Excerpt: ... when it has itself honored the check us it was actually drawn. The plaintiff bank was entitled, if it saw fit, to pay the check to the amount actually due from it to Burgess & Sons, if the defendant was willing to accept that sum. To this Burgess & Sons could have made no objection. . . . "The money which was the subject of the mistake was $7,500. In the forenoon of September 4, and neeessarily before the check f the defendant could be treated as paid, three checks, together amounting to $1,425, were drawn from the deposit of Burgess & Sons, which was nominally $17,145.46. These two sums being deducted from this deposit, there remained $8,220.40, for which Burgess & Sons had a right to draw. The amount which the plaintiff is entitled to recover is the difference between this sum and $15,000 (the amount of the check), with interest from the date of the writ." Book excerpt: Excerpt from Selected Cases on the Law of Quasi-Contracts This volume is intended to contain a representative selection of cases upon the large and important group of legal duties embraced in the term quasi-contract, and to afford material for the study and discussion of the principles regulating recovery in that class of cases, as those principles are found implicated with, and working upon, the actual facts of decided cases. For the historical development of the law of quasi-contracts, the student is referred to the masterly History of Assumpsit, by Professor Ames, which he has kindly permitted to be republished as an appendix to this volume. The primary division of the work into three parts was determined by the broad classification first given by Professor Ames in his History of Assumpsit, and adopted by Professor Keener in the introductory chapter to his Treatise on Quasi-Contracts. However, by far the greater part of the subject is comprised in Part III, under the general doctrine of "Unjust Enrichment," and the arrangement employed by the present editor for this part, while not the only feasible grouping, will, it is hoped, be practically satisfactory. As Dr. Johnson says in his essay on Pope: "Of two or more positions depending upon some remote or general principle, there is seldom any cogent reason why one should precede the other;" and so, while the cases in Part III depend upon the very general principle of "Unjust Enrichment," and while a cogent reason cannot always be given why some of these positions should precede others, nevertheless the special correlation of analogous topics has been the guide to the present arrangement. It may be added that the only essay at a completely developed classification of the law of quasi-contracts which has thus far been published, is the one offered tentatively by Professor Wigmore, in 25 American Laiv Reznezv, 695 (1891). Although I have endeavored, in the manner above stated, to throw the work, so far as its principal divisions are concerned, into a somewhat more systematic and logical form, i cannot flatter myself that I have carried out my design into all the details of the work. Such a task would have required far more leisure than I have been able to find in the short interval which has elapsed since the last edition, which is now exhausted, was published. Some little I have done, and morei hope to do, if I am permitted to revise another edition; but I must trust to the indulgence of the profession to excuse many defects of which I am painfully conscious. The reader will notice that the type has been enlarged, and that the Index is no longer printed in double columns, an alteration which will be found considerably to increase the facility of using it, as it admits of easier distinction of the subjects falling under each head by variations of the marginal spaces.
