Book excerpt: From the Publisher: In the wake of the most significant financial crisis since the Great Depression, the President signed into law on May 20, 2009, the Fraud Enforcement and Recovery Act of 2009, creating the Financial Crisis Inquiry Commission. The Commission was established to "examine the causes, domestic and global, of the current financial and economic crisis in the United States." The 10 members of the bi-partisan Commission, prominent private citizens with significant experience in banking, market regulation, taxation, finance, economics, housing, and consumer protection, were appointed by Congress on July 15, 2009. The Chair, Phil Angelides, and Vice Chair, Bill Thomas, were selected jointly by the House and Senate Majority and Minority Leadership. The FCIC is charged with conducting a comprehensive examination of 22 specific and substantive areas of inquiry related to the financial crisis. These include: fraud and abuse in the financial sector, including fraud and abuse towards consumers in the mortgage sector; Federal and State financial regulators, including the extent to which they enforced, or failed to enforce statutory, regulatory, or supervisory requirements; the global imbalance of savings, international capital flows, and fiscal imbalances of various governments; monetary policy and the availability and terms of credit; accounting practices, including, mark-to-market and fair value rules, and treatment of off-balance sheet vehicles; tax treatment of financial products and investments; capital requirements and regulations on leverage and liquidity, including the capital structures of regulated and non-regulated financial entities; credit rating agencies in the financial system, including, reliance on credit ratings by financial institutions and Federal financial regulators, the use of credit ratings in financial regulation, and the use of credit ratings in the securitization markets; lending practices and securitization, including the originate-to-distribute model for extending credit and transferring risk; affiliations between insured depository institutions and securities, insurance, and other types of nonbanking companies; the concept that certain institutions are 'too-big-to-fail' and its impact on market expectations; corporate governance, including the impact of company conversions from partnerships to corporations; compensation structures; changes in compensation for employees of financial companies, as compared to compensation for others with similar skill sets in the labor market; the legal and regulatory structure of the United States housing market; derivatives and unregulated financial products and practices, including credit default swaps; short-selling; financial institution reliance on numerical models, including risk models and credit ratings; the legal and regulatory structure governing financial institutions, including the extent to which the structure creates the opportunity for financial institutions to engage in regulatory arbitrage; the legal and regulatory structure governing investor and mortgagor protection; financial institutions and government-sponsored enterprises; and the quality of due diligence undertaken by financial institutions. The Commission is called upon to examine the causes of major financial institutions which failed, or were likely to have failed, had they not received exceptional government assistance. In its work, the Commission is authorized to hold hearings; issue subpoenas either for witness testimony or documents; and refer to the Attorney General or the appropriate state Attorney General any person who may have violated U.S. law in relation to the financial crisis.

Available in PDF, EPUB and Kindle. Book excerpt: The UNCITRAL Arbitration Rules have proved instrumental to the effective resolution of transborder, commercial, investment-treaty, and inter-State disputes. This book, by two leading scholars and practitioners whose 2006 joint report began the process that led to the first ever revision of the Arbitration Rules in 2010, and who were key contributors in the revision process at UNCITRAL thereafter, is the only article-by-article commentary of both the generic 2010 Rules and the Transparency Rules of 2013. Extensively referring to the UNCITRAL travaux préparatoires, the book considers: • the principal legislative intent behind each new or revised article – or, in respect of those articles which remain unchanged, the reasons for the absence of revision; • where an article is revised, or entirely new provisions are introduced, an explanation of the issues that the revision intended to address; and • an analysis of the discrete issues that arise in respect of each article. The authors make reference not only to academic literature and case law, but also to other commonly used Arbitration Rules and the practice under those Rules. More than a matchless guide to practice, this deeply informed resource offers a comprehensive understanding of both sets of UNCITRAL Rules. This book serves as the pre-eminent commentary and analysis on the UNCITRAL Arbitration Rules and the Transparency Rules.

