The Government wants to ensure that the threat of libel proceedings is not used to frustrate robust scientific and academic debate, or to impede responsible investigative journalism and the valuable work undertaken by nongovernmental organisations. Issues included in the draft Bill are as follows: a new requirement that a statement must have caused substantial harm in order for it to be defamatory; a new statutory defence of responsible publication on matters of public interest; a statutory defence of truth (replacing the current common law defence of justification); a statutory defence of honest opinion (replacing the current common law defence of fair/honest comment); provisions updating and extending the circumstances in which the defences of absolute and qualified privilege are available; introduction of a single publication rule to prevent an action being brought in relation to publication of the same material by the same publisher after a one year limitation period has passed; action to address libel tourism by ensuring a court will not accept jurisdiction unless satisfied that England and Wales is clearly the most appropriate place to bring an action against someone who is not domiciled in the UK or an EU Member State; removal of the presumption in favour of jury trial, so that the judge would have a discretion to order jury trial where it is in the interests of justice.

Book excerpt: In this consultation paper, the Law Commission sets out the case for reducing the scope for criminal law to be used in regulated fields such as farming, food safety, banking and retail sales. Criminal sanctions should only be used to tackle serious wrongdoing and it is out of proportion for regulators to rely wholly on the criminal law to punish and deter activities that are merely 'risky', unless the risk involved is a serious one. There has been a steep increase in the number of criminal offences created since the late 1980s to penalise risk-taking. The areas regulated cover a wide range of risk-posing activities, and involve millions of people and thousands of businesses. By turning to civil penalties for minor breaches, regulators could reduce costs to themselves and the criminal justice system by £11 million a year. In some cases, criminal prosecution can cost almost twice what the courts obtain in fines. The paper proposes that: (i) regulatory authorities should make more use of cost-effective, efficient and fairer civil measures to govern standards of behaviour; (ii) a set of common principles should be established to help agencies consider when and how to use the criminal law to tackle serious wrongdoing, and (iii) existing low-level criminal offences should be repealed where civil penalties could be as effective. Where criminal offences are created in regulatory contexts, they should require proof of fault elements such as intention, knowledge, or a failure to take steps to avoid harm being done or serious risks posed.

Book excerpt: The basis of the UK Civil Service was set out 150 years ago in the Northcote-Trevelyan report ('The organisation of the permanent Civil Service', Parliamentary Papers, Vol. XXVII, 1854). The management of the Service has evolved over this time through a non-statutory approach, and the creation of a statutory basis to underpin the role, governance and values of the Civil Service would be a major constitutional reform. This consultation paper seeks comments on whether legislation is a necessary and desirable step to take in support of the core service values of integrity, impartiality and objectivity, in the light of the modern challenges it faces in the 21st century. It contains the text of the Government's draft Civil Service Bill, which would cover staff in the Home Civil Service and the Diplomatic Service, and other government agencies including the Forestry Commission, ACAS, HSE and OFSTED; as well as the devolved administrations in Scotland and Wales. The provisions exclude civil servants working in the Secret Intelligence Service and Security Service agencies, and the Northern Ireland Civil Service. The draft Bill contains proposals to establish a Civil Service Commission as an independent statutory body to uphold the principle of selection on merit through fair and open competition, although it provides for the continuing exemption of special advisers from this requirement. It seeks to clarify what special advisers can and cannot do, by redefining their general function as 'assisting' Ministers, and determining that special advisers cannot authorise expenditure, exercise line management supervision over permanent civil servants, or discharge statutory powers. Responses to the consultation paper should be received by 28 February 2005.
