It is assumed that the reader has already gained an acquaintance with whatever is common to courts of justice generally, and with the great body of common law and equity, which is administered by all the leading American courts upon principles fundamentally similar. These volumes seek merely to superadd a knowledge of those details which are necessary to qualify the practitioner for the special duty of practice in the courts of the Union. The work, as originally published, was received with a favor very gratifying to the author and publishers. Since it appeared, the entire body of the statute law of the United States has received a new form and arrangement by the enactment of the United States Revised Statutes. The author was one of the commissioners by whom the Revision was draughted for the consideration of Congress. While the change affects only very slightly the substance and operation of the laws, it renders all references to them, by former arrangements, inappropriate; and throws doubt over all quotations of their language. Art. VI., 24. In conformity with this requisition, the Legislature at its session in 1847, appointed three gentlemen, (messrs. Arphaxad loomis, nich olas hill, jr., and david graham, ) to discharge the onerous and novel duty required by the Constitution. These gentlemen entered upon and continued in the performance of their duties for several months, when one of the Commissioners (mr. Hill) resigned and Mr. David dudley field, was appointed in his place. It is understood, however, that but little was accomplished by the gentlemen first named, who disagreed essentially in the principles which should govern the projected reform. Upon the re-organization of the commission by the selection of Mr. Field, the work progressed more rapidly, and to him, mainly, the State is indebted for the larger portion of the civil branch of the new system. On proof of such service, the motion will be considered, unless, for satisfactory reasons, further time be given by the court to either party. 5. Motions to dismiss and affirm united. - There may be united, with a motion to dismiss a writ of error or an appeal, a motion to affirm on the ground that, although the record may show that this court has jurisdiction, it is manifest the writ or appeal was taken for delay only, or that the question on which the jurisdiction depends is so frivolous as not to need further argument. 6. Motion day. - The court will not hear arguments on Saturday (unless for special cause it shall order to the contrary), but will devote that day to the other business of the court. The motion-day shall be Monday of each week; and motions not required by the rules of the court to be put on the docket shall be entitled to preference immediately after the reading of opinions, if such motions shall be made before the court shall have entered upon the hearing of a case upon the docket.
