Book excerpt: This short article sets out A Twelve Point Plan for Labour, after a review of the pathbreaking Manifesto for Labour Law, written by a host of the most distinguished labour lawyers from Britain, Europe and the Commonwealth. The essence, which became official policy at the Labour Party Conference of 2016, is a call for sectoral collective bargaining, a matching right to collective action, a meaningful floor of rights fully enforced, a renewed Ministry of Labour and an autonomous appellate Labour Court. Building on this, 'A Twelve Point Plan', with aims increasingly shared across the international labour movement, is set forth. Ten (save F and L) can be won through collective bargaining right now, to renew democracy and social justice. 1. Automatic enrolment and all-out recruitment to trade unions. 2. Board representation by votes at work. 3. Councils at work elected with binding rights. 4. Dismissals must be deferrable by work councils. 5. Extension of collective agreements. 6. Full employment through fiscal, monetary and trade policy. 7. Gender and general equality. 8. Holidays progressively raised to half the year. 9. Investment funds for income insurance. 10. Jobholders must have all rights. 11. Knowledge economics: a right to education at work. 12. Labour Courts, Labour Ministry and Legislature reform.

The book investigates the tensions and potential complementarities between the two logics through the combination of a strong theoretical framework and an extensive qualitative case study of trade union organizing and recruitment in four countries – Austria, Germany, Israel and the Netherlands. These countries still utilize social-wide bargaining but find it necessary to draw and develop strategies transposed from Anglo-American countries in response to continuously declining membership.

The project involved a substantial number of interviews with key union representatives and academic experts in each country, together with the collection of a large amount of union documentation and background material. The book gives an account of trade unionism in each country, the main recent challenges that unions have faced, and responses in terms of recruitment and mobilisation; organizational restructuring; new approaches to collective bargaining; changing political strategies; and international activities. The analytical starting point is that trade unions are conservative institutions containing significant veto points to organizational change, but at the same time can display dynamism and innovation, and that external challenges can therefore stimulate important internal adaptation. The book engages with the debates of the past two decades on union modernization and revitalization, and more generally with theories of institutional change and with the literature on varieties of capitalism. The central theme is that while trade unions do not easily change identities and core practices, they are not locked into inertia. Trade unions are not unitary actors but are internally contested organizations, and internal conflict is itself a potential source of dynamism. The literature on "revitalization" has tended to divide between the over-optimistic and the over-pessimistic; this study presents a more nuanced and differentiated account. The philosophical foundations of labour law rely on the protection of the weaker party of the employment contract. However, after 40 years of political neoliberalism, these justifications seem insufficient for achieving progress in the area of labour and employment rights. This book changes the narrative of why we need labour standards. It begins with a study of the reasons that gave rise to labour law in the context of the Industrial Revolution and its evolution, and moves on to analyse the current context dominated by globalisation and economic digitisation. It then proceeds to study the main justifications for intervention in the labour market in the current business-economic context on a global scale: economic growth; pre-distribution of wealth; a meritocratic allocation of working conditions and equality among workers. Using case studies and examples from across the EU, the UK, and the US, the book shows how the deregulation of labour markets harms innovation and the economy, especially when considering the challenges of platform work, algorithms, and AI. It demonstrates that labour standards such as the minimum wage, sectoral collective bargaining and collective rights, protection against dismissal and discrimination, occupational risk prevention, and social security are necessary for the economy to function properly.
