Book State Religion Relationships and Human Rights Law

Download or read book State Religion Relationships and Human Rights Law written by Jeroen Temperman and published by BRILL. This book was released on 2010 with total page 441 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents a human rights-based assessment of the various modes of state religion identification and of the various forms of state practice that characterize these different state religion models. This book makes a case for the recognition of a state duty to remain impartial with respect to religion or belief in all regards so as to comply with people s fundamental right to be governed, at all times, in a religiously neutral manner. As this book demonstrates through the various case studies there is increasing interest and concern at the manner in which questions concerning the enjoyment of the right to the freedom of religion or belief bear upon key questions concerning the governance of democratic society. Issues raised involve matters concerning employment, education, expression, association and, more generally, the interface between religion and political life. The existing literature often traces these concerns back to the need to consider the place of religion in contemporary society but leaves matters there. Another body of academic literature explores the theoretical dimensions of that relationship but fails to connect it to the practice of states in order to test out the propositions which are the product of these reflections. The great virtue of this work is that is seeks to unite these various enterprises and engages head on with the challenges which this produces The aim is to demonstrate and illustrate the key contention: that there is an emergent right to religiously neutral governance, and that this is incompatible with the continuation of systems which offer preference to particular forms of belief system religious or otherwise. A chief virtue of this book is that it works through the consequences of this claim in a fearless fashion, posing challenges for those states which continue to use their legal frameworks to offer support (directly or indirectly) for historical, dominant or favoured forms of religion or belief. It challenges received assumptions and, by driving the logic of contemporary human rights thinking to the foundations of state-religion relationships performs a valuable service for those engaging with this most difficult and timely of questions. Book Religious Expression in the Workplace and the Contested Role of Law

Download or read book Religious Expression in the Workplace and the Contested Role of Law written by Andrew Hambler and published by Routledge. This book was released on 2014-10-24 with total page 321 pages. Available in PDF, EPUB and Kindle. Book excerpt: The workplace is a key forum in which the issue of religion and its position in the public sphere is under debate. Desires to observe and express religious beliefs in the workplace can introduce conflict between employees and employers. This book addresses the role the law plays in the resolution of these potential conflicts. The book considers the definition and underlying motives of religious expression, and explores the different ways it may impact the workplace. Andrew Hambler identifies principled responses to workplace religious expression within a liberal state and compares this to the law applying in England and Wales and its interpretation by courts and tribunals. The book determines the extent to which freedom of religious expression for the individual enjoys legal protection in the workplace in England and Wales, and asks whether there is a case for changing the law to strengthen that protection. The book will be of great use and interest to scholars and students of religion and the law, employment law, and religion and human rights.

Book Research Handbook on Interdisciplinary Approaches to Law and Religion

Download or read book Research Handbook on Interdisciplinary Approaches to Law and Religion written by Russell Sandberg and published by Edward Elgar Publishing. This book was released on 2019 with total page 464 pages. Available in PDF, EPUB and Kindle. Book excerpt: Following 9/11, increased attention has been given to the place of religion in the public sphere. Across the world, Law and Religion has developed as a sub-discipline and scholars have grappled with the meaning and effect of legal texts upon religion. The questions they ask, however, cannot be answered by reference to Law alone therefore their work has increasingly drawn upon work from other disciplines. This Research Handbook assists by providing introductory but provocative essays from experts on a range of concepts, perspectives and theories from other disciplines, which can be used to further Law and Religion scholarship.

Book The Effect of the Eeoc s Proposed Guidelines on Religion in the Workplace

Download or read book The Effect of the Eeoc s Proposed Guidelines on Religion in the Workplace written by United States Committee On Th Judiciary and published by Forgotten Books. This book was released on 2018-02-13 with total page 188 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Effect of the Eeoc's Proposed Guidelines on Religion in the Workplace: Hearing Before the Subcommittee on Courts and Administrative Practice of the Committee on the Judiciary, United States Senate, 103rd Congress, Second Session on a Hearing to Review Eeoc's Proposed Guidelines on Religion in the Workplace; June 9, 1994 Today, we will hear from experts in labor and constitutional law, representatives of religious communities, and a businessman who would be forced to implement these guidelines and deal with them on a day-to-day basis. We cannot forget that these guidelines could be a tremendous burden for employers, who would be forced to make policies in anticipation of employee reaction to almost every manifestation of religious belief. In doing so, religious freedom would be suppressed by employers, who would be forced to create a politically correct workplace simply to avoid legal problems. Before we proceed, let me say that it is my understanding that the eeoc is aware of many of the problems involved with these guidelines and is working to clear up problems. I am optimistic that these hearings will provide an opportunity to constructively discuss these problems with a variety of perspectives. I thank all the witnesses for taking time to be with us here today and for their thoughtful testimony. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
