Book excerpt: Excerpt from A Selection of Cases on the Law of Carriers of Goods and of Passengers Although this collection of cases as now published remains substantially the same as when the Cases on Carriers of Goods were published three years ago, and the Cases on Carriers of Passengers were added a year later, making the first complete edition, yet there have been such changes in plan as to make an entirely new preface proper; and the former one is omitted as not applicable to the book in its present form, although the general purpose and plan have not been materially changed. Three principal considerations have been borne in mind in the selection of the cases to be included: First, to secure at least one case on each question involved in the law of carriers upon which the instructor would feel that he ought to give his class information, so that the collection will serve substantially the purpose of a text-book. Second, to select cases which present the principles of the subject by way of adjudication of actual controversies before a court, and not merely by way of dictum or argument in laying down the general propositions of law on the subject. These text-book cases are apparently satisfactory to the novice in the study of cases, because they seem to serve the purpose of a treatise, but they are not the cases which carry the greatest weight when cited, and therefore are not the cases which the student should master in determining what the law is. The plan of this work is the same as that of the author's work on Negligence, and the table of cases embraces aconcordance of citations constructed on the same plan. The book is thus designed to give the practitioner the advantage of a number of leading cases, combined with a treatise, upon a considerable title of the law. No treatise on the law of carriers would be complete unless it contained references to cases decided in the United States. The enormous distance between the different towns in that country has made this branch of the law one of extreme importance there, and the treatises of Story and Angell on it are held in reverence by lawyers throughout the world. The writer hopes a generous allowance will be made for shortcomings, as the branch of law dealt with con tains somewhat intricate questions connected with the receiving and forwarding of traffic, and the equal treat ment of the public by railway and canal companies. The Railway and Canal Traffic Act, 1888, is set out in the Appendix, and noticed in the text. The writer has not dealt with the practice before the Railway and Canal Commissioners, as the procedure is not yet settled; and he intends hereafter to devote a separate work to the subject. The writer desires to acknowledge valuable assistance in revision of the proofs which has been rendered to him by his friend, Mr. Yarborough anderson, of the North Eastern Circuit. Book excerpt: Excerpt from Carriers' Law: Relating to Goods and Passenger Traffic on Railways, Canals, and Steam Ships, With Cases I am led to consider such a book as this necessary from the diffi culty I have always experienced in obtaining information on Carriers' Law from ordinary law books written by barristers, and other railway officials will probably have experienced a similar difficulty. In such text - books one can seldom find the required information on the particular point that may be at issue. This may arise from barristers writing books technically obscure to the possible litigant who may be able to pay for an opinion, or it may arise from the technicalities of a carrier's business being too obscure for barristers to eliminate from the trials the essential points upon which a carrier requires information. It is likely that both these causes may have contributed to render barristers' books unsuited as legal guides to common carriers. Furthermore, barristers' books are commentaries on legal decisions, whereas a carrier wants the actual case as unfolded at the trial; that is to say, the facts stripped of legal technicalities, with the material part of the Judge's decision added thereto. This is exactly what has been attempted in the following pages. In fact, I have taken the law, as unfolded by the Judges, and classified and fitted it into the railway frame ready for easy reference. In the main I have abstained from being a commentator, preferring rather to collate the words of the Judges and apply them directly to the sections of the business to which they relate.
