Book excerpt: The Department for Environment, Food and Rural Affairs and its Animal Health agency successfully contained limited outbreaks of Avian Influenza and Foot and Mouth Disease in 2007. The estimated £33 million expenditure by Animal Health in 2007-08 on dealing with these exotic disease outbreaks has represented good value for money when compared to the economic costs of these diseases becoming more widespread. The control of some of the more serious endemic diseases has been managed less successfully. Good progress has been made with the control of Bovine Spongiform Encephalopathy (BSE), Scrapie and Salmonella, but Bovine Tuberculosis has continued to spread. In 2007-08, tackling Bovine Tuberculosis accounted for 39 per cent of Animal Health's total expenditure. Herd restrictions are applied immediately when disease is identified, but compliance with the requirements for routine testing to detect disease is not rigorously enforced. There are no national standards on farm biosecurity to minimise the risk of diseases spreading. The Department, Animal Health and other inspection bodies, such as local authorities, do not systematically collect and share information about biosecurity risks. Beekeepers have reported unusually high losses of honeybees in recent years and, now that the Varroa parasite is endemic, honeybee colonies are more vulnerable to other diseases. Controlling Varroa and monitoring of other diseases is hampered by the limited inspections of colonies carried out by the Department's National Bee Unit. An estimated 20,000 beekeepers are not known to the Unit's inspectors and are less likely to notify the Department of any diseases.

In the UK the incidence of common allergic diseases has trebled in the last twenty years to become one of the highest in the world. Treatment of allergies is a significant cost to the National Health Service. Allergies can have a detrimental impact upon the education of children at school or the performance of adults at work. There is a severe shortage of allergy specialists in the United Kingdom. Problems with data collection mean that statistics are imprecise, and a significant proportion of general practitioners are unable to diagnose and manage allergic disorders, and have nowhere to refer patients with complex allergies. The report recommends that allergy centres led by a full-time allergist should be developed, where various specialists come together to diagnose and manage patients with complex allergic disorders. These allergy centres should be a source of education and training for doctors, nurses and other healthcare workers at every grade. They should also advance research, enabling effective treatments to be developed, and should provide the clinical database required for epidemiological studies. Clinicians within the allergy centre should work together with local schools, employers, charities and others to educate the general public, and particularly patients and their families, on allergy matters. Other recommendations include: maintaining clinical surveillance systems to monitor allergic disease; calling for further research into the ways in which the indoor environment influences allergy development; reviewing how children with hayfever are supported throughout the examination system; assessing the training that teachers receive in dealing with allergic emergencies; assisting individuals with occupational allergies to return to work; amending food labelling legislation to specify the amount of allergens contained within products; analysing the costs and benefits of immunotherapy treatment; and withdrawing advice which recommends peanut avoidance for pregnant women.

This book identifies the European Union's impact assessment regime as a source of these norms. In 2002 the European Commission - later followed by the European Parliament and the Council of Ministers - committed to performing rigorous assessment of the economic, social and environmental impacts of policy options before adopting (legislative) proposals. Applying a 'constitutional lens' to this 'regulatory' topic, Anne Meuwese examines both the details and the framework of IA in EU lawmaking to date, drawing attention to its strengths, its contradictions, and its power to enhance the deliberative quality of legislative debates. Integrating the perspectives of political scientists and economists with the concerns of legal scholars and practitioners, Dr Meuwese describes and interrelates such aspects of the subject as the following: the potential role of impact assessment as a catalyst of legal principles, by emphasising or overriding norms that govern both the procedural and the substantive aspects of the EU legislative process; the 'constitutional tasks' of impact assessment as applied to European legislative proposals, especially relating to subsidiarity, proportionality, and the precautionary principle; the formal and informal extension of the scope of impact assessment beyond the co-decision procedure; the question whether impact assessment crosses the line between informing the legislator and fettering legislative discretion. In the course of her analysis Dr Meuwese develops models for possible usages of IA in EU lawmaking, analyses the implementation of impact assessment processes in the European Commission, the European Parliament and the Council as well as the roles of relevant 'co-actors', and offers results of empirical research in the forms of a survey of EU legislative practice and in-depth case studies of four EU legislative dossiers.

This report examines the proposals and finds them a lost opportunity. The Government should have directed the debate towards scrapping the existing CAP and replacing it with a Rural Policy for the European Union. There should thus be a new Vision document, launched in a more subtle way so that allies for reform can be enlisted. The credibility of the document depends on the Government providing full and detailed evaluation of the impact of proposals on biodiversity, the environment, markets for agricultural goods and individual farm enterprises. This should be done by mid 2008. The long-term justification of the expenditure of taxpayers' money is the provision of public benefit. These public goods should be measurable and capable of evaluation.

Regime complexes can be found wherever state interests clash. Thus, even in one of the most constitutionalized of institutional environments, the European Union (EU), regime complexity features prominently – especially in European defence cooperation, where states have created competing institutions overlapping in their mandates to organize armaments cooperation or defence planning. The tense relationship between the institutions of the EU’s Common Security and Defence Policy (CSDP) and those of NATO is well-known. Yet inter-institutional conflict is not limited to this dichotomy. It extends to institutions beyond these two frameworks, such as those of the former Western European Union and regional defence cooperation frameworks such as the Nordic Defence Cooperation (NORDEFCO), or OCCAR – a minilateral armaments agency. All these institutions have partially overlapping membership structures and mandates and therefore rival authority claims in the field of European defence. Book excerpt: In this report looking at crisis management in the EU, the Committee call for a closer working relationship between the EU Monitoring and Information Centre (MIC) and NATO's Euro-Atlantic Disaster Response and Coordination Centre (EADRCC). The role of the two bodies is similar, but there is practically no contact between them. It would be in the interests of the EU, NATO and the members of both organisations to support and complement each other's work rather than duplicating it. In the event of a serious natural or man-made disaster the failure of the two bodies to cooperate could have serious consequences. The Committee also raise concerns that NATO prevents officials of the EU Joint Situation Centre (SitCen) from taking part in NATO training courses due to concerns about security clearance. The Committee state that the level of security clearance required by NATO should be the same for officials of national Governments and of the European Union. The Committee also call on the Government to begin working with the EU to ensure a full EU contribution to the security preparations in place at the 2012 Olympic site and in surrounding London boroughs. Finally the report criticises the failure of the UK to participate fully in international exercises designed to test preparedness for Chemical, Biological, Radiological or Nuclear (CBRN) attacks. The UK has been involved to some extent in only 11 of 31 EU or NATO CBRN exercises between 2000 and 2008; it has played a full part by deploying teams in none of the NATO exercises, and only one of the EU exercises.

Following on from a National Audit Office report (HCP 17, session 2004-05; ISBN 0102931550), the Committee's report focuses on the following issues: strengthening compliance checks and enforcing penalties for non-compliance; improving case processing and making the system easier to use, including simplifying forms; and the operation of the tax exemption scheme for heritage assets. A number of conclusions and recommendations are made, including the need to: improve data collection and analysis to examine the tax gap on undeclared or under-valued assets; consider extending regulations on disclosure obligations to inheritance tax avoidance schemes; and to further reduce the number of long-outstanding cases by setting targets and making full use of powers to secure information required. The report also recommends that the Revenue should consider developing a co-ordinated bereavement website, in co-operation with other departments, containing advice and information on dealing with the death of a relative, including filing inheritance tax and probate returns.
