Book excerpt: Excerpt from Outlines of English Legal History A year ago it became my duty as one of the Readers to the Council of Legal Education, to deliver, at short notice, a course of lectures on Royal Justice in this country. The information which had to be gathered from many books, some out of print, others of great price, few to be found except in great libraries, I now place at the disposal of those who take, at the least, a passing interest in the subject. Inaccuracies and inelegancies I am sure that I have not entirely avoided. If on some points I have spoken without certainty, it should be remembered that our information is not yet, and may never be, complete. On some topics, such as the Justices of the Forest and of the Jews, I have chosen to be silent and await the promised records of the Selden Society. I desire here to acknowledge my great debt to the Rolls Series, the Acts of the Privy Council, and the invaluable volumes of the Selden Society. James F. Colby, iii Widely considered the father of legal history, Frederic William Maitland [1850-1906] was an English jurist and historian best known for the standard The History of English Law Before the Time of Edward I, 2 vol. (1895), written with Sir Frederick Pollock. He was educated at Eton and Cambridge and studied at Lincoln's Inn, London. Maitland was called to the bar in 1876, then practiced until 1884 when he became a reader in English law (1884) and professor (1888) at Cambridge. He founded the Selden Society in 1887. Hailed for his original outlook on history, his works profoundly influenced legal scholarship. An extraordinarily productive career was shortened by his death from tuberculosis at age 45. Francis C. Montague [1858-1935] was a Professor of History at University College, London and Lecturer in Modern History, Oriel College, Oxford. He was also the author of The History of England from the Accession of James I. to the Restoration (1907) and The Elements of English Constitutional History from the Earliest Times to the Present Day (1910). James F. Colby [1850-1939] taught international law at Yale Law School from 1883 until 1885. He later taught history and political economics at Dartmouth College, and was Parker Professor of Law and Political Science at Dartmouth College from 1885-1916 and lectured in jurisprudence and international law at Boston University Law School from 1905-1922. But we have always sacrificed science and symmetry on the altar of utility. Our judges from time im memorial would rather give an ephemeral judgment doing practical justice between a man and his neigh bour than deliver one of lasting reputation dealing with great interests and world-wide principles; our courts, in which all classes of our laymen take their places as Spectators, litigants, jurymen, or assessors, have been constructed and altered and reconstructed to suit their varying notions of convenience; and our legislators being men not mainly of law, but of business, have made their laws to meet the daily and hourly requirements of the people and to render more easy and more safe the duties of their social life. For the social life of English men, from the time when they shouted under the uplifted spear to the time when, as now, they sit with apparent content in the wooden boxes which the custom of many generations has consecrated to their use, has ever been concerned with the administration of justice to an extent unknown probably in any antient, certainly in any modern state. When, therefore, it was suggested to me to write some account of our Courts of Law, I recognised that such a theme did form part of our social story and might fairly be a chapter in our national life.