Book The Soft Power of Non Western Small States

Download or read book The Soft Power of Non Western Small States written by Sarina Theys and published by Taylor & Francis. This book was released on 2024-09-12 with total page 112 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book critically engages with the concepts of small states and soft power and advances a new approach to defining small states, a new conceptualisation of soft power, and a method for empirically analysing the exercise of soft power. It revisits the concepts of small states and soft power with a focus on Bhutan and Qatar and their approach to exercise soft power to achieve their foreign policy goals. Building on two main perspectives to define small states – the objective approach and the subjective perspective – this book offers an intersubjective approach to define states as small. The intersubjective approach requires a shared understanding between states that a certain state is small. The book further highlights the importance of deconstructing the meaning of size and to separate the notion of size from the concept of power because size is not always indicative of power. It argues that although small states tend to have fewer material resources than large states, they nevertheless can have influence through the exercise of soft power. Soft power is in this book defined as the ability of an actor to convince another actor that something is true. Convincing deals with the beliefs of an actor and is a mental decision rather than a physical action. This book argues that the exercise of soft power can be analysed through examining the development, projection, and reception of identities. The findings of this book show that Bhutan was more successful than Qatar in exercising soft power and explains the reasons for this variation. Aimed at a multidisciplinary audience, this book will be of particular interest to practitioners, scholars, and students of International Relations, Political Power, Small States, and Area Studies.

Book Putting Passengers First Disruption at Gatwick Christmas Eve 2013 HC 956

Download or read book Putting Passengers First Disruption at Gatwick Christmas Eve 2013 HC 956 written by Great Britain: Parliament: House of Commons: Transport Committee and published by The Stationery Office. This book was released on 2014-04-11 with total page 32 pages. Available in PDF, EPUB and Kindle. Book excerpt: Far better contingency planning and preparedness must be put in place by UK airports, and by the airlines that use them, to prevent the kind of chaos that unfolded at Gatwick Airport on Christmas Eve 2013. The problems that unfolded were not new and the whole event should be a wake-up call for airports across the UK to improve their operational resilience. Airports must ensure that their contingency planning is good enough to ensure that future disruption will be met with well-drilled arrangements that are familiar to airport operators, airlines, and other contractors, and which put passenger interests first. If our largest airports cannot demonstrate they can do this then the Civil Aviation Authority must act. Passengers must also be promptly reimbursed for the extra costs they face as a consequence of disruption. The Committee welcomed a key conclusion from Gatwick's own review of the events on Christmas Eve that the airport should appoint passenger champions at each of its terminals. Similar arrangements should also be put in place at other major UK airports. Further recommendations include that airports should: develop (in consultation with airlines) much clearer operational protocols and guidance on the threshold conditions that will trigger the cancellation or postponement of flights; negotiate robust agreements with airlines (which carry formal responsibility for passenger welfare) for reclaiming the costs of looking after passengers during periods of disruption. Government should also push for amendments to a proposed new EU regulation on passenger compensation to include electronic means of alert and information dissemination

Book Carbon Politics and the Failure of the Kyoto Protocol

Download or read book Carbon Politics and the Failure of the Kyoto Protocol written by Gerald Kutney and published by Routledge. This book was released on 2014-02-03 with total page 170 pages. Available in PDF, EPUB and Kindle. Book excerpt: Carbon Politics and the Failure of Kyoto charts the framework and political evolution of the Kyoto Protocol negotiations and examines the ensuing failure of the international community to adequately address climate change. The focus is not on the science or consequences of climate change but on the political gamesmanship of the major players throughout the UNFCCC negotiation process. More than an updated history of the subject matter, this book provides a detailed study of the carbon targets which became the biggest influencing factor on the reaction of nations to Kyoto’s binding agreements. The book provides an in-depth analysis of the leading nations’ motives, including the US, China and Germany, in entering the negotiations, in particular, their economic interests. Despite the effort to combat climate change in politics that the negotiations represent, the book concludes that an agreement which requires almost 200 very different nations to agree on a single protocol is doomed to failure. The book offers a novel contribution to our understanding of this failure and suggests alternative frameworks and policies to tackle what is arguably the most complex political issue of our time.
