Book excerpt: Hastings v. USATF, IAAF and IOC is a case where sports, constitutional law, and human rights law converge when an elite athlete is excluded from the Olympics due to her gender. This case is a federal appeal by Nakia Hastings, a female intersex athlete who was excluded by USA Track & Field ["USATF"] from the US team sent to the 2012 London Olympics. Her exclusion was due to new Regulations that ban female athletes with naturally elevated testosterone levels; these Regulations were promulgated by the international sports regulatory bodies [the International Association of Athletics Federations ("IAAF") and the International Olympic Committee ("IOC")]. Hastings challenged her exclusion before the Court of Arbitration for Sports ["CAS"] which ruled against her. She appealed this CAS arbitration in US District Court, alleging: that these Regulations are unconstitutional gender discrimination; that they violate her human rights; and that they should not be enforced under the "public policy" exception to the New York Convention. The District Court ruled against Hastings on all counts, and she has appealed to the Ninth Circuit. Although international in focus, the case file is designed to be accessible to US JDs and LLMs, and thus it is set in a US court and all legal authorities are available in English. The case file includes the appellate record and potential assignments, specifically, an appellate brief, oral arguments, appellate mediation, and a judicial opinion for the case. The Teacher's Manual includes answer keys, evaluation rubrics, and a full bench memo. Lightfoot, Micaela Thorpe appeals the District Court's denial of her petition to have her young son returned to Trinidad after he was abducted to the US by his father, Antoine Lightfoot, in violation of the Hague Convention on International Child Abductions. This appeal raises three issues of public international law and international family law, specifically: Does a US court have jurisdiction over an anticipatory breach, given the conflicting international law on this issue? Would it pose a "grave risk of harm" to return a child suffering from PTSD to the place where his PTSD-triggering injuries occurred? Is an 8-year-old child "sufficiently mature" for a court to consider his objections when repatriating him against his will? This case file is intended for two audiences. First, it is intended for professors of international or family law, allowing them to assign any or all of the documents in the file as practice materials to supplement students' training in the substantive law. In addition, this case file is intended as the lawsuit at the heart of an advanced advocacy course or moot court competition. In either situation, professors can assign any of the assignments alone or together. The case file and its Student Manual guide students through creating a bench memo and a federal appellate brief, mediating the appeal, and writing the final judicial opinion. The Teacher's Manual provides a full set of rubrics, samples and a thorough bench memo to teach each of these components. The Maltese ex-wife has sued to be allowed to use the parties¿ embryos that they created during their marriage: using the embryos, she wants to create children via a surrogate. The parties¿ IVF contract specified she would have control of any embryos, but the U.S. ex-husband won an injunction barring her access to the embryos. This case file is their appeal. Each party is arguing their constitutional right to be or to not be a parent is at stake in the case. The ex-husband further argues that the surrogacy required to create children from the embryos would be a crime under DC law [where the embryos are located] as well as being a crime under Maltese law [the ex-wife¿s nationality and where she intends to return with the children], but it is unclear whether D.C., Maryland, Virginia or Maltese law governs this embryo dispute, and the choice of law is outcome-determinative.
