The first degree of evidence, and that which, though open to error and misconception, is obviously most satisfactory to the mind, is afforded by our own senses.l Believe half what you yourself see, and a twentieth part of what you hear from others, is a maxim, founded in the main upon the experience of life, marking the vast distinction that obtains between a knowledge of facts derived from actual perception, and the belief of the existence of facts resting on information. In judicial proceedings, the judge or jury can seldom act entirely upon evidence of this description.2 In a vast number of instances, however, especially where the fact in dispute is sought to be proved by circumstantial evidence, the verdict will rest materially upon matter submitted to the ocular inspection of the jury. The learned judge, however, refused to allow this question to be put, and on a bill of exceptions, the House of Lords confirmed the ruling.1 Here, had the answer been in the afiirmative, it would not have been evidence, because money paid to quiet a complaint can be no proof that the demand was well founded; and even if it were evidence in favour of the party receiving the money, it could not be evidence on behalf of a stranger. Neither was the question admis sible in order to test the credit of the witness; for, raising, as it did, an irrelevant inquiry, the answer could not have been contradicted, had it been in the negative.
