Book The EU s Approach to Human Rights Conditionality in Practice

Download or read book The EU s Approach to Human Rights Conditionality in Practice written by Elena Fierro and published by BRILL. This book was released on 2021-10-18 with total page 448 pages. Available in PDF, EPUB and Kindle. Book excerpt: Human rights in the external relations of the EU may manifest itself in different manners; one of them is the conditionality policy that the EU applies to third countries. This study intends to explore the modalities of this conditionality policy, as well as its nature and reach. It also analyzes how the policy could be improved and be made more coherent and effective. The point of departure is the division made between two modes of conditionality: ex ante and ex post. In the first case the EU issues conditions, which must be fulfilled before the negotiation or conclusion of a given agreement or an action with a view to strengthening the relations. The second case, conditionality ex post , is when conditions are allready part of an agreement or an established relation. The so-called human rights clause, or democratic clause, incarnates the second modality. This study explores both types of conditionality, but puts a special emphasis on the second, given its legal nature, its reciprocity, and its systematic inclusion in all framework agreements. It is argued here that this clause could represent the basis of a fully-fledged human rights policy of EU. At present, however, the implementation of the clause has been fragmentary. The interpretation that has prevailed (the human rights clause being a mechanism of exclusively punitive nature), has constituted an obstacle for its implementation. In addition, the clause has been activated only as a response to breaches of democratic principles (and not human rights) in the ACP countries ( and not other regions). The human rights clause has been the victim of the 'sectorial approaches' where policy choices were determined by the instrument at issue. It is about time for the EU to revisit the interpretation of the clause in order to make of it a dynamic instrument, integrated in a global and coherent external human rights policy.

Book The NEBI YEARBOOK 2001 2002

Download or read book The NEBI YEARBOOK 2001 2002 written by Lars Hedegaard and published by Springer Science & Business Media. This book was released on 2013-03-09 with total page 485 pages. Available in PDF, EPUB and Kindle. Book excerpt: Thorvald Stoltenberg President of the Norwegian Red Cross Chairman of the Editorial Advisory Board Despite the very optimistic language on the imminence of new accessions to the European Union that came out of the June 2001 European Council in Gothen burg, it will serve no good purpose to neglect the fact that EU membership for the Central and Eastern European applicants remains a difficult process. Painful experience makes it prudent to exercise caution in predicting developments with in the European Union. Negotiations may drag out, snags may appear and some thing may happen on the way to ratification. So perhaps it is wise to take a broad er view of European integration - and therefore integration within the North European, Barents and Baltic Sea region that is the focus of this Yearbook. EU membership for those countries that are able to satisfy the Copenhagen requirements - and the chapters of the acquis communautaire that have subse quently been specified - is certainly a prize worth fighting for. But all is not lost if some of the applicants end up not joining the Union as a result of the current enlargement round. Even more important than formal membership is the process of growing together that has taken place simultaneously with the membership negotiations. We are dealing here with integration in the real world of trade, investments, division of labour, politics, environment, hard and soft security, people-to-people relations etc.

Book Designing Democracy

Download or read book Designing Democracy written by G. Pridham and published by Springer. This book was released on 2005-05-11 with total page 294 pages. Available in PDF, EPUB and Kindle. Book excerpt: Designing Democracy is the first systematic and in-depth study of the effects of the EU's democratic conditionality, originally set out in the Copenhagen conditions of 1993, on the new political systems of Central and Eastern Europe. Using new material drawn from extensive elite interviews in several of these countries as well as in Brussels, the book throws much light on how far the EU enlargement process has really strengthened these new post-Communist democracies following their transitions in the 1990s.

Book The Effectiveness and Limits of EU Conditionality

Download or read book The Effectiveness and Limits of EU Conditionality written by Lenka Fedorová and published by LIT Verlag Münster. This book was released on 2011 with total page 235 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study examines domestic policies in Slovakia from the collapse of communism in 1989 until its EU accession in 2004. It traces policy changes in Slovak healthcare, regional policy, agriculture, and minority protection, and it assesses the capacity of domestic political actors and external agents to shape the policy arrangements and institutional environment in a democratizing state aspiring to join the EU. The study addresses the issues of democratic transition and consolidation in EU candidate states, evaluates the effectiveness and limits of EU conditionality in the respective policy domains, and contributes to current debates on democratization, Europeanization, and policy transfer. Book EU Enlargement

  • Release : 2004-07-01
  • ISBN : 1847310680
  • Pages : 256 pages

Download or read book EU Enlargement written by Christophe Hillion and published by Bloomsbury Publishing. This book was released on 2004-07-01 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: The enlargement of the European Union to embrace Central, Eastern and Southern Europe is usually analysed from political and economic points of view. The current process also has legal implications which this edited collection aims to explore. Written by scholars and officials from the enlarged EU, the contributions look at the conditions and modalities of accession and at the impact of enlargement on EU institutions and policies. This volume is a useful reference for anyone interested in enlargement as such but it also provides a valuable background to the current constitutional reform of the EU.

Book The European Union s 2007 Enlargement

Download or read book The European Union s 2007 Enlargement written by Cristina Chiva and published by Routledge. This book was released on 2014-07-10 with total page 132 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book fills a significant gap in recent literature on European Union politics by examining the EU’s ‘other’ eastern enlargement, completed in 2007 with the accession of Bulgaria and Romania. It focuses on both the process and the effects of the 2007 enlargement within the wider context of the post-communist countries’ accession to the EU, and, more broadly, within the context of the history of EU enlargement. The book brings together in-depth analyses of a wide range of issues, both from a comparative perspective and through single case studies. Individual contributions shed new light onto EU enlargement through a theoretical re-evaluation of the ‘strategic action’ paradigm, as well as through historical analyses of the 2007 enlargement and of its implications for future EU enlargements. Further insight into the process of EU enlargement is gained through systematic exploration of the impact of accession on policy-making and institutional structures in Bulgaria and Romania. Altogether, the contributions exemplify the multi-faceted nature of EU enlargement and accession, as well as the extent to which the process of acceding to the EU is not completed with membership, either for the EU or for the candidate countries. This book was published as a special issue of Perspectives on European Politics and Society.
