Book excerpt: It is estimated that at any one time 4,500 EU nationals are held in custody in countries other than their normal place of residence. As they are less likely to be granted bail (because of a greater perceived of absconsions) the Commission has proposed a European supervision order (ESO), which would mean that authorities in a person's home State would also be responsible for returning them for trial. This report examines the proposal in detail and makes some recommendations for improvement. The Committee welcome the proposal and think it deserves prompt attention by Member States.

If the Commission prohibits a merger, or a third party objects to the clearance, the decision can be challenged in the Court of First Instance (CFI). However the CFI procedure can take several months, thereby prolonging uncertainty and sometimes causing bids to be abandoned. This is unsatisfactory and the CBI has proposed a new Competition Court as the way forward. This report looks at this proposal and concludes that such a court would not be the best way forward. Instead there is scope for improving current procedures by firmer case management, reducing the work load of the CFI by transferring trade mark cases, and improving the Commission's handling of cases to reduce the number and scope of challenges.

Book excerpt: The European Arrest Warrant (EAW) is now widely used to secure the arrest and surrender of suspected criminals across the Union. The EAW has a key role to play in the fight against terrorism and in bringing those accused of serious crime to justice. This report draws attention to two recent developments relating to the EAW. Firstly, the EC Commission's recent report on the implementation of the EAW criticised Member States for inadequate or faulty implementation. Secondly, certain Member States' constitutional courts have found incompatibility with safeguards provided for their nationals. As a result, some legal uncertainty now surrounds the EAW. Until this is resolved the EAW may not be fully effective between Member States. Further, the adoption of other measures based on mutual recognition, such as the European Evidence Warrant, may be delayed. The report also makes available the written and oral evidence on these matters given by Mr Andy Burnham MP, Parliamentary Under Secretary of State in the Home Office.

Book excerpt: The European Commission has recently adopted a proposal for the a Regulation crating a European Small Claims Procedure, which seeks to secure consumers' access to justice and settlement of disputes in the single market. The ESCP would provide a procedure available in the courts of all Member States to deal with cross-border cases and simple enforcement across national boundaries. In its examination of the Regulation the Committee identifies three main difficulties: differences between the Commission and Member States, most importantly on costs; the need for the practicalities of the scheme to be given more attention; lack of clarity in some parts of the text of the Regulation.

It is also one of the most contested fields of EU action, covering measures which have a significant impact on the protection of fundamental rights and the relationship between the individual and the State, while at the same time presenting a challenge to State sovereignty in the field and potentially reconfiguring significantly the relationship between Member States and the EU. The book will examine in detail the main aspects of EU criminal law, in the light of these constitutional challenges. These include: the history and institutions of EU criminal law (including the evolution of the third pillar and its relationship with EC law); harmonisation in criminal law and procedure (with emphasis on competence questions); mutual recognition in criminal matters (including the operation of the European Arrest Warrant) and accompanying measures; action by EU bodies facilitating police and judicial co-operation in criminal matters (such as Europol, Eurojust and OLAF); the collection and exchange of personal data, in particular via EU databases and co-operation between law enforcement authorities; and the external dimension of EU action in criminal matters, including EU-US counter-terrorism co-operation. The analysis is forward-looking, taking into account the potential impact of the Lisbon Treaty on EU criminal law.
