Book A Practical Approach to Conditions of Contract for Civil Engineering Works

Download or read book A Practical Approach to Conditions of Contract for Civil Engineering Works written by David Y.K. Leung and published by Hong Kong University Press. This book was released on 2010-08-01 with total page 267 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a comprehensive commentary and guidance to readers on the current edition (1999 Edition) of General Conditions of Contract for Civil Engineering Works (the "General Conditions"), which the Hong Kong Government uses for all its civil engineering contracts. The book describes 46 out of 90 clauses in the General Conditions and their practical application, with explanations in plain and simple language under such headings as Commentary, Analysis and Application. The listing of equivalent clauses of the more user-friendly English ICE Conditions and the international FIDIC Conditions together enables the readers to understand the meaning of the General Conditions from a different context. For those readers who find it easier to read in Chinese, the translation will help them to compare with and understand the original English text. The book is therefore useful to students, consulting engineers, surveyors and lawyers who want to understand more about the Hong Kong construction practice.

This book was released on 2013-04-22 with total page 229 pages. Available in PDF, EPUB and Kindle. Book excerpt: When all parties involved in the construction process fully understand their roles and are able to anticipate potential points of conflict, disputes and delays will be minimised. The Employer’s and Engineer’s Guide to the FIDIC Conditions of Contract sets out the essential administrative requirements of a FIDIC based contract by reference to the FIDIC 1999 Red Book. The obligations and duties of the Employer and the Engineer are identified and discussed. Potential pitfalls are highlighted and likely consequences pointed out. The importance of the Employer’s role in the preparation of tenders, which fully reflect his requirements and duties and obligations arising in the execution of the works, is emphasised. The key role of the Engineer in the effective administration of contracts after award is examined and commentary provided. Included in the guide are a number of appendices, including model letters which will be of value to less experienced staff (particularly those whose mother-tongue is not the English language). Engineers, quantity surveyors and project managers engaged in the contractual administration of international projects using FIDIC forms of contract will find the concise guidance in simple and jargon-free language provided here invaluable. This, together with the author’s earlier book, Contractor’s Guide to the FIDIC Conditions of Contract - which describes the duties, rights and responsibilities of the Contractor – represents the totality of supervision, design and execution of construction projects executed under the FIDIC Conditions of Contract. Book Practical Guide to the NEC3 Engineering and Construction Contract

Download or read book Practical Guide to the NEC3 Engineering and Construction Contract written by Michael Rowlinson and published by John Wiley & Sons. This book was released on 2015-12-14 with total page 357 pages. Available in PDF, EPUB and Kindle. Book excerpt: Launched in 1993, the NEC Engineering and Construction Contract has become one of the UK's leading standard forms of contract for major construction and civil engineering projects. The third edition, popularly known as NEC3, is a process based contract embodying project and commercial management best practice, so its basic philosophy differs from the more adversarial approach of other standard construction contracts. Since the first edition of this book, the third edition of the contract has seen the introduction of a new secondary option for use in the UK and amendments to a number of clauses. In addition, in September 2011, changes were introduced to cater for the amendments to the Housing Grants, Construction and Regeneration Act 1996 contained in the Local Democracy, Economic Development and Construction Act 2009, which became effective for all new contracts entered into from 1 October 2011. These amendments have been incorporated into the text. A Practical Guide to the NEC3 Engineering and Construction Contract will be useful to everyone in the construction industry working on a project under this contract. It will be of interest to the complete construction supply chain, including employers, construction professions, contractors and sub-contractors, as well as consultants and lawyers advising any of these parties, either in the preparation of contract documentation or the day to day management or the resolution of problem situations which may arise.

