Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Sketch of the Criminal Law As the Court of Parliament does not seem particularly likely in the immediate future to trouble itself with codifying the Criminal Law, and as text-books will not be till then (even if then) rendered unnecessary, it is hoped that this little work may have its usefulness and its sale. I have not attempted in its pages to be exhaustive or learned. My object has been simply to give the reader a sketch of those elementary principles of the criminal law and practice with which not only every law student, but every intelligent citizen, ought to be familiarly acquainted. "The learning touching these subjects," says Mr. Justice Foster in the Preface to his Discourses on Crown Law, "is a matter of great and universal concernment. It merits, for reasons too obvious to be enlarged on, the attention of ever man living." Indeed, so great and so unquestioned is the importance, in the interests of the community, of a knowledge of the general principles of the criminal law, that it is a matter for surprise and regret that they should not form a regular branch of study at our public schools and other educational establishments. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Outlines of Criminal Law In preparing the book, I have aimed at making its range of topics no wider than may be grasped, upon a first perusal, even by a reader previously unfamiliar with law. But I have tried to treat each individual topic with such fulness as may serve to fix it effectually in the reader's memory. Yet the susceptibility of his memory must depend very much (as all lecturers soon discover) upon the extent to which the matter in hand arouses his interest. Fortunately the law of Crime - when once the pre liminary difficulties attendant upon the chaotic form which it still retains in England have been faced and surmounted - is a branch of jurisprudence peculiarly capable of being rendered interesting. It is Closely linked with history, with ethics, with politics, with philanthropy. My endeavour has been to make it attractive to the reader, by supplying him with enough illustrative examples to give vividness and reality to all the abstract principles of our Criminal Law and also by tracing out its connexion with the past sufficiently to explain the various historical anomalies with which it is' still encumbered; and. Book The Prisoner at the Bar

Download or read book The Prisoner at the Bar written by Arthur Train and published by Forgotten Books. This book was released on 2018-02-07 with total page 412 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Prisoner at the Bar: Sidelights on the Administration of Criminal Justice The favorable reception accorded to the Prisoner at the Bar, not only in the United States but in England, and the fact that it has won a place in sev eral colleges and law schools as a reference book, and in some instances as a sort of elementary text book upon criminal procedure, have resulted in a demand for a new edition. When the book was writ ten the author's sole intention was to present in readable form a popular account of the administra tion of criminal justice. Upon its publication he discovered-to his surprise that it was the only book of its exact character in the English language or perhaps in any other. Reviewers pointed out that whereas there were annotated text-books of crim inal procedure and isolated articles on special top ics, most of them relating to the jury system, there was in existence no other sketch of criminal justice as a whole, from arrest to conviction, based upon either actual experience or hearsay. Book excerpt: Excerpt from Criminal Law, Vol. 1: Instruction Paper If the party defrauded is also guilty of a violation of the law, he, too, should be prosecuted, rather than his offense should serve as a shield to the other's crime. The offense is committed against the public, and not against the individual. The guilty party is prosecuted in the interest of the people of the state, and not in the interest of the party defrauded of his property. There is no principle of law that will bar the state from prosecuting a criminal because some other person is a particeps criminis. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Our Criminal Criminal Law This is a day of progress, reform, amendment and change. Whether the changes made in the things and processes we have been accustomed to will all result in benefit may well be doubted and the test of time and experience alone can determine, but that many amendments and corrections brought about by the present almost universal desire to review the past and enact new regulations for future conduct will ameliorate our political conditions is evident. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Handbook of Criminal Law IN preparing a new edition of Mr. Clark's book, no depar ture from the original plan of the author has been made. The book is intended, as explained in the preface to the first edi tion, to contain a concise, but full, statement of the general principles of the criminal law, exclusive of criminal proce dure, which has been made the subject of a separate volume in the Hornbook Series by the same author. The editor has incorporated much new matter, which has necessitated chang es in the original text, and has made other changes which were suggested to him by a use of the book in the classroom. Many additional cases, most of them reported since the first edi tion, but some of them earlier leading cases, have been cited. Book excerpt: Excerpt from Outlines of Criminal Law, for Use of Students Whatever may be thought of the advantages or defects of the plan of giving instruction by oral lectures, there seemed to be no other course to pursue in reference to this subject, for the treatises on criminal law are too voluminous, to say nothing of their cost, for use in a course where but a portion of the time for not more than three weeks can be given to the study, and the smaller works which have been written, in general devote too large a portion of their space to discussing. Particular crimes, many of which are of comparatively small importance and regulated by statute, and give too little attention to those principles which are applicable to all crimes.
