As Thomas Morris clearly shows, racial slavery came to the English colonies as an institution without strict legal definitions or guidelines. Specifically, he demonstrates that there was no coherent body of law that dealt solely with slaves. Instead, more general legal rules concerning inheritance, mortgages, and transfers of property coexisted with laws pertaining only to slaves. According to Morris, southern lawmakers and judges struggled to reconcile a social order based on slavery with existing English common law (or, in Louisiana, with continental civil law.) Because much was left to local interpretation, laws varied between and even within states. In addition, legal doctrine often differed from local practice. And, as Morris reveals, in the decades leading up to the Civil War, tensions mounted between the legal culture of racial slavery and the competing demands of capitalism and evangelical Christianity.

Tise suggests that American proslavery thought, far from being an invention of the slave-holding South, had its origins in the crucible of conservative New England. Proslavery rhetoric, Tise shows, came late to the South, where the heritage of Jefferson's ideals was strongest and where, as late as the 1830s, most slaveowners would have agreed that slavery was an evil to be removed as soon as possible. When the rhetoric did come, it was often in the portmanteau of ministers who moved south from New England, and it arrived as part of a full-blown ideology. When the South finally did embrace proslavery, the region was placed not at the periphery of American thought but in its mainstream.

John Patrick Daly dissects the evangelical defense of slavery at the heart of the nineteenth century's sectional crisis. Southern evangelicals argued that their unique region was destined for greatness, and their rhetoric gave expression and a degree of coherence to the grassroots assumptions of the South. The North and South shared assumptions about freedom, prosperity, and morality. For a hundred years after the Civil War, politicians and historians emphasized the South's alleged departures from national ideals. Recent studies have concluded, however, that the South was firmly rooted in mainstream moral, intellectual, and socio-economic developments and sought to compete with the North in a contemporary spirit. Daly argues that antislavery and proslavery emerged from the same evangelical roots; both Northerners and Southerners interpreted the Bible and Christian moral dictates in light of individualism and free market economics. When the abolitionist's moral critique of slavery arose after 1830, Southern evangelicals answered the charges with the strident self-assurance of recent converts. They went on to articulate how slavery fit into the "genius of the American system" and how slavery was only right as part of that system.
