But some things may be presumed. From the facts stated. Thus, if the case states the satisfaction of a mortgage, it will be presumed that the debt was extinguished.$5 Of course, the court cannot go outside of them in forming a decision.86 It is just as important that all the facts out of which the question arose should be stated, otherwise the court can render no decision.37 Should, therefore, the parties neglect to ascertain the sum for which the judgment is to be ren dered, the court ought not to proceed until the case is perfected. Those who use volumes one and two are reminded that two more volumes will, in due time, appear treating of the different legal actions or remedies now in use, and that many matters which might have been presented in these volumes are reserved for presentation in them. Many, perhaps most matters, might be presented with equal appropriateness in the general chapter to which they relate, or in the chapter dealing with the particular action or remedy to which they are also related. If therefore they are not found in these volumes, the reader is besought to trust the revisers' statement that they are reserved for the other volumes. It certainly is their intention to include in the entire work all the principles and rules of practice and every important case applying to them. Another feature of the present edition is the addition of a very large number of forms. Besides those in volumes one and two, many more will appear in the two concluding volumes; in short, this edition will aim to give all the forms deemed most useful to the legal practitioner. Troubat and wil liam W. Haly, two distinguished and learned members Of the Phila delphia Bar, was presented to the Profession in the year 1825, in one thin octave volume; a second volume appeared in 1829. It immedi ately took high rank as a professional text-book; and probably no gentleman has since been admitted to our Bar, who has not drawn from its pages his first knowledge Of the intricacies of Practice. In 1837, the same learned gentlemen favored the profession with a second edition, in two volumes. Shortly after the publication of this edition, Mr. Troubat retired from active practice, and Mr. Haly, at the time of his sudden and fearful death, on the 27th of December 1851, in the destructive fire, at Sixth and Chestnut streets, in the City of Phila delphia, had made great progress in the preparation of a third edition. The materials collected by Mr. Haly were placed in the hands of Dr. Francis wharton, the well-known legal writer, and by him the third edition was prepared for the press. This edition was enriched by the insertion of the manuscript notes of decisions of the present Chief Justice sharswood, then President Judge Of the District Court of Philadelphia. These valuable cases have been retained in the present edition, with the exception of a small number, which have been subsequently overruled, or rendered obsolete by legislation. Dr. Wharton'8 edition was published in 1853. The fourth edition, which appeared in the year 1867, was edited by the late asa I. Fish, Esq. Barlow was convicted in the court of Quarter Sessions of Luzerne county, and judgment was given in November 1806, that he should be imprisoned at hard labour, &c. for two years in the gaol of the county of Philadelphia, and pay a fine of ten dollars. The error assigned is, in that part of the judgment which directs the imprisonment to be in the county of Philadelphia. By the 4th section of the act of 5th April 1790, intitled "An act to reform the penal laws of this state," every person convicted of an offence, for which by the laws in force before the act intitled "An act to amend the penal laws of "this state," burning in the hand, cutting off the ears, nailing the car or cars to the pillory, placing in and upon the pillory, whipping or imprisonment for life may be inflicted, shall, instead of such parts of the punishment, be confined and kept at hard labour, &c. for any term not exceeding two years at the discretion of the court. This general description includes the crime of perjury. By the 28th section of the same act, the malefactors sentenced to hard labour in the several counties of this state, other than the county of Philadelphia, shall be employed in the several gaols and workhouses of the respective counties in which they were convicted; but by the 34th section of the same act, any felon convicted in any county, other than the county of Philadelphia, of any felony, for which he shall be sentenced to hard labour for the space of twelve months or upwards, may, at the discretion of the court before whom he shall be convicted, within three months after such conviction be removed to the gaol in the county of Philadelphia, and therein be confined at hard labour, &c. By the act of 21st March 1806, the court before whom any person is convicted of felony or larceny, and sentenced to undergo imprisonment at hard labour, &c. for any term not exceeding three years, may direct the imprisonment, &c. to be in the gaol of any county within the commonwealth, or in the gaol and penitentiary of Philadelphia. J - Being unshackled by danger of disturbing titles, .it is our duty to interpret the statute according to its oh vious intent. To ascertain the object which the legislature de signed to accomplish, we must look to the mischief and the remedy. Debtors have been prejudiced, and purchasers perplexed by neglect of judgment creditors to enter satisfaction of record when actually obtained and the legislature interfered so far as to command the creditor to acknowledge satisfaction within a specified period after request made. This remedy being found inadequate, and the legislature declaring that the provision theretofore made for preventing the risk and inconvenience to purchasers of real estate by suffering judgments to remain an indefinite time without any process to continue or revive the same, hath not been effectual do what Direct the party to give notice by process of scire facias, or execution according to the stat. Westm. 2? Not at all. Had that been the sum of the matter, they would have stopped short with the first section, which declares that no judgment *shall be a lien for more *13 than five years, unless the plaintiff, within that time, sue out a scire facias to revive it instead of which, there is in the 'succeeding sections a mandate that the writ be pursued to judg ment, the form of which is directed to be, not that the plaintiff have execution, but that the original judgment be revived for another term of five years. The renewal of the lien, therefore, is by Virtue of the judgment of the court, the old lien continuing in the meantime, at least to give the plaintiff a reasonable 0p portunity to prosecute his writ to its consummation. We are not going to say that nothing less than a judgment formally pro nounwd will be available. On the contrary, we have held a judgment by consent in an amicable scire facias, to be a com pliance with the Spirit of the law; and there would be little difficulty in maintaining that any confession or agreement that the lien endure for the specified period, is within its purview. Book excerpt: Excerpt from Reports of Cases Adjudged in the Supreme Court of Pennsylvania, 1812, Vol. 4 Hall for the defendants in error did not deny the importance of the consideration to a deed of bargain and sale; but he said the plaintiffs in error had now placed themselves in the situation of persons asking for a specific performance; and as the court must be satisfied from examining the notes of the trial and the judge's charge, that Quigley had been guilty of shuffling and prevarication to avoid paying for the land, they would not give him the benefit of the objection which had been raised. In reply it was said, that the question did not turn upon the propriety of a specific performance, but upon the point, whether the judge had erred in law in his charge to the jury. If the judgment is affirmed, the opinion of the judge upon all points on which it was delivered, is declared to be good. Tilghhan, C. J. This is a writ of error to the Common Pleas of Northumberland county, founded on the opinion of the president of that court reduced to writing, and filed according to the act of assembly. The plaintiffs had sold to Christopher Quigley one of the defendants a tract of land, for which he had paid a small part of the consideration money, and entered into possession in the year 1791. In 1795, the agents of the plaintiffs tendered to Quigley a deed of conveyance, and demanded payment of the balance of the money. Quigley refused to accept the deed; in consequence of which, the plaintiffs considered the contract as void, and brought this ejectment. Several objections were made to the opinion delivered by the president. I shall take notice of only one of them, because it is decisive. The deed tendered by the plaintiffs was executed by five persons, three of whom were men, and two, married women. It was acknowledged according to law, but there was a blank left for the consideration. There was evidence, that the agent of the plaintiffs was authorized by them to fill up this blank. Under these circumstances, the president of the Court of Common Pleas was of opinion, that the deed was sufficient.
