Book excerpt: Excerpt from A History of English Law, Vol. 1 The first volume was begun in 1901, and the second and third volumes were finished in 1909. From 1909 to 1921 I have been writing the history of the law from 1485 onwards. I have, therefore, been engaged upon this History of English Law for twenty years; and necessarily both the material available for the study of the subject and my own knowledge have, in the course of that time, increased considerably. For both these reasons it has become clear to me that the first volume in its original form is quite inadequate, and that the second and third volumes need revision to bring them up to date. It has also become clear to me, as the work on the later volumes progressed, that the earlier volumes need revision in order that the whole work may form a complete and co-ordinated whole. Therefore, simultaneously with my work on the later volumes, I have been en aged on the work of the revision and co-ordination of t e earlier volumes. The first volume is a new book; and the second and third have been considerably added to and altered. The result' is a continuous History of English Law as a whole down. To 1700, and, in respect to some parts of the subject, down to modern times. The mode of treatment appears from the Plan of the History which will be printed at the begin ning of each of the volumes. The sixth chapter, with which this volume opens, deals with the public law of the seventeenth century, and shows how, as the result of the constitutional conflicts of that century, our modern constitution and constitutional law have emerged. It is necessarily a long chapter, partly because the subject is intimately bound up with the general history of England, and partly because the events of that century have never before been treated from a purely legal point of view. The continuity of English history has given to seventeenth century constitutional history a very permanent influence upon the politics of later centuries, with the result that its history has too often been written from the point of view of those politics, and has reflected the political prepossessions of the writer. But, if we would understand the strength and weakness of the claims made by King and Parliament, we must approach the problem from that legal point of view which was adopted by both the contending parties in the seventeenth century. It is only in this way that we can do justice to these rival claimants to sovereignty. The seventh chapter carries on the history of the enacted law from the point at which it was left in the second chapter of this Book, and describes the modifications and additions made by the legislature between 1660 and 1700. The eighth chapter deals with the professional development of the law. It also is a long chapter. This is partly due to the fact that no history of this period in our legal history has ever been written before; and partly to the fact that in the legal world, as on other sides of our national life, modern conditions then decisively emerged. In the eight succeeding volumes, which contain Books II-IV, I have described the sources and influences which shaped the development of English law down to 1700, and I have related both the history of English public law during the same period, and also the history of the principal doctrines of English private law, in some cases to 1700 and in others down to the nineteenth century. These three succeeding volumes begin Book V, the last Book of this History, in which I propose to relate the history of English law from 1700 to 1875. They begin Part I of this Book, and they relate the history of public law, and of the sources and influences which shaped the development of English law, during the eighteenth century. If I continue to have sufficient health and leisure, I hope in a succeeding volume to complete Part I of this Book, and in Part II to complete the History in two more volumes by giving some account of the history of those doctrines of English law with which I have not fully dealt in the preceding volumes. It may be thought that I have dealt with the legal history of the eighteenth century at too great a length. But there are several reasons why I have found it necessary to fill three bulky volumes.
