The committee explores the ideas, implementation issues, and legislative initiatives behind the tradition of special education for people with disabilities. It investigates the policy and practice implications of the current reform movement toward high educational standards for all students. Educating One and All examines the curricula and expected outcomes of standards-based education and the educational experience of students with disabilitiesâ€"and identifies points of alignment between the two areas. The volume documents the diverse population of students with disabilities and their school experiences. Because approaches to assessment and accountability are key to standards-based reforms, the committee analyzes how assessment systems currently address students with disabilities, including testing accommodations. Book excerpt: In 2005, the Texas Education Agency implemented a new accountability measure for school districts that penalized those that had more than 8.5% special education enrollment. The policy that lasted for over a decade and its implications, which continue to this day, created inequitable access to services for students with disabilities of all socioeconomic and racial/ethnic backgrounds as school leaders struggled to keep percentages down. Researchers and advocates provided ample evidence that Texas was artificially suppressing special education enrollment using narratives and statistical analysis by arguing that the state had an 8.7% enrollment compared to a national average of 14%. The evidence got the attention of the U.S. Department of Education, which issued a report in 2018 confirming the agency's multiple violations and including corrective actions. Most compelling was that the policy resulted in some estimates to be around 25,000 students with disabilities not receiving a free appropriate public education. One of the fastest growing segments of special education is autism; yet, as many as 36% of those with an eligible autism disability are not receiving services, which may have been exacerbated by the special education cap policy. Current research is clear on why this happens: poor evaluator training; inappropriate assessment tools; and insufficient funding. However, many of these barriers to services could be resolved by implementing the inclusion mandate, which includes community resource involvement and collaboration in the eligibility process. The purpose of this study was to examine how the Texas special education cap policy affected families with autism, in particular the student with a medical diagnosis of autism enrolled in a public school, in receiving services and their perspectives of school administration as agents of oppression, which may be continuing today. Themes were analyzed against a community model framework based on critical disability theory, including collateral costs of eligibility denial, lack of quality evaluators and training as a major factor, and a pervasive "culture of denial" that appears to exist today. Recommendations were provided so that school administrators and district leaders can take immediate corrective action. In doing so, I hope to change the systemic factors that created and continue to propagate inequities for families with autism.

Board of Education, a decision that declared segregated schools cannot be equal, it affirmed the right of every student access to equal education. Prior to this law students with disabilities were taught in separate facilities. This court case deemed the separation as unconstitutional and students with disabilities were able to attend schools amongst general population. Despite this ruling there has still been academic achievement gaps amongst students in the public education system. No child left behind Act made this issue a national crisis. The law reassessed the public-school system and decided American students needed proficiency in reading and Mathematics. It also aimed to increase graduation rates for all students. But, did NCLB really include all students? Did it account for those 6.7 million enrolled in special education programs? This report assesses stakeholder perception of NCLB as it relates to disabled student's education objectives. The researcher evaluates NCLB by comparing measurement of assessments with the intended goal to have all public education students graduate. While there are different types of assessments given to students with disabilities, all students are required to be assessed yearly. We will answer the question according to stakeholders, under NCLB is the United States public school system failing students with special needs? Stakeholders who would be most concerned and involved with this policy includes parents of disabled students, teachers, administrators and policy makers. We found that NCLB did shed light on educational discrepancies in public school education. For example; there was a high number of students not proficient on their assessment because the exam was not tailored to the students IEP. It is important to realize that education policy derives from a top down approach were policy makers prescribe solutions for educational hurdles that arise for general population students in public schools. The issue we found with the NCLB act is that this approach must be bottom-up to adhere to the many conflicts in educating students with disabilities. National education policy can use this study to include more special education framework and collaborative governance at the start of policy formation. We concluded that NCLB made shortcomings in education for students with disability a frequent topic of discussion, however it did not increase graduation rates for disabled students.

Book excerpt: Responding to concerns that charter schools do not provide equal access to students with disabilities, advocates in districts, states, and courts across the country have sought to improve such access. Adding to these concerns, the U.S. Government Accountability Office recently released a report showing that charter schools, on average, serve a smaller proportion of students with disabilities than do district-run public schools. In New York, state lawmakers amended the New York State Charter Schools Act in 2010 to include enrollment targets for particular student groups. According to the amended law, charter school authorizers must set enrollment and retention targets for students with disabilities, as well as for students eligible for free and reduced-price meals and English language learners. Failure to meet the targets or make diligent efforts toward them could be considered a factor in the renewal of a school's charter. Broadly, these policies were developed to make certain that students in these traditionally underserved groups are provided full access to charter schools. In this report the authors provide some context to these policy responses to special education enrollment in charter schools by describing the distribution of students with disabilities in New York State charter and district-run schools. The authors show that different levels of comparison--state level, school type, district level, and authorizer level--yield different results, and comparisons at high levels of aggregation (such as those made at the state level) mask important information and variation.
