The main focus of Workers Before the Tribunal is to overcome traditional binary oppositions between corporativist and contratualist models of labor relations, the former representing a view in which the working class would have more autonomy in struggling for better labor conditions, the latter meaning the protagonism of the State in promoting labor rights. Teixeira da Silva presents three main arguments. First, he shows that the Brazilian labor justice system created during the Getúlio Vargas dictatorship (1930-1945), although inspired by Mussolini's legal order in Italy, is very different from the Fascist Magistratura del Lavoro. Second, in his comparative analysis with other national cases, such as the United States, France, Germany and Australia, the author argues that there was a large circulation of ideas and practices, resulting in a more complex dynamic of appropriation of international ideas on labor rights and institutions in Brazil. Third, Teixeira da Silva demonstrates that litigation in labor courts was one strategy of the working-class movement in Brazil, together with strikes and other means of confrontation. Therefore, he questions historiographical and political approaches that see labor justice as a weak substitute for class action. The "jurisdictionalization" of labor relations became a constitutive element in the making of the Brazilian working class. The book is anchored in the research of hundreds of labor litigation cases during the dramatic months preceding the 1964 civil-military coup d’état that inaugurated a quarter century of dictatorial rule in Brazil.

Seen as the end of an exclusively repressive approach, the CLT was long hailed as one of the world's most advanced bodies of social legislation. In Drowning in Laws, John D. French examines the juridical origins of the CLT and the role it played in the cultural and political formation of the Brazilian working class. Focusing on the relatively open political era known as the Populist Republic of 1945 to 1964, French illustrates the glaring contrast between the generosity of the CLT's legal promises and the meager justice meted out in workplaces, government ministries, and labor courts. He argues that the law, from the outset, was more an ideal than a set of enforceable regulations--there was no intention on the part of leaders and bureaucrats to actually practice what was promised, yet workers seized on the CLT's utopian premises while attacking its systemic flaws. In the end, French says, the labor laws became "real" in the workplace only to the extent that workers struggled to turn the imaginary ideal into reality.

Book excerpt: This book explores how and why the labor practices of the world’s largest employer, supermarket giant Walmart, were contested by unions and government regulators as it expanded to Latin America starting in the 1990s. With an in-depth case study of Brazil, and a comparative chapter examining Argentina, Chile, and Mexico, this book analyzes the problematic encounter between diffusion of home-office anti-labor practices and evolving national institutional contexts that are quite varied and in some cases enable considerable resistance by unions and/or regulators. Walmart’s “repressive familial” and “anti-union” model is found to generate costs and conflicts that contributed to its unprofitability and ultimate exit from Brazil in 2018. This experience, contrasted with country situations where Walmart’s overall competitive and labor and human resource practices “fit” better with national markets and institutions, underlines the brittle, problematic nature of diffusionist corporate models lacking adaptive capacity to significant cross-national variations across host countries.

Book excerpt: How lawsuits around intellectual property in Brazil and India are impacting the patentability of plants and seeds, farmers’ rights, and the public interest. Over the past decade, legal challenges have arisen in the Global South over patents on genetically modified crops. In this ethnographic study, Karine E. Peschard explores the effects of these disputes on people’s lives, while uncovering the role of power—material, institutional, and discursive—in shaping laws and legal systems. The expansion of corporate intellectual property (IP), she shows, negatively impacts farmers’ rights and, by extension, the right to food, since small farms produce the bulk of food for domestic consumption. Peschard sees emerging a new legal common sense concerning the patentability of plant-related inventions, as well as a balance among IP, farmers’ rights, and the public interest. Peschard examines the strengthening of IP regimes for plant varieties, the consolidation of the global biotech industry, the erosion of agrobiodiversity, and farmers’ dispossession. She shows how litigants question the legality of patents and private IP systems implemented by Monsanto for royalties on three genetically modified crop varieties, Roundup Ready soybean in Brazil and Bt cotton and Bt eggplant in India. Peschard argues that these private IP systems have rendered moot domestic legislation on plant variety protection and farmers’ rights. This unprecedented level of corporate concentration in such a vital sector raises concerns over the erosion of agricultural biodiversity, farmers’ rights and livelihoods, food security, and, ultimately, the merits of extending IP rights to higher life forms such as plants.
