Book A Bibliography of Legal Festschriften

Download or read book A Bibliography of Legal Festschriften written by L.M. Roberts and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 187 pages. Available in PDF, EPUB and Kindle. Book excerpt: The idea of compiling a bibliography of legal Festschriften originated with Lilly Roberts, and represented the most important creative side of her life during the last ten years of her association with the Universi ty of Michigan Law Library. The project received advice and counsel from the Foreign Law Com mittee of the American Association of Law Libraries. The final publi cation was made possible by an allocation from the grant made to the University of Michigan Law School by the Ford Foundation for re search in International and Comparative Law. Beverley J. Pooley Professor of Law Director of the Law Library University of Michigan PREFACE The present bibliography is international in scope; it covers Fest schriften published in many countries. It includes Festschriften from 1868 (date of the earliest legal Festschrift found) through December, 1968. A bibliography of all legal Festschriften, to be complete, could only be achieved through the cooperative effort of an international group of experts. The present bibliography is based on notes gathered by the compiler over a period of years from material available at the University of Michigan Law Library. It is therefore, inevitably, incom plete and occasionally inaccurate and must be considered as a tentative list, subject to implementation and correction at other legal centers. It was felt, however, that its publication might be of some use, since not enough bibliographical information about this important and steadily growing type of legal literature exists.

Book An Index to Common Law Festschriften

Download or read book An Index to Common Law Festschriften written by Michael Taggart and published by Bloomsbury Publishing. This book was released on 2006-09-01 with total page 344 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first ever index of contributions to common law Festschriften and fills a serious bibliographic gap in the literature of the common law. The German word Festschrift is now the universally accepted term in the academy for a published collection of legal essays written by several authors to honour a distinguished jurist or to mark a significant legal event. The number of Festschriften honouring common lawyers has increased enormously in the last thirty years. Until now, the numerous scholarly contributions to these volumes have not been adequately indexed. This Index fills that bibliographic gap. The entries included in this work refer to some 296 common law Festschriften indexed by author, subject keyword, editor, title, honorand and date. It therefore includes over 5,000 chapter entries. In addition, there are more than a thousand entries of English language contributions to predominantly foreign language, non-common law legal Festschriften from Germany, Austria, Switzerland, Denmark, Finland, Iceland, Norway and Sweden.

Book The Reasonable As Rational

Download or read book The Reasonable As Rational written by Werner Krawietz and published by . This book was released on 2016 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the course of the last few decades Aulis Aarnio has made a major contribution to the process of laying of new foundations for the theory of practical legal argumentation and modern jurisprudence (legal theory, philosophy of law). He was influenced by the modern philosophy of language and by the late works of Ludwig Wittgenstein as well as being inspired by the analytical-hermeneutic philosophy of his teacher Georg Henrik von Wright. With his original and widely acknowledged research in law and legal systems and the rationality of the resulting scholarly interpretation which have been crowned and honoured with the Alexander von Humboldt Research Award in the field of the Humanities he has changed the face of modern legal science, above all, that of juridical or legal method, the methodology of law and the social sciences and of legal and social theory, the latter in his capacity as editor-in-chief of »Associations«, a new periodical from the same publisher. The »Festschrift« was presented to him on his 60th birthday in the name of his friends and colleagues from all over the world in a specially hand-rafted copy. This book is a kind of handbook to his discipline and contains very profound and sophisticated responses to his magnum opus, »The Rational as Reasonable. A Treatise on Legal Justification«, which has determined and significantly advanced contemporary research in the field of legal and scholarly interpretation and argumentation. It deals with nearly all the central issues in the application of law and its justification.

Available in PDF, EPUB and Kindle. Book excerpt: The contributions in this volume pay homage to Zenon Bańkowski, with a focus on problems concerning law’s normalization and the revitalizing force of anxiety. Ranging from political critique to methodological issues and from the role of human rights in development to the role of parables and analogy in legal reasoning, the contributions themselves are testament to the richness of Bańkowski’s scholarship, as well as to the applicability of his core ideas to a wide range of issues. Divided into five parts, the book focuses on the role and methods of the jurist; conceptions of legality and the experience of living under rules; jurisprudential issues affecting exchange and the market; and the burden and methods of legal judgement. It also includes Bańkowski’s 2011 valedictory lecture and a bibliography of his work. Comprising all original contributions, the contributors represent a balance of established, leading figures and younger, emerging scholars in the field of legal and social theory.

