efforts. She is therefore in the unique position of a researcher who collected data as an insider and analyzed it as an outsider. This book is one of the first systematic, empirical studies of religious orders in the United States and one of the few sociological investigations of convents and the changes occurring within them.

Work on this aspect of contempt has been brought forward to tie in with the Government's consideration of the possible abolition of the offence under the Crime and Courts Bill. A well-publicised case in spring 2012 highlighted the historic common law offence of scandalising the court. This offence covers conduct likely to undermine the administration of justice or public confidence in the administration of justice, where the conduct does not impinge on particular proceedings. Scandalising the court has been defined as "any act done or writing published calculated to bring a Court or a judge of the Court into contempt, or to lower his authority". There has not been a successful prosecution for scandalising the court in England and Wales since 1931, although it has been used more recently in other common law jurisdictions. The controversy surrounding this offence is in relation to: the lack of clarity about both the conduct element and the mental element; the lack of clarity about the defences available; the justification for retaining such an offence in a well-established democracy; and the compatibility of the offence with freedom of speech and the European Convention on Human Rights. It is thus a relationship rooted in the state's need for security, authority, and legitimacy as much as liberalism's powerful arguments for economic and political freedom. In Europe, this long running endeavour has yielded a market based, liberal democratic regional order that has profound consequences for media law and policy in the member states. This book examines the economic and human rights aspects of European media law, which is not only comparatively coherent but also increasingly restrictive, rejecting alternatives that are well within the traditions of liberalism. Parallel efforts in the international sphere have been markedly less successful.
