Tal é o questionamento central debatido nesta pesquisa, que se delimita à realização de uma análise a partir de uma interpretação hermenêutica sistemática e histórica da política de penalização de condutas no Código Penal brasileiro de 1940, fazendo-se uma subsunção entre os direitos fundamentais dispostos na Constituição Federal e a consequente tutela desses direitos, a partir da pena que se culmina para a eventual lesão destes, observando-se, em todo caso, os preceitos do princípio da proporcionalidade e a sua efetividade no ordenamento jurídico brasileiro. Através de uma pesquisa bibliográfica e documental, pretendeu-se chegar a uma solução teórica acerca da compatibilidade da previsão das sanções penais das infrações penais previstas no Direito Penal brasileiro.
