Download or read book A Treatise on the Law of Conveyancing Classic Reprint written by W. B. Martindale and published by . This book was released on 2015-07-03 with total page 698 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Conveyancing This volume is designed to present, in a convenient form for ready reference, a concise, yet somewhat comprehensive view of the Law of Conveyancing, applicable to all the States. The aim of the author has been to condense the work by treating the subject with reference to general principles, and by stating, as succinctly as was found to be consistent with accuracy, the propositions decided by the courts, referring the reader to numerous and carefully selected authorities where more extended discussions of the various questions may be found. It has been attempted, in this manner to render the work of service to the profession, and at the same time to meet the wants of a large class of conveyancers, who are specially interested in this branch of the law. In the preparation of this treatise the author has had the valuable assistance of Mr. Lyne S. Metcalfe, Jr., of the St. Louis Bar, whose skill and experience in examining and digesting authorities, supplemented by an accurate knowledge of the Law of Real Property, has materially contributed to the completion of the work. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Dower: Particularly With a View to the Modern Practice of Conveyancing IN treating of Dower, it has been customary to consider it as founded on the three successive circumstances of Ma1r1age, Seisin, and Death Of the Husband. The concurrence of the two former is properly the ground -work of the title Of dower; the latter 18 its consummation. This chronological arrangement having at least the convenience of Obviousness, has been here followed. The subject of Marriage, so far as it is connected with the law of Dower, is Open to considerations which call for some degree of attention and discrimination on the part of the student, and may even exercise the acuteness of the experienced lawyer. The obvious business Of the pre sent treatise is rather to point out the principles and distinctions which are to be borne in mind in applying the numerous cases on marriage to questions of Dower, than to enter upon any substantive discussion of the cases themselves. Book excerpt: Excerpt from A Treatise on Conveyancing, Vol. 3: With a View to Its Application to Practice More than twenty years have elapsed since the essay now submitted to the public was announced by Mr. Butler in one of his valuable notes to the octavo edition of Coke on Littleton. At that time one half only of the volume had been written, and that half was in an imperfect state. In the interval, every authority which has occurred has been enlisted into the service of this work. Though merger be the subject, yet, in substance, the volume contains a Treatise on Estates, and may be considered as an essential part of the undertaking in which the author is engaged. Book excerpt: Excerpt from The Law of Real Property: With an Appendix of Forms of Conveyancing Adapted to the Law of the State of New York, and to States Having Similar Laws The law of real property has been fully discussed by the best of the English juridical writers. From the time when Littleton published his treatise upon tenures, more than four hundred years ago, successive writers have discussed the subject in all its bearings, and no portion of the English law has been more elaborately explained, none better illustrated. These works are of great value to the American student, and yet they are incumbered with much that is useless to him, much. Download or read book A Treatise on the Law of Real Property as Applied Between Vendor and Purchaser in Modern Conveyancing Or Estates in Fee and Their Transfer by Deed Vo written by Leonard Augustus Jones and published by Forgotten Books. This book was released on 2018-05-02 with total page 962 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Real Property as Applied Between Vendor and Purchaser in Modern Conveyancing or Estates in Fee and Their Transfer by Deed, Vol. 1 of 2 These volumes treat of the practical parts of the general subject of Real Property which arise in ordinary conveyancing between vendor and purchaser. They do not profess to cover the entire field of Real Property law. It is impossible in two or even three volumes to state the law and give the authorities relating to the entire subject. It is only possible in such compass to state general principles with a meagre citation of authorities. I write now, as I have written heretofore, with the purpose to state with considerable fulness the law of the topics of which I treat, - to state it with such completeness as to make the treatise valua ble to the courts and to practising lawyers. Moreover, I have intended to state the law only as it now is, with as little reference as possible to the law that has become obsolete. I have referred to the old law only for the purpose of stating the principles upon which some parts of the present law are founded. The subjects that present the most difficulties and give rise to the most litiga tion I have discussed with the greatest care. I have cited a great number of cases, and have cited them after examination for their value. The mode of treatment is similar to that I have adopted in my other works. It will be observed that I take up the subject of Real Property with the consideration of that part of it which is usually made the closing part in other treatises. Instead of beginning with the least possible estates in realty, going up through the larger estates, and finally at the end coming to something about estates in fee and their transfer by deed, I begin with this part of the subject. Book excerpt: Excerpt from A Treatise on the Law of Mortgages, Vol. 1 To the Student this work was originally ad dressed; but the subsequent editions have rendered it pre-eminently useful to the practical Lawyer, in discovering to him parallel cases, and in furnishing him with a systematic body'of law on a subject of very frequent recurrence. In short, the high repu tation of the original Work renders it an indispen sable part of every Lawyer's Library. Lt was the scarcity of so valuable a Treatise, that induced. The Editor to undertake the task of preparing a new edition for the press and be conceived that by adding the subsequent decisions and other practical information, he should be forwarding the design of the learned Author. The Editor' 8 Obj ect has been to make the present edition of Mr. Powell's Work a comprehensive digest of the theory and practice of Conveyancing, with reference _to Mort gage securities. Download or read book The Touchstone of Common Assurances Vol 1 written by William Sheppard and published by . This book was released on 2015-07-21 with total page 516 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Touchstone of Common Assurances, Vol. 1: Being a Plain and Familiar Treatise on Conveyancing The high reputation which the Touchstone has so long maintained, renders it an almost indispensible part of a Lawyer's Library. As a systematic body of Law relating to Real Property, it is a Work particularly valuable to the Student. It may, perhaps, be expected that some notice should be taken of what has been done to the present Edition. To say any thing about the quantity of the additional matter contained in it, would be quite superfluous; - the number of the notes and the copiousness of many of them, rendering it evident, that the additional matter is very considerable; and, from the smallness of the type in which the notes are printed, still more considerable than, from a cursory view, might be supposed. - How far indeed, the Editor's labours may be useful to the Profession, is not for him to determine. It may be proper to observe, that he has taken a new, and it is hoped a more correct view, of several important points on the subject of Fines. The same may be observed with respect to Leases.
