Franchising provides a method for businesses to expand quickly and inexpensively into various markets. A business accomplishes this task by licensing its name and trademark as well as selling its goods or its particular business format to independent franchisees in exchange for payment of a royalty. The franchisee also benefits from such an arrangement. By entering into a franchising relationship, a franchisee can effectively run its own business without having to invest substantial time and money trying to perfect a new good or business method. That is, franchisees benefit from their franchisor's knowledge, experience, research, development, capital, and reputation. The ease of entry into a franchise relationship offers a partial explanation for franchising's success. In the United States, franchised businesses account for one-third of all retail sales, with approximately 750,000 operating franchised units employing over eight million people. American franchising indirectly accounts for over twice that number of jobs while yielding over 1.5 trillion dollars in annual retail sales. The American concept of franchising is expanding rapidly throughout the world, with an increasing share of international commerce. In spite of this success -- or perhaps as a result of it -- franchises have had their fair share of problems. In an attempt to protect franchisees, many state legislatures and the federal government have developed regulations, similar to consumer protection laws, regarding proper disclosure requirements for franchisors. While federal disclosure regulations do not require registration, state laws typically oblige franchisors to register a detailed filing prior to seeking potential franchisees. By forcing franchisors to dis-close certain information, the Federal Trade Commission and many state legislatures have equipped franchisees with the information needed to make, one hopes, an intelligent investment decision.

Book excerpt: The franchising business is one of the most successful among various forms of businesses operating in the country nowadays and the food franchise business is the most prominent. The kind of relationship of the franchisor and the franchisee is governed by a franchise agreement. The franchisors provide opportunities mostly franchisees to pursue a franchising business because of it nature. What makes a franchise business appealing is its return on investment and somehow its relative low risk level. This study focuses on the franchisee-franchisor relationship under a franchise contract which both parties agreed and how this contract may have affected the franchisee financially. There are two variables used in this study; the net profit of the franchisees’ franchising business and the terms and conditions of the franchising contract affecting: location decision, technical support, funding, target markets, marketing, administration and human resources and business operations. Using the Spearman rho Correlation, the degree of association between net profit against the following variable: location decision r 0.851, target markets r.454, technical support r.898, funding r .909, administration and human resource r.127, marketing r.612, and business operations r.914 may indicate a unified but slightly verified perception. It may overwhelmingly suggest a close association between net profit and the other set of variables thus appropriate to say that the financial success of franchisees are all determined by the relationship of the franchisor-franchisee under the provisions of the franchising contract.
