Book excerpt: The Health Committee calls for fundamental reform of the social care system in England and says political point-scoring must stop. Instead of indulging in pre-election politicking, all the parties should come together to map out sustainable reform. Consensus on the details of reforms must be achieved early in the new Parliament and a failure to do so will betray current and future generations. The report says the current social care system is chronically underfunded, severely rationed, locally variable, too often of poor quality and discriminates against older people. The Committee is highly critical of the Government's Free Personal Care at Home Bill which it says smacks of policy-making on the hoof and risks creating perverse incentives and being substantially underfunded. Free care funded from taxation has many supporters but has been ruled out as an option by the Government. The Committee urges debate on this issue. It also acknowledges the widespread concern about the proposed reform of disability benefits for older people, noting the lack of clear information from the Government on who the winners and losers will be. To mitigate significantly the worst aspects of the existing funding system, as an interim measure, the Committee recommends raising the capital thresholds in the means test. The Committee strongly supports giving people more choice and control over their care and support, but emphasises that vulnerable people must be properly protected.

Book excerpt: The Chancellor's departments faced extraordinary challenges during 2008-09, mainly arising from the need to respond to the emerging financial crisis and associated economic downturn. The report concludes that it is very difficult to draw final conclusions regarding their level of success - too much remains unfinished business. It draws attention, in particular, to the new relationship between the Treasury and UKFI, and recommends that the Government considers whether the formal terms of the relationship need some re-definition in the light of experience. The report is particularly concerned by the dire results for HM Revenue & Customs (HMRC) of a cross-Government staff survey pilot study. The Report calls for HMRC management to publish a clear and detailed plan to provide focus and direction to their efforts to re-engage with their workforce. Noting a rise in customer complaints and that, on average, only 57 per cent of calls to HMRC contact centres were answered during 2008-09. HMRC should publish more data to enable effective scrutiny of its performance against its targets, data which is essential for tax gaps to be closed and for the take up of the working tax credit to be assessed and improved. The Report is critical of the failure of most departments to provide accurate and timely monthly in-year figures to the Treasury. Other sections of the report cover National Savings & Investment, the revaluation of UK statutory ports and the performance of the Royal Mint.

Book excerpt: Although there has been a lot written about how counter-terrorism laws impact on human rights and civil liberties, most of this work has focussed on the most obvious or egregious kinds of human rights abrogation, such as extended detention, torture, and extraordinary rendition. Far less has been written about the complex ways in which Western governments have placed new and far-reaching limitations on freedom of speech in this context since 9/11. This book compares three liberal democracies - the United States, the United Kingdom and Australia, in particular showing the commonalities and similarities in what has occurred in each country, and the changes in the appropriate parameters of freedom of speech in the counter-terrorism context since 9/11, achieved both in policy change and the justification for that change. In all three countries much speech has been criminalized in ways that were considered anachronistic, or inappropriate, in comparable policy areas prior to 9/11. This is particularly interesting because other works have suggested that the United States' unique protection of freedom of speech in the First Amendment has prevented speech being limited in that country in ways that have been pursued in others. This book shows that this kind of argument misses the detail of the policy change that has occurred, and privileges a textual reading over a more comprehensive policy-based understanding of the changes that have occurred. The author argues that we are now living a new-normal for freedom of speech, within which restrictions on speech that once would have been considered aberrant, overreaching, and impermissible are now considered ordinary, necessary, and justified as long as they occur in the counter-terrorism context. This change is persistent, and it has far reaching implications for the future of this foundational freedom.

Book excerpt: Reviews of patients' case notes indicate that in the NHS and in other healthcare systems as many as 10 per cent of patients admitted to hospital suffer some form of harm, much of which is avoidable. Tens of thousands of patients suffer unnecessary harm each year and there is a huge cost to the NHS in consequence. This report examines the implementation of safety policy since 2000. That policy has focused on the creation of a unified national mechanism for reporting and analysing incidents, underpinned by a new culture of openness in the NHS. Systems for reporting, and learning from, incidents, were established, centred on the National Reporting and Learning System (NRLS) and the National Patient Safety Agency (NPSA). The Committee finds areas where policy has failed, barriers to change and other reasons for slow progress. It recommends several changes that need to be made in order for there to be further progress in tackling unsafe care. The recommendations are in the areas of: measurement and evaluation; harmed patients and their families or carers; creating a more open, reporting and learning NHS; more patient safety at the front line in the NHS; greater use of technologies to improve care; improvements in the education and training curricula; commissioning by Primary Care Trusts, performance management and regulation; the role of managers and boards; and the role of the Department of Health and Government.
