Book excerpt: Excerpt from A Treatise on the Law of Legacies, Vol. 1 of 2 The late learned Author had intended to republish his Treatise on the Law of Legacies under an entirely new arrangement; and at his death left the thirteen first chapters and part of another prepared with that view, but without any other manuscripts from which even an outline of his plan respecting the remainder of the work could be collected. The completion of this design devolved upon the Editor, in the prosecution of which he has avoided, as much as possible, alterations in the manuscript chapters left by the late Author, beyond verbal corrections and the addition of subsequent decisions. The substance of the former Editions will be found in the present, but under a new arrangement, which has been adopted in the hope of rendering the work more useful, and at the same time a more accurate and comprehensive analysis of a complicated subject. To obviate objections which have been made to the lengthened statements of cases in the former Editions, considerable pains have been bestowed in compressing them within the smallest compass consistent with utility. The Editor feels confident that the chapters left by the late Author, and forming about one third of the present volumes, will not disappoint the expectations of those acquainted with his intention of republishing. Book excerpt: Excerpt from A Treatise on the Laws of Descent The laws of descent were an organic part of the feudal system; and, so far as the general principle of succession is involved, have come down to us unchanged. Important alterations have been made in the order and lines of succes sion. The course of descent has also been subjected to be entirely defeated by the alienation of the ancestor while alive, and by his testamentary alienation to take effect at and after his death. His estate has also been made liable to the payment of his debts, and the fulfillment of his personal obligations, after the succession of the heir. Otherwise, the heir succeeds the ancestor in the ownership of the estate, precisely as he did under the feudal law, in all the States of this country; that is, his right of succession is based upon the same principle, which regulated succession under purely feudal organizations. It is, therefore, necessary to fully understand the principle and operation of the feudal succes sion, in order to understand the principle and operation of inheritance at the present day. This work is designed to put the student in possession of a full and familiar know ledge of the feudal law, and of feudal customs in that respect. Having possessed himself of that general knowledge, the student has then attained a standpoint from which he can command a clear view, and a ready comprehension of the Whole of this department of the law, in all its practical operations and incidents.
