However, significant changes have already occurred in some areas, thus offering an opportunity to analyze the trends here and track the process of emergence of successor doctrines and practices destined to replace the Soviet heritage. The quartet of topics selected for treatment in this volume - the relationship between international and domestic law; citizenship and state succession; the Sino-Russian boundary problem; and cooperation with China in policing crime - illustrates major shifts in Russia's international law policy in a bid to shed the corset of Communist ideology and the old regime's modus operandi and join the international community's mainstream culture. The test cases also attest to the difficulties encountered in the process of transition and show that progress on this front has by no means been uniform. Book excerpt: This history and critique of Soviet treaty diplomacy focuses on the United States' relations with the Soviet Union from 1933, the year when the United States established diplomatic relations with the Kremlin, to the present. Appearing at a time of enormous change within the Soviet Union and in its relations with the United States, the book raises important questions about the degree to which the Soviet Union can be relied upon to honor its treaty commitments. As Beichman reminds us, the Soviet Union's record of treaty compliance in the past is dismal, and its continuing rhetorical strategic commitment to Marxism-Leninism as guiding ideology in its diplomatic activities is troubling. Beichman argues for a more realistic understanding of Soviet history and political culture, so that the results of treaty negotiations will be more positive in the future than they have been in the past. In effect, he argues for a risk-assessment approach, in which diplomats take seriously the possibility of treaty violation and factor the possible consequences into their diplomatic assessments. The Soviet Union's record, from arms control treaty violations to the invasion of Afghanistan, has been appalling, and the ignorance of American statesmen about the Soviet Union, from Roosevelt to Reagan, is discouraging. Despite Gorbachev's accession and liberalizing developments in the Soviet Union and Eastern Europe, he warns, caution is warranted. Using relevant texts and historical materials, supported by anecdotes and his own extensive personal experiences, Beichman presents a readable, compelling argument that is sure to be controversial. The book will be of particular interest to specialists in international affairs, and experts on the Soviet Union and Central Europe, as well as general readers interested in the course of U.S.-Soviet relations.

Book excerpt: This volume provides the most comprehensive account to date of the foundations, evolution, and nature of the treaty-making practice, known as the practice of mixed agreements, whereby the European Community and its Member States enter into international agreements with one or more other subjects of international law. Covering policy areas from external economic relations to the environment, from development cooperation to the law of the sea, the practice of mixed agreements occupies a highly prominent position in the external relations of the EU. Rather than focusing upon any particular agreement or subject area, the book seeks to identify, through analysis of the respective interests of the Community, the Member States and other parties, as they are reflected in actual practice, the general parameters for the conclusion and application of mixed agreements. The basic thesis defended is that there are mediating strategies whereby mixed agreements can be turned into an effective technique for manifesting the Community's position in external relations whilst nevertheless safeguarding the vital interests of the Member States and the other, non-EC parties. Rather than a `necessary evil', mixed agreements should be regarded as a natural way of organizing the international relations of the EC and its Member States. Of individual treaties, the most thorough examination is made of the Community and the Member States' participation in the Law of the Sea Convention, the Food and Agriculture Organization of the UN (FAO), as well as the Agreement establishing the World Trade Organization (WTO). As regards the WTO, for instance, the book offers a comprehensive account of the dispute settlement practice under the GATS and TRIPS Agreements.
