Book excerpt: In this report, 'The Review of the Less Favoured Areas Scheme (HL Paper 98)', the European Union Committee calls for the swift adoption of reforms to the EU Less Favoured Areas (LFA) scheme, a method of distributing EU agricultural funding to disadvantaged areas where farming land might otherwise be abandoned. The report stresses that the justification for the LFA scheme is to maintain farming in marginal areas where farming activity generates benefits for the environment and landscape, rather than to compensate for regional economic hardship.

Download or read book The Revision of the EU s Emission Trading System written by U K Stationery Office and published by The Stationery Office. This book was released on 2008-12 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: Both the UK and the EU have pinned much of their climate change policy on the effective opeation of the EU emissions trading system (ETS). Now in its second year the scheme has yet to demonstate that it can deliver the substantial greenhouse gas emission reductions that will form the yardstick of its success. This report examines the proposed revisions to the ETS, which would take effect in the scheme's third trading period, scheduled to last from 2013 to 2020. It is ultimately felt that if the ETS is to live up to its full potential, the aim must be to link it up with emissions trading schemes in other parts of the world so as to make the most of emission reduction opportunities in additional countries and sectors. However, the establishment of such links could prove arduous. It is anticipated that the EU may eventually face stark trade-offs between maintaining the environmental integrity of the ETS and extending its reach.
Download or read book Draft Detention of Terrorist Suspects Temporary Extension Bills written by Great Britain: Parliament: Joint Committee on the Draft Detention of Terrorist Suspects (Temporary Extension) Bills and published by The Stationery Office. This book was released on 2011-06-23 with total page 68 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Joint Committee scrutinised the Home Office's draft Detention of Terrorist Suspects (Temporary Extension) Bills, which could be enacted urgently if it ever became necessary to extend to 28 days the maximum period for which the police could apply to a High Court judge detain terrorist suspects before charging them. The Committee agrees with the Government's objective, but does not accept the Government's proposals for achieving the objective. When provisions of this kind needed to be introduced after individuals had been arrested; it would be almost impossible to give Parliament the information it would need to scrutinise the legislation adequately without putting at risk a suspect's right to have a fair trial. In addition there is a risk that, if the provision was required in a period of parliamentary recess or dissolution, legislation could not be introduced in time, or at all. The Committee recommends, instead, the introduction of legislation to empower the Secretary of State to make an executive order (with the agreement of the Attorney General and subject to rigorous safeguards), that would temporarily extend the maximum period available for pre-charge detention to 28 days. There would have to be an independent review of the case for making such an order. The Director of Public Prosecutions would continue to be responsible for applications to a High Court judge in individual cases. The Secretary of State would be accountable to Parliament for the decision once there was no longer any risk of prejudicing judicial proceedings.
Download or read book Managing civil tax investigations written by Great Britain: National Audit Office and published by The Stationery Office. This book was released on 2010-12-17 with total page 36 pages. Available in PDF, EPUB and Kindle. Book excerpt: HMRC's civil investigations directorates, which examine serious cases of suspected tax evasion, have generated increasing returns from their work, while reducing resources. This report recognises this improvement in performance but underlines the scope for them to achieve more. Since 2007-08 the directorates have increased the additional tax generated ('yield') from their work by 49 per cent in real terms to £8.5 billion, while reducing their expenditure by 10 per cent in real terms, to £567 million. They have also delivered a range of other activities to prevent future tax losses and improve taxpayer compliance. Yield provides a firm measure of the value of investigation work. But used alone it does not capture the full impact of investigations, such as the effect on taxpayer behaviour; nor does it encourage preventative work to improve compliance. The Department is planning a broader range of metrics to assess the impact of its enforcement activities. While the Department is making progress in understanding its performance and managing its enforcement resources, it does not have all the management information necessary on the cost-effectiveness of its different types of enforcement activity and their wider impact. Among the NAO's recommendations are that the system for referring cases for investigation be improved; that the time taken to complete investigations be reduced; that a clearer picture be developed of the penalties imposed on those found to have evaded or defrauded tax; and that it be made easier to trace whether tax debts from completed investigations have been paid in full.
Download or read book Limits to EU Powers written by Jacob Öberg and published by Bloomsbury Publishing. This book was released on 2017-07-27 with total page 259 pages. Available in PDF, EPUB and Kindle. Book excerpt: PRAISE FOR THE BOOK “...essential reading for anyone interested in the existence and exercise of EU powers in the field of criminal law. Öberg's critical examination of the constitutional constraints to EU action also raises many questions that are of great interest in other areas of EU competence. The book deserves a wide readership among scholars interested in the constitutional workings of the European Union.” Samuli Miettinen, University of Helsinki & Tallinn University "The main strength of this book lies in its comprehensiveness of dealing with the topical issue of EU regulatory criminal law from the fascinating perspective of limits to EU powers. Its particular contribution to existing scholarship in the field of EU criminal law concerns its focus on judicial checks on the exercise of competences as to which the book offers a convincing proposal for a stricter standard for judicial review in matters of regulatory criminal law and beyond." Professor Jannemieke Ouwerkerk, Leiden Law School "An excellent read on competence allocation in EU law and what it means in criminal law context. This book guides the reader through very complex questions of the contours of subsidiarity, national competences and the exact limits of EU powers. It also supplies up to date case studies of financial crimes and the need for the EU to act effectively and thereby increase confidence in the market and the challenges it may cause for national systems. A very timely contribution." Ester Herlin Karnell, VU University Amsterdam Pursuant to the precepts of EU law, EU policy-makers are bound to ensure that any EU legislation must fall within the remit of the EU's competences. This monograph looks at this highly contested issue, with particular reference to European Union criminal law. It looks at the powers enjoyed by the EU to impose criminal sanctions to suggest mechanisms by which legislative powers could be kept in check. The book argues that the main responsibility for providing checks against the exercise of EU power lies with the EU judiciary. It argues that the most effective form of review is procedural and through the case study of sanctions, provides the basis for such a review. Innovative, engaging and rigorous, this is an important publication both in the field of European criminal and constitutional law.

