Book excerpt: "The Nunavut Land Claims Agreement (NLCA) is a land claims agreement, within the meaning of the Constitution Act, between Canada and the Inuit of the Nunavut Settlement Area (NSA). Both ratified the NLCA, the Inuit by a vote and the Federal Government by passage and assent to the Nunavut Land Claims Agreement Act which came in force July 9, 1993. The NLCA stipulated that the Federal Government, Inuit, and the Territorial Government would develop an Implementation Plan governing the activities required to implement the NLCA. A Contract Relating to the implementation of the Nunavut Final Agreement (the Implementation Contract) was signed in May, 1993. This executive summary provides an overview of the findings and concepts discussed in each section of the Implementation of the Nunavut Land Claim Agreement: An Independent 5 year Review (the 5 Year Review). It also provides comments that put the findings and recommendations into perspective"--Page 1.

Without qualifying or limiting that protection, NTI notes that the Inuit and Crown Parties to the Nunavut Agreement are under Constitutional, treaty, statutory, and contractual duties to negotiate in good faith to the renewal of efforts to implement the Agreement, in pursuit of agreed upon actions and initiatives that will contribute to its objectives, meet its specific commitments, and remove implementation obstacles and shortfalls. The Crown must meet its duties to negotiate in good faith in a manner that recognizes and reflects the Honour of the Crown. Duties to negotiate cannot be equated of confused in law, either in substance or in process, with duties of consultation.

[...] Since 2002, the Government of Canada, the Government of Nunavut and NTI have been engaged in negotiations to renew the Implementation Contract signed in 1993 (at the same time as the Agreement) to cover the second implementation period, 2003 to 2013. [...] On the basis of my recommendations the parties have found 2. Prime Minister Chrétien put it this way: "Fifty years from now schoolchildren will be reading about this day in their text books...when we redrew the map of Canada and helped achieve the long-promised destiny of the people of the Eastern Arctic." 3. The Minister of State (Northern Development), the Premier of Nunavut and the President of N [...] The result is that, although most of the elected members of the Government of Nunavut are Inuit, the great majority of the higher level positions in the public service are held by non-Inuit; in fact, these latter constitute a large part of the 15% of residents of Nunavut who are not Inuit. [...] Given the demographics of the new territory Inuktitut ought, generally speaking, to be the language of the governmental workplace in Nunavut and the language of the delivery of government services.
