Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Philadelphia Lawyer in the London Courts The nucleus of this volume was an address delivered before the Pennsylvania State Bar Association which, finding its way into various newspapers in the United States and England, received a degree of favorable notice that seemed to warrant further pursuit of a subject heretofore apparently overlooked. Successive holiday visits to England were utilized for this purpose. As our institutions are largely derived from England, it is natural that the discussion of public questions and the glimpses of important trials afforded by the daily papers - usually murder trials or divorce cases - should more or less familiarize Americans with the English point of view in legal matters. American lawyers, indeed, must keep themselves in close touch with the actual decisions which are collected in the reports to be found in every library and which are frequently cited in our courts. These selected paragraphs distill the contents and give you a quick look inside A Philadelphia Lawyer in the London Courts: Look inside the book: Again, it is difficult to grasp fully the influence exercised through life by the barrister's Inn—that curious institution, with its five hundred years of tradition—voluntarily joined by him when a youth; where he has received his training; by which he has been called to the Bar and may be disbarred for cause, and upon the Benchers of which Inn he must naturally look as his exemplars, although the Lord Chancellor may be the nominal creator of King's Counsel and the donor of judge-ships. ...C.'s, indeed, are afforded their title in the reports—even in the newspapers—but nowhere does it appear that 'Leaders' are appointed by the judge of a particular equity court to 'take their seats' and practice before him exclusively, being associated in each case with 'Juniors,' who in turn have 'Devils' to prepare their cases; or that a leader may sever this relation and thereafter 'go special'; yet all these, and many other peculiar and inviolable customs, are handed down from one generation to another to be followed as if by instinct: and the profession would no more trouble the busy world with such matters than a dog would feel it necessary to explain that he turns thrice before lying down, simply because his wolfish ancestor did so in order to make a bed in the grass.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Legal Philadelphia Comments and Memories Let me venture to believe that almost a half-century's membership of the Philadelphia bar, including occasional appearances in other Pennsylvania jurisdictions, and of other States, as well as observation of foreign courts, may serve as my adequate credentials, in the present emergency, in view of some asperities of expression. Within little more than a twelvemonth, without the intermediary of a tipstaff, bearing my visiting card, or any ceremony whatever, I was cordially welcomed to the private office in the City Hall of a younger member of the Philadelphia judiciary. My visit, a professional one, was brief, solely because of my inability to accept the courteously tendered hospitality of the judge and an associate in chambers. Book excerpt: Excerpt from The District Court of the City and County of Philadelphia: An Address Delivered at the Final Adjournment of the Court, January 4, 1875 So it happened, that when a century had elapsed from the lawyer-repressing statutes I have quoted, and the green countrie town of Penn had become a prosperous city aspir ing to be the capital of the great Republic, there had grown up in it a bar, not only numerous, but renowned for profes sioual learning and ability, and the business of litigation was such as not only to give active and profitable employment to the bar, but to burden the courts and impose vexatious delays upon the suitors. Download or read book The Philadelphia Lawyer written by Robert R. Bell and published by Susquehanna University Press. This book was released on 1992 with total page 340 pages. Available in PDF, EPUB and Kindle. Book excerpt: One focus of this book is to look at the interrelationship between the old Philadelphia upper class and the legal profession. The upper class refers to a group of old Philadelphia families whose members are descendants of financially successful individuals. Through their families, those men have had the means to enter, train in, and practice law. While over the two centuries covered here the percentage of upper class lawyers decreased, their influence for many years continued to surpass their numbers. In 1944, about 10 percent of all lawyers were listed in the Social Register. In the eight largest law firms in the city they accounted for 37 percent of the partners and 23 percent of the associates. But by 1990, their influence was waning: they represented only about two percent of all lawyers in the city. Moreover, in the eight largest law firms in the city, 12 percent of the partners were in the Social Register, but only one percent of the associates. Indeed, with the twenty-first century approaching, the old upper class was - and is - becoming increasingly irrelevant to Philadelphia law. In each chapter, an examination is made of the emerging American legal system and the training and practice of law in a given historical period. Before the Revolution most American law was British law. After the Revolution there were often bitter struggles over the continued use of British common law. Rapidly the British common law was modified, giving way to American common law - and that was the major focus of law up until the Civil War. Following the Civil War and well into the twentieth century the major thrust of law was related to business and industry, especially corporations. By the 1930s there was an increasing focus on Federal Commissions and statute law. Over the decades the training of lawyers underwent change. Until the twentieth century, most lawyers were trained in law offices, and it was only slowly that law schools became the accepted means of legal training. For most of American history, the lawyer practiced alone and often appeared as an advocate in court where his forensic skills were highly valued. For the various historical eras, this study attempts to show how the Philadelphia lawyer lived, some of his values, how he learned the law, and how he practiced it. Anecdotal material is used to illustrate these points whenever possible. Forty-two Philadelphia lawyers were interviewed who, for the most part, had first entered the bar in the 1920s and 1930s. Six modern-day Philadelphia lawyers were interviewed at length, and their insights are presented in the epilogue. Following each chapter there is a profile of a Philadelphia lawyer contemporary to the period discussed. Most of the profiles are of men who, considered outstanding lawyers in their own time, have come to be regarded as outstanding in the history of Philadelphia law.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Pleasantries of English Courts and Lawyers Well planned and well written, the story of the Great Seal would be a rare story. It calls up the dead of eight silent centuries, placing before the mind much of that which is most beautiful and noble, and not a little of that which is most to be deplored in the growth of England's greatness. The poet's song and the soldier's fame give music and brightness to the atmosphere that covers and surrounds the mystic emblem of sovereign will. For seven-and-twenty generations fair women and brave men have submitted meekly to its influence and bowed before it reverentially. More than a mere symbol of the ruler's power, it has been honored as the power itself by the flatteries of pliant courtiers, the prayers of wretched supplicants, the hopes of ambition, and the fears of cowardice. For twice four hundred years it has witnessed the most stirring scenes, held parley with the most famous personages, and been an actor in the grandest episodes of history. Book excerpt: Excerpt from Stories of the Law and Lawyers But of a different order to any of the foregoing was the bitter wit of Lord Ellenborough, who frequently made counsel feel the keen edge of his sarcastic tongue. When Preston, the great con veyancer, gravely stated to the Court of the King's Bench the platitude that an estate in fee simple was the highest estate known to the law of England, the Chief Justice said, with politest irony, Stay, stay, Mr. Preston, let me take that down. An estate (the judge writing as he spoke) - ih fee simple - is the highest estate - known to the law of England.' Thank you, Mr. Preston; the Court, sir, is much indebted to you for the information.
