Excerpt: ...put up to plead, a rule which made it exceedingly difficult for him to take advantage of any defect. But then again, any person might point out such a flaw, aud it was in a sort of way the duty of the judge as counsel for the prisoner to do so. On the other hand, some flaws were, and others were not, waived, by pleading to the indictment. In short, it is scarcely a parody to say, that from the earliest times to our own days, the law relating to indictments was much as if some small proportion of the prisoners convicted had been allowed to toss up for their liberty. In practice this system is to a great extent a thing of the past. Legally it is still in full force except so far as it has been relaxed by a few specific sections of acts of parliament. 1 I say practical impunity because the chance of his being indicted a second time and of the prosecution being able to prove that the flaw in the first indictment was such that he had never been legally in peril, and so could not plead autrefois acquit, was not great. ACTS OF 1828 AND 1851. The following are the practically important sections: --By 7 Geo. 4, c. 64 (1826), ss. 14--18 inclusive, it is enacted that the property of a number of articles (as to which it is difficult to say to whom they belong), may in any indictment be laid in particular persons, e.g. the property in things provided for the repair of a county bridge, may by s. 15 be laid in the inhabitants of the county, and none of them need be named. These provisions have saved a great deal of petty trouble. By s. 19 misnomers and wrong additions, or the want of an addition, are rendered practically unimportant. The 28 Hen. 8, c. 10 (1536), described by Hale as "the "great concluding act against the papal authority," subjected to the penalties of prcemunire the asserting and maintaining of the papal authority; and obstinate refusal to take the oath of abjuration therein provided was made high treason. By 31 Hen. 8, c. 8 (1539), which was passed in the same year as the Act of the Six Articles, proclamations concerning religion were put on the same footing as acts of parliament, and those who went beyond sea in order to avoid the penalties enacted by the proclamations were to be guilty of high treason. By 35 Hen. 8, c. 3 (1543), passed after the fall of Cromwell, the king's 1 style was united and annexed to the imperial crown of England, and it was made treason to "imagine to "deprive the king, queen, prince, or the heirs of the king's "body, or any to whom the crown is or shall be limited, of any "of their titles, styles, names, degrees, royal estate or regal "power annext to the crown of England." These were the new treasons created by Henry VIII.'s legislation, in order to secure and establish the great religious and political revolution which he had effected.
