Book Humanization of Arms Control

Download or read book Humanization of Arms Control written by Daniel Rietiker and published by Routledge. This book was released on 2017-07-06 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: Despite clear legal rules and political commitments, no significant progress has been made in nuclear disarmament for two decades. Moreover, not even the use of these weapons has been banned to date. New ideas and strategies are therefore necessary. The author explores an alternative approach to arms control focusing on the human dimension rather than on States’ security: "humanization" of arms control! The book explores the preparatory work on arms control treaties and in particular the role of civil society. It analyzes the positive experiences of the movements against chemical weapons, anti-personnel mines, and cluster munitions, as well as the recent conclusion of the Arms Trade Treaty. The author examines the question of whether civil society will be able to replicate the success strategies that have been used, in particular, in the field of anti-personnel mines (Ottawa Convention) and cluster munitions (Oslo Convention) in the nuclear weapons field. Is there any reason why the most destructive weapons should not be outlawed by a legally binding instrument? The book also explains the effects of weapons, especially nuclear weapons, on human beings, the environment, and global development, thereby focusing on vulnerable groups, such as indigenous peoples, women, and children. It takes a broad approach to human rights, including economic, social, and cultural rights. The author concludes that the use of nuclear weapons is illegal under international humanitarian and human rights law and, moreover, constitutes international crimes under the Rome Statute of the International Criminal Court. In his general conclusions, the author makes concrete proposals for the progress toward a world without nuclear weapons.

Book Conceptual and Contextual Perspectives on the Modern Law of Treaties

Download or read book Conceptual and Contextual Perspectives on the Modern Law of Treaties written by Michael J. Bowman and published by Cambridge University Press. This book was released on 2018-10-25 with total page 1171 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years there has been a flourishing body of work on the Law of Treaties, crucial for all fields within international law. However, scholarship on modern treaty law falls into two distinct strands which have not previously been effectively synthesized. One concerns the investigation of concepts which are fundamental to or inherent in the law of treaties generally - such as consent, object and purpose, breach of obligation and provisional application - while the other focuses upon the application of treaties and of treaty law in particular substantive (e.g. human rights, international humanitarian law, investment protection, environmental regulation) or institutional contexts (including the Security Council, the World Health Organization, the International Labour Organization and the World Trade Organization). This volume represents the culmination of a series of collaborative explorations by leading experts into the operation, development and effectiveness of the modern law of treaties, as viewed through these contrasting perspectives.

Book International Law and Sea Dumped Chemical Weapons

Download or read book International Law and Sea Dumped Chemical Weapons written by Grant Dawson and published by Oxford University Press. This book was released on 2023-04-27 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: Following the two world wars of the twentieth century, governments decided to dispose of unwanted chemical weapons in the world's oceans. The deleterious consequences of this decision for the earth's precious marine environment are now becoming clear. As the issue of sea-dumped chemical weapons cannot be contained by borders, we will all have to deal with the adverse effects on our fragile planetary ecosystem. While states have made some efforts to address the situation, unresolved international legal issues remain. International Law and Sea-Dumped Chemical Weapons contains a systematic conceptual analysis of the international legal frameworks governing the remediation of sea-dumped chemical weapons. Where deficiencies are found in the law, legal solutions are offered. In addition, practical approaches to the problem are explored. Furthermore, the book argues that solutions to this environmental hazard rely on a holistic awareness-and acceptance-of how humanity's past actions have damaged our ecosystem. Aiming to bring about the necessary will to overcome this challenge, this volume identifies and analyses the problem, offers guidance, and provides hope to the current and succeeding generations so that we can solve the problem of sea-dumped chemical weapons and restore balance to our ecosystem.

Book Technology Transfers and Non Proliferation

Download or read book Technology Transfers and Non Proliferation written by Oliver Meier and published by Routledge. This book was released on 2013-09-05 with total page 280 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edited volume examines the issue of the proliferation of dual-use technology and the efforts of the international community to control these technologies. Efforts to stop the spread of weapons of mass destruction (WMD) increasingly focus on preventing the proliferation and misuse of dual-use technologies: information, materials and equipment that can be easily applied for peaceful and hostile purposes. The threat of terrorist attacks with nuclear, biological or chemical weapons, in particular, makes it necessary to develop a sustainable non-proliferation policy that effectively hinders the misuse of dual-use technologies. In this book, leading non-proliferation experts from different regions of the world reflect on the political, legal and technical obstacles with an aim to finding a better balance between control and cooperation in dual-use technology transfer regulations. This broad approach makes it possible to compare regimes which may be structurally different but are similar in the way they attempt to regulate dual-use technology transfers by balancing controls and cooperative approaches. This book will be of much interest to students of weapons proliferation, arms control, global governance, international organizations and international security.