Book FIDIC Plant and Design Build Form of Contract Illustrated

Download or read book FIDIC Plant and Design Build Form of Contract Illustrated written by Raveed Khanlari and published by John Wiley & Sons. This book was released on 2017-05-05 with total page 344 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Conditions of Contract prepared by FIDIC are used extensively as the standard contract of choice in international construction and civil engineering projects. Engineers working on these projects need to be aware of these contracts, but as the forms are complex it can be difficult to draw together all the sub-clauses relating to a particular issue. The FIDIC Plant and Design-Build Forms of Contract Illustrated crystallizes the requirements of the FIDIC P&DB contract into a range of simple to follow flow charts, providing a clear and concise way to rapidly assimilate the requirements of each clause. The relationship between the various clauses in the contract, the concepts, process methods and actors involved in each sub-clause are all easily seen, and key issues around each topic (such as periods allowed, notices, etc) are all documented. In addition, related sub-clauses and/or important additional documents are linked so that the reader has a full understanding of the wider implications of each clause.

Book Practical Guide to the NEC3 Professional Services Contract

Download or read book Practical Guide to the NEC3 Professional Services Contract written by Michael Rowlinson and published by John Wiley & Sons. This book was released on 2012-05-08 with total page 221 pages. Available in PDF, EPUB and Kindle. Book excerpt: Currently in its third edition, the NEC suite has become one of the UK’s leading families of standard forms of contract for major construction and civil engineering projects. Part of the NEC suite, the Professional Services Contract (PSC) was drafted with the same process-based approach and objectives, offering a standard contract for the appointment of consultants providing professional services in an engineering or construction project. Embodying best practice in terms of project management, the basic philosophy of the PSC differs from the principles and approach of other standard contracts used to appoint consultants. This book is a practical guide to the application of the PSC. Starting with a brief discussion of the background and philosophy behind the PSC, it identifies the roles and responsibilities of each of the named functions within the contract, explains the approaches required to achieve a successful working relationship between all parties, and examines all the procedures in the PSC. The book explains the links between the various sections of the contract to assist the reader with cross referencing, and covers all the variations created by the Main and Secondary Options. As a very practical guide it will aid users in the transition from their use and understanding of the other standard contracts to the collaborative project management-based approach of the PSC. Written for anyone working in the construction and related industries using the PSC to procure or provide consultancy services in relation to a construction project, it will be of interest to the complete construction supply chain, particularly architects, structural engineers, services (M&E) engineers, civil engineers, quantity surveyors and interior designers, together with Contractors and Sub-Contractors who have a design liability and employ consultants to assist them. It will also be of interest to consultants and lawyers advising any of these parties, either in the preparation of contract documentation or the resolution of problem situations which may arise.

Book A Contractor s Guide to the FIDIC Conditions of Contract

Download or read book A Contractor s Guide to the FIDIC Conditions of Contract written by Michael D. Robinson and published by John Wiley & Sons. This book was released on 2011-02-16 with total page 172 pages. Available in PDF, EPUB and Kindle. Book excerpt: This guide will help the contractor’s staff overcome some of the difficulties encountered on a typical international contract using FIDIC forms. The majority of FIDIC-based contracts use the Red Book (Conditions of Contract for Construction), so this book concentrates on the use of those particular forms. Supplementary comments are included in Appendix C for the Yellow Book (Plant & Design-Build) recommended for use where the contractor has a design responsibility. The Contractor is represented on site by the Contractor’s Representative who carries the overall responsibility for all the Contractor’s on-site activities. In order to provide guidance to the Contractor’s Representative and his staff, this book is divided into five sections: A summarized general review of the Red Book from the Contractor’s perspective. A review of the activities and duties of the Contractor’s Representative in the same clause sequencing as they appear in the Red Book. A summary of these activities and duties but arranged in order of their likely time sequence on site. This has the added intention of providing the Contractor’s Representative with a means of ensuring that documents are not only properly provided to the Employer and Engineer, but most importantly that they are provided within the time limits specified in the Contract. A selection of model letters is provided which make reference to the various clauses of the contract requiring the Contractor to make submissions to the Employer or Engineer. Various appendices. The guide is not intended to be a review of the legal aspects of FIDIC- based contracts; legal advice should be obtained as and when necessary, particularly if the Contractor has little or no knowledge of the local law. Armed on site with a copy of The Contractor and the FIDIC Contract, the Contractor’s Representative will be more able to avoid contractual problems rather than spend considerable time and energy resolving those problems once they have arisen.
