Book excerpt: Excerpt from A Treatise on the Rights and Privileges Guaranteed by the Fourteenth Amendment to the Constitution of the United States As the author has observed through many years, it is almost daily, in the federal and state courts, that the Fourteenth Amendment to the Constitution of the United States is appealed to. All those, whether citizens or denizens, who are, or allege themselves to be, unjustly affected in the great rights and privileges and immunities of citizenship, life, liberty, property or equality, invoke that Amendment for their safety and shield against the action of officers and courts under, state authority, and against federal governmental authority as forbidden by like principles found in the Fifth Amendment. More particularly is this so where those cardinal rights are prejudiced by the exercise of public authority by the tribunals or officers of the states, or their municipalities; then the federal courts are called upon to assert their jurisdiction for the vindication of those rights guaranteed against state infraction by the Fourteenth Amendment. This book was released on 2017-09-17 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Adoption of the Fourteenth Amendment The Supreme Court Of the United States, in the Slaugh ter House Cases, declared that the privileges and immuni ties of citizens guaranteed by the Fourteenth Amendment are those which they possess as citizens Of the United States and not those which they enjoy by virtue of state citizenship. This decision means that those privileges and immunities which flow from state citizenship must rest for their security and protection where they have heretofore rested, namely, upon the States. In Maxwell w. Dow the Court declared that the privileges and immunities Of citi zens Of the United States do not include those enumerated in, and secured against violation on the part of the Central Government by the first eight Amendments to the Federal Constitution. The same Court, in the Civil Rights Cases, declared that Congress cannot enact direct, affirmative leg islation for the enforcement of the Fourteenth Amendment and can enact only remedial legislation. This book was released on 2017-11-03 with total page 80 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Rights of Citizens and Persons Under the Fourteenth Amendment The rights and immunities of citizens and persons guaranteed by the Fourteenth Amendment cannot be understood apart from the history of its origin. Therefore a study of the events and forces which led to its adoption is necessary. It is impossible, however, in a short monograph like this, to present all that legiti mately belongs to such a history, as the whole ground of the Civil War and reconstruction Should be covered. Moreover, it is only essential to the purpose of this paper to point out the historical forces and conditions which have an immediate bearing upon the development and adoption Of the Amendment. Book The Original Meaning of the Fourteenth Amendment

Download or read book The Original Meaning of the Fourteenth Amendment written by Randy E. Barnett and published by Harvard University Press. This book was released on 2021-11-02 with total page 489 pages. Available in PDF, EPUB and Kindle. Book excerpt: A Federalist Notable Book “An important contribution to our understanding of the 14th Amendment.” —Wall Street Journal “By any standard an important contribution...A must-read.” —National Review “The most detailed legal history to date of the constitutional amendment that changed American law more than any before or since...The corpus of legal scholarship is richer for it.” —Washington Examiner Adopted in 1868, the Fourteenth Amendment profoundly changed the Constitution, giving the federal judiciary and Congress new powers to protect the fundamental rights of individuals from being violated by the states. Yet, the Supreme Court has long misunderstood or ignored the original meaning of its key Section I clauses. Barnett and Bernick contend that the Fourteenth Amendment must be understood as the culmination of decades of debate about the meaning of the antebellum Constitution. In the course of this debate, antislavery advocates advanced arguments informed by natural rights, the Declaration of Independence, and the common law, as well as what is today called public-meaning originalism. The authors show how these arguments and the principles of the Declaration in particular eventually came to modify the Constitution. They also propose workable doctrines for implementing the amendment’s key provisions covering the privileges and immunities of citizenship, due process, and equal protection under the law.

Book The Fourteenth Amendment and the Privileges and Immunities of American Citizenship

Download or read book The Fourteenth Amendment and the Privileges and Immunities of American Citizenship written by Kurt T. Lash and published by Cambridge University Press. This book was released on 2014-04-07 with total page 327 pages. Available in PDF, EPUB and Kindle. Book excerpt: This exhaustively researched book presents the history behind a revolution in American liberty: the 1868 addition of the Privileges or Immunities Clause of the Fourteenth Amendment. It follows the evolution in public understanding of 'the privileges and immunities of citizens of the United States', from the early years of the Constitution to the election of 1866. For 92 years nothing in the American Constitution prevented states from abridging freedom of speech, prohibiting the free exercise of religion, or denying the right of peaceful assembly. The suppression of freedom in the southern states convinced the Reconstruction Congress and supporters of the Union to add an amendment forcing the states to respect the rights announced in the first eight amendments. But rather than eradicate state autonomy, the people embraced the Fourteenth Amendment that expanded the protections of the Bill of Rights and preserved the Constitution's original commitment to federalism and the principle of limited national power.

Book Freedmen the Fourteenth Amendment and the Right to Bear Arms 1866 1876

Download or read book Freedmen the Fourteenth Amendment and the Right to Bear Arms 1866 1876 written by Stephen P. Halbrook and published by Bloomsbury Publishing USA. This book was released on 1998-11-30 with total page 246 pages. Available in PDF, EPUB and Kindle. Book excerpt: Whether newly-freed slaves could be trusted to own firearms was in great dispute in 1866, and the ramifications of this issue reverberate in today's gun-control debate. This is the only comprehensive study ever published on the intent of the framers of the Fourteenth Amendment and of Reconstruction-era civil rights legislation to protect the right to keep and bear arms. Indeed, this is the most detailed study ever published about the intent of the Fourteenth Amendment to incorporate and to protect from state violation any of the rights guaranteed by the Bill of Rights, even including free speech. Paradoxically, the Second Amendment is virtually the only Bill of Rights guarantee not recognized by the federal courts as protected by the Fourteenth Amendment. Through legislative and historical records generated during the Reconstruction epoch (1866-1876), Halbrook shows the intent of the Fourteenth Amendment and of civil rights legislation to guarantee full and equal rights to blacks, including the right to keep and bear arms.
