Book A Coalition of Industrialized Nations Developing Nations Multilateral Development Banks and Non Governmental Organizations

Download or read book A Coalition of Industrialized Nations Developing Nations Multilateral Development Banks and Non Governmental Organizations written by Barbara Crutchfield George and published by . This book was released on 2013 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Within the last decade there has been a concerted effort from a number of sources to control the pervasive and persistent problem of corruption among the international business community. Corruption undermines democracy and development, fundamentally distorts public policy, discourages investment, leads to the misallocation of resources, discriminates against the poor, and destroys public confidence in democratic government. Despite the enhanced global awareness of the corrosive effects of corruption within the political, economic, and social spheres, there are as yet no clear, definitive indications that the occurrence of corruption has been reduced. A recent Gallup poll commissioned by Transparency International (TI) found that thirty-three percent of the 779 multinational executives surveyed believe that the problem of corruption in the business world is worsening. Commenting on the Gallup Poll survey, TI's Chairman, Peter Eigen, said “[t]he data provides a disturbing picture of the degree to which leading exporting countries are perceived to be using corrupt practices.” In a statement made in 1999, David Aaron, Undersecretary of Commerce for International Trade, noted that “there is a huge amount of money at stake. Just last year, there have been allegations of foreign bribery in 55 contracts worth $37 billion.” Subsequent to the initial passage, in 1977, of the U.S. Foreign Corrupt Practices Act (FCPA) there have been several significant developments, such as the adoption of the 1997 OECD Convention on Combating Bribery of Foreign Public Officials in International Business Transactions (OECD Convention) and the inception of active non-governmental organizations like Transparency International (TI). Despite these developments, current evidence of extensive business corruption shows that critical gaps still remain in the mechanisms used to fight corruption. Closing these gaps will require the heightened awareness of and increased cooperation among diverse entities. First, there must be a means to establish leverage over the public sector procurement process. Second, cultural attitudes toward corruption must be modified. Other necessary strategic components are grassroots initiatives within developing nations, which are the homes of many of the bribe-takers, to mobilize civil society and the private sector. Cooperation among all involved entities - government officials, legislatures, multilateral development institutions, industry, trade unions, and civil society in both developing and industrialized nations - will be necessary to eliminate global business corruption. In this paper the authors (1) discuss why the emerging global economy creates an environment that requires integrity in the marketplace; (2) demonstrate the inability of purely legislative measures to eradicate corruption; (3) summarize the nature and costs, both social and economic, of business corruption; (4) describe current anti-corruption initiatives by the industrialized nations; (5) review grassroots initiatives to combat corruption by non-governmental organizations; (6) analyze the role of multilateral development banks in tying aid to meeting anti-corruption requirements; (7) evaluate current anti-corruption agendas emanating from developing countries; and (8) recommend a strategy to unite the diverse entities necessary to a successful campaign against corruption. This article focuses primarly on business entities within industrialized countries who bribe government officials in developing nations, but corrupt acts also occur between business entities in industrialized countries and government officials in developed nations. However, corruption is not as common between companies in developing nations and the government officials in developed countries, presumably because their current economic relationship does not provide the opportunity.

Available in PDF, EPUB and Kindle. Book excerpt: Economic and social progress requires a diverse ecosystem of firms that play complementary roles. Making It Big: Why Developing Countries Need More Large Firms constitutes one of the most up-to-date assessments of how large firms are created in low- and middle-income countries and their role in development. It argues that large firms advance a range of development objectives in ways that other firms do not: large firms are more likely to innovate, export, and offer training and are more likely to adopt international standards of quality, among other contributions. Their particularities are closely associated with productivity advantages and translate into improved outcomes not only for their owners but also for their workers and for smaller enterprises in their value chains. The challenge for economic development, however, is that production does not reach economic scale in low- and middle-income countries. Why are large firms scarcer in developing countries? Drawing on a rare set of data from public and private sources, as well as proprietary data from the International Finance Corporation and case studies, this book shows that large firms are often born large—or with the attributes of largeness. In other words, what is distinct about them is often in place from day one of their operations. To fill the “missing top†? of the firm-size distribution with additional large firms, governments should support the creation of such firms by opening markets to greater competition. In low-income countries, this objective can be achieved through simple policy reorientation, such as breaking oligopolies, removing unnecessary restrictions to international trade and investment, and establishing strong rules to prevent the abuse of market power. Governments should also strive to ensure that private actors have the skills, technology, intelligence, infrastructure, and finance they need to create large ventures. Additionally, they should actively work to spread the benefits from production at scale across the largest possible number of market participants. This book seeks to bring frontier thinking and evidence on the role and origins of large firms to a wide range of readers, including academics, development practitioners and policy makers.