Book The Golden Metwand and the Crooked Cord

Download or read book The Golden Metwand and the Crooked Cord written by C. F. Forsyth and published by Oxford University Press. This book was released on 1998 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a lively collection of essays by an internationally distinguished group of the world's most respected administrative lawyers. It is a timely work as public law in the United Kingdom is at an extremely interesting stage in its long development. A period of unprecedented expansion in the judicial review jurisdiction and the growing legal impact of membership of the European Community provide an incentive to reflect upon and consolidate existing learning, and assess how public law doctrine and scholarship will progress into the new millenium. There has also been a recent burgeoning of theoretical public law scholarship and the development of more critical and socio-legal approaches to the subject of law and administration. This book takes account of all these factors, and also reflects the international dimension of administrative law issues. The essays are written in honour of Sir Wlliam Wade, who was Professor of English at St John's College Oxford, Rouse Ball Professor of English Law at the University of Cambridge and Master of Gonville and Caius College Cambridge. He is one of the leading scholars of his generation and is justly credited for having contributed hugely to the development of administrative law in Britain through his text Administrative Law (OUP) but also through the Hamlyn lectures and through his work as a member of the English bar, his lectures throughout the world and numerous articles, notes and essays.

Book Law Life and the Images of Man

Download or read book Law Life and the Images of Man written by Frank Fleerackers and published by . This book was released on 1996 with total page 642 pages. Available in PDF, EPUB and Kindle. Book excerpt: Jan M. Broekman is since 1996 Professor emeritus of Philosophy of Law and Legal Theory at the Catholic University of Leuven (Belgium) and of Philosophy and Medical Ethics at the Vrije Universiteit of Amsterdam (Netherlands).During a long and distinguished career he has won an international reputation for his work in the fields of legal anthropology, legal theory and the philosophy of law and medicine. He published widely in these fields and lectured throughout Europe, Latin America and the United States of America. This Festschrift reflects some important themes of his work, especially the ones concerning the intertwinement of legal, medical and moral discourse and its related aspects in technology, politics and anthropology.Due to their different fields of research, the authors approach their topic from their own scientific and cultural perspective. The contributions provide the reader with well-documented and skilled insights into specific questions in many countries like Germany, Brasil, Chile, Italy, Belgium and the United States of America. The composition of the colourful range of contributions is focussed on the core theme of both legal modernism and post-modernism: the tacit assumption of a discursive unity behind thinking, acting and talking. The mimetic representation of man and humanity in legal and medical discourse is built on this assumption.Fundamental questions belonging to the discursive unity are dealt with, for instance concerning language and reality; being and mimesis; norms, rights and facts. They are confronted with actual questions in health care (quality of life, autonomy, the elderly), in European politics and in economics. The contributions document the leading developments in today's legal, medical and philosophical debates. They will provide the reader with outstanding thoughts on the future orientation of law in society.

Book excerpt: "A festschrift for Guido Alpa, what could be better or indeed more fun...the guests come from all over the world and represent the most interesting, the best, each country has to offer. Truly a fete, truly amicorum! ...Guido Alpa knows the place of theory in law, and knows how to apply it to the forensic arts. He does this, however, without ever confusing the role of the scholar and that of the advocate. In Guido Alpa both parts are played elegantly, each learns from the other, but the two are never conflated.. We have come because Guido is truly international in outlook and in feeling.. Guido stands out because he has always, and almost instinctively, known what it means to have a worldwide view of law." - Guido Calabresi, Forward of Liber Amicorum Guido Alpa *** This festschrift honors Guido Alpa, a professor of civil law at the University of Rome 'La Sapienza.' He has held visiting chairs at universities around the world, honorary degrees, and appointments and honors too many to mention. He is a leading scholar of private and commercial law, but also covers many constitutional and regulatory topics, moving freely across the boundaries that divide the law. He is recognized internationally as a leading comparativist as well as one of the parents of European private law.
