Book excerpt: The Consumer Rights Act is a vital and far-reaching piece of legislation containing provisions specific to contract and consumer law, criminal law, and competition law. It sets out a much-needed framework to consolidate the key consumer rights surrounding contracts for goods, services, and digital content, as well as the law relating to unfair terms in consumer contracts. The Act introduces easier routes for consumers and SMEs to challenge anti-competitive behavior through the Competition Appeal Tribunal, as well as confirming enforcers' powers to investigate potential breaches of consumer law. Ultimately, the Act gives civil courts and public enforcers greater flexibility to take the most appropriate action for consumers when dealing with breaches of consumer law. This Blackstone's Guide, written by a team of leading experts in the field, provides clear and concise coverage of the Consumer Rights Act's history, scope, and application. It is the complete resource for anyone looking for an introduction to this wide-ranging Act. The Blackstone's Guide Series delivers concise and accessible books covering the latest legislative changes and amendments. Book Competition Law and Consumer Protection

Download or read book Competition Law and Consumer Protection written by Katalin Judit Cseres and published by Kluwer Law International B.V.. This book was released on 2005-01-01 with total page 466 pages. Available in PDF, EPUB and Kindle. Book excerpt: The assumption that competition law and consumer protection are mutually reinforcing is rarely challenged. The theory seems uncontroversial. However, because a positive interaction between the two is presumed to be self-evident, the frequent conflicts that do in fact arise are often dealt with on an ad hoc basis, with no overarching legal authority. There is a clear need for a detailed and coherent understanding of exactly where the complements and tensions between the two policy areas exist. Dr Cseres in-depth analysis provides that understanding. Proceeding from the dual perspective of law and economics that is, of justice, fairness, and reasonableness on the one hand, and of efficiency of the other she fully considers such underlying issues as the following: the role of competition law and consumer law in a free market economy;the notion of consumer welfare;the effect of the modernisation of EC competition law for consumers;economics theories of information, bounded rationality, and transaction costs;the special significance of vertical agreements and merger control; and,how consumers are affected by information asymmetries. The ultimate focus of the book is on current and emerging EC law, in which a rapprochement between the two areas seems to be under way. Dr. Cseres provides a knowledgeable guide to the various strands of theory, policy, and jurisprudence that (she shows) ought to be taken into account in the process, including schools of thought and law and policy experience in both Europe and the United States. A special chapter on Hungary, where post-1989 law and practice reveal a fresh and distinctly forward-looking understanding of the matter, is one of the book's most extraordinary features. Competition Law and Consumer Protection stands alone as a committed contribution to bridging a gap in legal knowledge the significance of which grows daily. It will be of immeasurable value to a wide range of professionals from academics and researchers to officials, policymakers, and practitioners in competition law, consumer protection advocacy, economic theory and planning, business administration, and various pertinent government authorities.

Book Equipment for Older Or Disabled People and the Law

Download or read book Equipment for Older Or Disabled People and the Law written by Michael Mandelstam and published by Jessica Kingsley Publishers. This book was released on 1997 with total page 570 pages. Available in PDF, EPUB and Kindle. Book excerpt: This comprehensive book explains the provision, both law and practice, of equipment and home adaptations to assist older or disabled people in daily living. Characterised by ill-defined statutory reponsibilities and terminology, and an under-developed consumer retail market, the system of provision has long been recognised as chaotic and confusing for professionals and public alike. This is despite the fact that equipment and adaptations are meant to be a central plank of community care. Necessarily wide-ranging but maintaining its focus, the book aims critically to describe the system and thereby promote better practice. By exploring boundaries and breaking points, it will assist people to understand the law when things go wrong - from negligence to judicial review, and from contract to product safety legislation. The range of items covered is great, from alarms to artificial limbs, baths to bedrooms, chopping boards to crutches, electronic toothbrushes to environmental controls, hearing aids to hoists, incontinence pads to ironing equipment, rails to ramps, speech aids to stairlifts, and walking frames to wheelchairs.