Book No Rule of Law No Democracy

Download or read book No Rule of Law No Democracy written by Cristina Nicolescu-Waggonner and published by State University of New York Press. This book was released on 2016-11-10 with total page 316 pages. Available in PDF, EPUB and Kindle. Book excerpt: Mainstream theories assert that democracy cures corruption. In market economies, however, elections are expensive and parties, with ever-thinning memberships, cannot legally acquire the necessary campaign funds. In order to secure electoral funds, a large number of politicians misappropriate public funds. Due to the illicit character of these transactions, high officials with conflicts of interest prefer to leave anticorruption enforcement mechanisms unreformed and reserve the right to intervene in the judicial process, with dire consequences for the rule of law. In No Rule of Law, No Democracy, Cristina Nicolescu-Waggonner demonstrates that when corrupt politicians are in power—true of nearly all new democracies—they will protect their office and fail to implement rule of law reforms. Consequently, these polities never reach a point where democracy could and would cure corruption. This dysfunction is tested in one hundred cases over sixteen years with significant results. In the case of the Czech Republic, for example, which is regarded as a consolidated democracy, there is systematic corruption, misappropriation of state funds, an unreformed judiciary, and arbitrary application of law. The only solution is a powerful, independent, well-funded anticorruption agency. Romania, one of the most corrupt countries in Europe, established, at the European Union's request, powerful anticorruption bodies and punished corrupt leaders, which created the predictability of enforcement. It is the certainty of punishment that curtails corruption and establishes true rule of law.

Book Towards a Global Consensus Against Corruption

Download or read book Towards a Global Consensus Against Corruption written by Mathis Lohaus and published by Routledge. This book was released on 2019-03-04 with total page 150 pages. Available in PDF, EPUB and Kindle. Book excerpt: Corruption has long been identified as a governance challenge, yet it took states until the 1990s to adopt binding agreements combating it. While the rapid spread of anti-corruption treaties appears to mark a global consensus, a closer look reveals that not all regional and international organizations move on similar trajectories. This book seeks to explain similarities and differences between international anti-corruption agreements. In this volume Lohaus develops a comprehensive analytical framework to compare international agreements in the areas of prevention, criminalization, jurisdiction, domestic enforcement and international cooperation. Outcomes range from narrow enforcement cooperation to broad commitments that often lack follow-up mechanisms. Lohaus argues that agreements vary because they are designed to signal anti-corruption commitment to different audiences. To demonstrate such different approaches to anti-corruption, he draws on two starkly different cases, the Organization of American States and the African Union. Contributing to debates on decision-making in international organizations, this work showcases how global governance is shaped by processes of diffusion that involve state and non-state actors. The book highlights challenges as well as chances linked to the patchwork of international rules. It will be of great interest to students and scholars of IR theory, global governance, international organizations and regionalism.

Book Extraterritoriality and International Bribery

Download or read book Extraterritoriality and International Bribery written by Branislav Hock and published by Routledge. This book was released on 2019-09-11 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book presents a collective action perspective to explain how extraterritoriality functions and assess when, and to what extent, extraterritoriality is effective. A collective action perspective provides a new account of foreign anti-bribery laws and their extraterritorial enforcement that draws on theories discussed in the field of economic governance. Within this framework, the book offers an intensive analysis of US foreign anti-bribery law such as the Foreign Corrupt Practices Act (FCPA), international law as it emanates from the OECD Anti-Bribery Convention, and comparative insights into UK law and German law. To test the theory in practice, the book provides a unique data set of more than 40 foreign anti-bribery enforcement actions conducted by the US Department of Justice (DOJ) and the Securities and Exchange Commission (SEC), and other examples from comparative jurisdictions. Extraterritoriality and International Bribery is ideal reading for academics and students with an interest in global governance, economic crime, criminology, and law and economics, as well as practitioners concerned with foreign anti-bribery enforcement, including compliance officers, lawyers, investigating and prosecuting authorities, and business leaders. The book also discusses governance alternatives existing outside international anti-bribery law and offers policy and legal reforms proposals. The book suggests a decentralized enforcement model with the delegation of some enforcement tasks to an external body as the most appropriate governance alternative.

Book World Development Report 1994

Download or read book World Development Report 1994 written by and published by World Bank Publications. This book was released on 1994 with total page 268 pages. Available in PDF, EPUB and Kindle. Book excerpt: World Development Report 1994 examines the link between infrastructure and development and explores ways in which developing countries can improve both the provision and the quality of infrastructure services. In recent decades, developing countries have made substantial investments in infrastructure, achieving dramatic gains for households and producers by expanding their access to services such as safe water, sanitation, electric power, telecommunications, and transport. Even more infrastructure investment and expansion are needed in order to extend the reach of services - especially to people living in rural areas and to the poor. But as this report shows, the quantity of investment cannot be the exclusive focus of policy. Improving the quality of infrastructure service also is vital. Both quantity and quality improvements are essential to modernize and diversify production, help countries compete internationally, and accommodate rapid urbanization. The report identifies the basic cause of poor past performance as inadequate institutional incentives for improving the provision of infrastructure. To promote more efficient and responsive service delivery, incentives need to be changed through commercial management, competition, and user involvement. Several trends are helping to improve the performance of infrastructure. First, innovation in technology and in the regulatory management of markets makes more diversity possible in the supply of services. Second, an evaluation of the role of government is leading to a shift from direct government provision of services to increasing private sector provision and recent experience in many countries with public-private partnerships is highlighting new ways to increase efficiency and expand services. Third, increased concern about social and environmental sustainability has heightened public interest in infrastructure design and performance.
