Book Collective Responsibility and Accountability under International Law

Download or read book Collective Responsibility and Accountability under International Law written by Shane Darcy and published by BRILL. This book was released on 2007-03-30 with total page 424 pages. Available in PDF, EPUB and Kindle. Book excerpt: Collective Responsibility and Accountability under International Law examines the extent to which the basic principle of individual responsibility accommodates liability for the acts of others. It examines the debates and legal developments surrounding collective responsibility under international law. The philosophical debates on collective responsibility provide an introduction to the examination of whether collective responsibility is ever appropriate or even lawful under international law. As the international criminal justice project begins to flourish, it is of paramount importance that the extent of the potential liability of individuals for the acts of others is clarified and held up to rigorous scrutiny. It is of equal importance that there is a clear understanding of whether the means of responding to ongoing violations of international humanitarian law can include measures based on collective responsibility. Global events have created an impetus for the parameters of responsibility to be clearly defined. The rise of non-State actors within the international legal regime raises complex questions surrounding their status, power and the means for holding them accountable. Published under the Transnational Publishers imprint.

Download or read book Europe and the Americas written by Erik André Andersen and published by Hotei Publishing. This book was released on 2015-04-21 with total page 431 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Europe and the Americas: Transatlantic Approaches to Human Rights, leading scholars of different disciplines offer new insight into transatlantic approaches to human rights. At a time when global challenges (economic crises, poverty, terrorism, mass migration and climate change) have a profound impact on the universal development of human rights and democracy, a common transatlantic understanding of human rights may prove instrumental in meeting these challenges. Through conceptual discussions, by analysing different human rights topics in different periods and regions (Europe, the United States and Latin America), and by focusing on a diverse range of actors, from policy makers and judicial institutions to academics and civil society, the authors identify key developments of human rights within a transatlantic framework.

Book Yearbook of International Humanitarian Law Volume 24 2021

Download or read book Yearbook of International Humanitarian Law Volume 24 2021 written by Heike Krieger and published by Springer Nature. This book was released on 2023-01-01 with total page 301 pages. Available in PDF, EPUB and Kindle. Book excerpt: Volume 24 of the Yearbook of International Humanitarian Law (IHL) is dedicated to investigating IHL’s universalist claims from different perspectives and regarding different areas of IHL. While academic debates about “universalism versus particularism” have dominated much of the critical scholarship in international law over the past two decades, they remain relatively underexplored in the field of IHL. The current volume fills this gap in IHL literature by focusing on the ways in which different interpretive communities approach questions of IHL from differing perspectives. Authors were invited to use the concept of culture to deconstruct and take critical distance from the production, interpretation, and application of IHL, and those keen on challenging the idea that IHL needs critical deconstruction were also invited to argue their case. The Volume contains four articles dedicated to the subject of cultures of IHL. It also features a book symposium on Samuel Moyn’s Humane: How The United States Abandoned Peace and Reinvented War (2021) and ends, as usual, with a Year in Review section. The Yearbook of International Humanitarian Law is a leading annual publication devoted to the study of international humanitarian law. The Yearbook has always strived to be at the forefront of the debate of pressing doctrinal questions of IHL and will continue to do so in the future. As this volume shows, it is also a forum for taking a step back and reflecting on the broader, theoretical issues that inform the practice and thinking about the field. The Yearbook provides an international forum for high-quality, peer-reviewed academic articles focusing on this crucial branch of international law. Distinguished by contemporary relevance, it bridges the gap between theory and practice and serves as a useful reference tool for scholars, practitioners, military personnel, civil servants, diplomats, human rights workers and students.

Book Traditions of War

Download or read book Traditions of War written by Karma Nabulsi and published by OUP Oxford. This book was released on 2005-06-02 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: Traditions of War examines wars and military occupation, and the ideas underlying them. The search for these ideas is conducted in the domain of the laws of war, a body of rules which sought to regulate the practices of war and those permitted to fight in it. This work introduces three ideologies: the martial, Grotian, and republican. These traditions were rooted in incommensurable conceptions of the good life, and the overall argument is that these differences lay at the heart of the failure fully to resolve the distinction between lawful and unlawful combatants at successive diplomatic conferences of Brussels in 1874, the Hague in 1899 and 1907, and Geneva in 1949. Based on a wide range of sources and a plurality of intellectual disciplines, this book places these diplomatic failures in their broader social and political contexts. By bringing out idealogical continuities and drawing on the social history of army occupation in Europe and resistance to it, this book both challenges and illuminates our understanding of modern war.