This book was released on 2008-03-06 with total page 92 pages. Available in PDF, EPUB and Kindle. Book excerpt: The 2003 reform of the Common Agricultural Policy marked the culmination of a gradual reorientation of EU farm subsidies from product support to direct income support. A mid-term "Health Check" of this reform is now underway, exploring what further adjustments may be required for the period 2009 to 2013. The Commission's proposals for short-term adjustments to the CAP merit broad support. The Committee is not convinced of the long-term justification for maintaining direct subsidy payments in their present form, and advocates a phased reduction in direct payments over the course of the next financial period beginning in 2014. A significant proportion of the funds released should remain earmarked for the CAP, but be spent on the rural development element of the policy rather than on farm subsidies. The report also addresses the challenges and opportunities that lie ahead for the EU agriculture industry. The sector is a significant contributor to climate change, but also vulnerable to its effects. Climate change may present a business opportunity for the industry, which is uniquely placed to deliver environmental services. Soaring global demand for many agricultural commodities has allowed some sectors of the European farming industry to prosper, while others are grappling with rising input prices and stagnant or falling output prices. Were supply shortages to ensue in future, the Committee expects that food scarcity would be a function of income rather than of production capacity. Those most at risk are consumers on low incomes in the developing world. Further trade liberalisation in the agriculture sector is supported, but if direct payments are withdrawn and import tariffs reduced-as the UK Government advocates-then the production standards that EU producers of agricultural goods are obliged to meet should be re-examined.
Download or read book Building Schools for the Future written by Great Britain: Parliament: House of Commons: Committee of Public Accounts and published by The Stationery Office. This book was released on 2009-06-11 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Department for Children, Schools and Families' Building Schools for the Future Programme (BSF) plans to renew every secondary school in the country, by rebuilding half of them, structurally remodelling 35 per cent, refurbishing 15 per cent and providing Information Communication Technology to all. Its aim is to use capital investment in new buildings as a catalyst to improve educational outcomes. The Department estimates that the programme will cost £52-£55 billion over its lifetime. The Department was over-optimistic in its original planning assumptions for BSF: of the 200 schools originally planned to be completed by December 2008, only 42 had been by that date. The Department now expects the programme to take 18 years, with the last school completed in 2023. Local authorities are responsible for the local delivery of BSF. They plan, procure and manage the BSF school buildings. In 2004, the Department established Partnerships for Schools to manage the national delivery of the programme. The Department and Partnerships for Schools encourage local authorities to procure their schools through a Local Education Partnership. These are 10-year partnerships to procure a flow of projects, structured as joint ventures between the local authority, a consortium of private companies that build, finance and maintain schools, and Building Schools for the Future Investments. It is too early to conclude whether BSF will achieve its educational objectives. To date, over-optimism has meant the programme could not live up to expectations. Establishing Partnerships for Schools to manage the programme centrally has helped local authorities to deliver more effectively, but while Local Education Partnerships have potential advantages, their value for money is yet to be proven. And it will be very challenging to deliver all schools by 2023.

Book excerpt: It is estimated that at any one time 4,500 EU nationals are held in custody in countries other than their normal place of residence. As they are less likely to be granted bail (because of a greater perceived of absconsions) the Commission has proposed a European supervision order (ESO), which would mean that authorities in a person's home State would also be responsible for returning them for trial. This report examines the proposal in detail and makes some recommendations for improvement. The Committee welcome the proposal and think it deserves prompt attention by Member States.

Download or read book Carbon Politics and the Failure of the Kyoto Protocol written by Gerald Kutney and published by Routledge. This book was released on 2014-02-03 with total page 248 pages. Available in PDF, EPUB and Kindle. Book excerpt: Carbon Politics and the Failure of Kyoto charts the framework and political evolution of the Kyoto Protocol negotiations and examines the ensuing failure of the international community to adequately address climate change. The focus is not on the science or consequences of climate change but on the political gamesmanship of the major players throughout the UNFCCC negotiation process. More than an updated history of the subject matter, this book provides a detailed study of the carbon targets which became the biggest influencing factor on the reaction of nations to Kyoto’s binding agreements. The book provides an in-depth analysis of the leading nations’ motives, including the US, China and Germany, in entering the negotiations, in particular, their economic interests. Despite the effort to combat climate change in politics that the negotiations represent, the book concludes that an agreement which requires almost 200 very different nations to agree on a single protocol is doomed to failure. The book offers a novel contribution to our understanding of this failure and suggests alternative frameworks and policies to tackle what is arguably the most complex political issue of our time.
Download or read book The United Nations and Human Rights written by Frédéric Mégret and published by Oxford University Press. This book was released on 2020-04-02 with total page 802 pages. Available in PDF, EPUB and Kindle. Book excerpt: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.
