Book excerpt: Excerpt from A Treatise on the Law of Partition of Real and Personal Property Of the merits of this work, if it has any, I have nothing to say. The author is indiscreet that does that. Let him launch his book upon the sea of public opinion. If the work is worthy and has merits, it will be a success; if not worthy and having no merit, it will sink. I now launch this work upon that great sea, which, upon matters of this kind, has neither sympathy nor favoritism. I trust that it will not sink. Book The Law of Joint Property and Partition in British India Classic Reprint

Download or read book The Law of Joint Property and Partition in British India Classic Reprint written by Ram Charan Mitra and published by Forgotten Books. This book was released on 2015-07-07 with total page 786 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Joint Property and Partition in British India The subject of this Treatise was the subject on which I delivered Lectures as the Tagore Law Professor for the year 1896 in the University of Calcutta. During the 16 years which have since elapsed, case-law has largely discussed several incidents of joint property, while legislature has made new provisions for the partition of revenue paying estates. In the present Edition I have attempted to discuss the principles in the light of the authoritative decisions up-to-date, without interfering with the old division of the subject according to the personal laws of the people in British India. This division of the subject will, it is hoped, facilitate the student in discriminating the principles of the different systems of law on the same questions, though it may inconvenience the busy practitioner who will have to refer to different parts of the Treatise in order to collect all the information on any question. But this inconvenience, it is hoped, will be minimized by a reference to the Index which will show at once where the same question has been discussed according to the different systems of law. Book excerpt: Excerpt from A Practical Treatise on the Law of Partition: With an Appendix, Containing the Statutes and a Selection of Precedents Having had occasion, in the course of practice, to consider one or two points arising on the sub joet of Partition, I found the law. Applicable to those points much scattered in the books. It oc curred to me, therefore, that as a work analyzing the general law of Partition would have greatly assisted my own researches, it might not perhaps he deemed useless by the Profession at large. Book Cases on the Law of Personal Property Classic Reprint

Download or read book Cases on the Law of Personal Property Classic Reprint written by John V. Brennan and published by Forgotten Books. This book was released on 2017-09-13 with total page 548 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Cases on the Law of Personal Property The purpose of this book is to set out and illustrate by concrete cases these fundamental principles. In selecting these cases, the author has kept in mind two things; viz., first, to include no case based on obsolete law; second, to include only so much of the case as is in point. The cases have also been arranged in such a way as to develop, in a logical order, the legal principles under discussion. As a further help to the student, a topical heading has been used for each case or group of cases the purpose being to give the student something definite to look for. The heading, however, in no instance, reveals the holding of the case, for the author has been as careful to pre vent legal conclusions being drawn from the headings as he has been particular in selecting suitable headings. The cases selected are of such a type and variety as to illustrate, in a comprehensive manner, the underlying principles of the law of Personal Property. Book An Epitome of Personal Property Law Classic Reprint

Download or read book An Epitome of Personal Property Law Classic Reprint written by W. H. Hastings Kelke and published by . This book was released on 2015-07-06 with total page 172 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from An Epitome of Personal Property Law The following pages, supplementary to an "Epitome of Real Property Law," deal with Personal Chattels. The subject is in some ways harder to epitomize. Since Bracton's artless enumeration quoted on the title page, personal property, especially in the form of choses in action, has ramified in all directions and become closely entangled with law of contract. None of the general treatises, in my opinion, make sufficiently clear the distinction between these two, property and contract: perhaps I have succeeded little (if at all) better than my predecessors, though I have tried to keep off contract, except where necessary for explaining the nature of certain kinds of property. Another difficulty lies in the multiplicity of statutory regulations. Here I have attempted to cull those only which affect property as such in its creation, the extent of its enjoyment, and most of all in the methods of its conveyance.
