Book excerpt: Excerpt from A Lecture Upon Roman Law Procedure The following sketch of the history and character of legal procedure in the Roman Law was originally delivered in October, 1875, as the opening lecture in my course of instruction in Pleading. I now publish it for your use, in the hope that it may be found to present, in brief outline and convenient form, the leading features of the several systems of pleading and procedure which obtained in that nation of antiquity, whose growth was most affected by legal processes and promoted by lawyers. and whose jurisprudence has most influenced our own. Of course I claim no other merit for these few pages than the industry which was intended to, and it is hoped may aid your labors in this field. If Mr. Abdy's little work upon this subject had been republished in this country, I should not have printed these pages; but not knowing where else to refer you for a brief general sketch of this branch of the Civil Law, I have compiled these pages both as a pleasure and a duty. It collects the first results of the European Research Council Project, Scriptores iuris Romani - dedicated to a new collection of the texts of Roman jurisprudence, highlighting important methodological issues, together with innovative reconstructions of the profiles of some ancient jurists and works. Jurists were great protagonists of the history of Rome, both as producers and interpreters of law, since the Republican Age and as collaborators of the principes during the Empire. Nevertheless, their role has been underestimated by modern historians and legal experts for reasons connected to the developments of Modern Law in England and in Continental Europe. This book aims to address this imbalance. It presents an advanced paradigm in considering the most important aspects of Roman law: the Justinian Digesta, and other juridical late antique anthologies. The work offers an historiographic model which overturns current perspectives and makes way for a different path for legal and historical studies. The Regius Professor of Civil Law lectures on the Roman Civil Law twice in the week during the College Term. Decreed by the Provost and Senior Fellows, October 26, 1850. 1. Students may begin to attend the Regius Professor of Civil Law in the first Term of their Senior Sophister year. 2. To obtain credit for their first year as law students, they must attend the Regius Professor for the three terms of that year, and pass an examination in subjects to be prescribed by the Professor at the end of Trinity Term. 3. Students who have passed this examination may attend the lectures of the Professor of Feudal and English Law. 4. To obtain credit for the second year as law students, they must attend three Terms of the lectures of the Professor of Feudal and English Law, and pass an examination as before, at the end of Trinity Term, in the subjects prescribed by the Professor. 5. Students who comply with the foregoing regulations will be considered as law students of the University, and entitled to the same privileges in their Senior Sophister year which have been already given to other professional students. 6. The Law Professors shall give a joint certificate to such students as have attended for two years the lectures, and passed the examinations required by the foregoing regulations."
