He has carefully examined all the recent cases, and inserted in the notes every case which has applied the principles laid down in the text decided since the appearance of the last edition. In this way citations to upward of nine thousand new cases have been made. At the end of each chapter, under the head of Points requested for the defence improperly refused, and erroneous charges, a state ment of cases designed as, Suggestions for the Defence, has been made. All those cases relating to the subject of a chapter in which a conviction has been set aside on appeal, either because the trial Judge has refused to affirm a point submitted by the defendant's attorney which ought to have been affirmed, or because there has been error in his charge to the Jury, have been collected and arranged. In every case the words of the point improperly refused or the erroneous charge are given. It is believed that a lawyer having a client to defend will find practical assistance in the preparation of his points from these collections of cases. It is thought that the addition of the date of the decision to the citation will be of use both to the busy lawyer, who desires to look at only the latest authorities, and to the student, who wishes to follow the development of the law. When authorities are few he may be to some extent a prophet and an originator; but as the ground is more fully covered in detail by judicial decisions, he necessarily limits himself more strictly to an orderly arrangement and con cise statement of that which has been determined; and finally when the number of adjudications on the subject which he is considering has become so great as to cover practically all the important questions which are likely to arise, his function is to put all in order and preserve a proper perspective which shall make general and well-established principles stand out boldly among the bewildering details of complicated cases, without obliterating distinctions which may be of the greatest im portance when they are pertinent, but would mislead if mag nified into prominent dividing lines. It is futile to speak of one of these functions as greater than another. I believe there is not now in general use any work especially devoted to the subject, and no one has, so far as I am aware, either professed or attempted to take an exhaustive view of this branch of the law. Yet a table of some five thousand cases, cited in this volume, and nearly all of which are in some way directly applicable to attorneys and counsellors at law, should seem to indicate that questions in regard to the subject-matter have commanded the attention and called for the adjudication of courts with considerable frequency; and that lawyers have been in the past, and 'doubtless will be in the future, by no means exempt from litigation wherein they figure not as attorneys alone, but as parties litigant, by reason of their profession. It has occurred to the writer that an exclusive treatise, attempting to present the law governing the attorney as an officer of the court and as the representative of his client, would be of convenience to the profession, and perhaps in some degree lessen its labors, and assist its members in arriving more readily at a just ascertainment of their own rights and lia bilities, in their relations to court and client. The reader will perhaps be not displeased if the general design of the work is now disclosed in its more prominent outlines. Book excerpt: Excerpt from Institutes of American Law, Vol. 1 of 2 Most lawyers have felt the want of a preliminary work to serve the young American student as a guide in the labyrinth of jurisprudence; as an instructor to give him a general view of the several parts of this judicial science; to mark the objects of each, and to point out the natural dependence which unites them; a work tending to establish a method which should be adopted in the study of the law; to point out the numerous links of the chain which unites the ancient with the modern law, which binds the past with the present, and which by its nature must for ever remain indestructible. A work which would thus elevate the science of the law in the sight of youth, and impress a character of unity upon it, would exercise a happy influence on the minds of the students, develop their moral and intellectual faculties, and be a blessing to them. But it is far less difficult to describe what the legal edifice should be, and to state what is required for its construction, than to select the materials of which it should be composed, and to make such a disposition of them in the building as would render the structure at once solid, elegant, and every way fitted for the purpose for which it is intended. On entering on his profession, the American student is discouraged by being obliged to study laws which are not his own, and which do not belong to the present age, except as matter of history. It requires an effort to read even the elegant Blackstone, and, when studied, it must be forgotten, because the laws on which that author has so beautifully commented are not the laws which the young aspirant seeks to know - they are not those of his country. It is true, noble efforts have been made by American writers to explain our laws, and to them the profession must be greatly indebted; but the commentaries which have been so liberally bestowed are better adapted to the use of those who are already good lawyers, than to teach one who has every thing to learn. The author cannot hope to have made a perfect work, and supplied, in this respect, all the deficiencies and the wants of the profession; his aim has been an approximation to what a work should be which might, in some degree, deserve the title of Institutes of American Law. He has endeavored to reduce the whole to a strict method, and, by a correct classification, to impress upon the mind of the student the objects of his inquiry; for, what is well classified is half known. It seemed to him that jurisprudence, as much as any other science, required this method; and while all kinds of human knowledge are now taught in this manner the law should not be an exception. The mere fact that he becomes a creditor of the defend ant after a judgment was entered will not enable him to impeach it, if it was not suffered in view of his becoming such creditor.' A grantee of land which' is subject to a judgment lien cannot attack the judgment on any ground not open to the defendant.' A creditor or purchaser from the judgment debtor cannot impeach a judgment except Upon the same facts which would entitle him to impeach a deed made by the debtor at the same time and for the same purpose.
