This book was released on 2006-01-30 with total page 80 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Committee's report examines how the UK Parliament can best hold the Government to account for the foreign policy of the European Union, known as the Common Foreign and Security Policy (CFSP). As the European Parliament has principally only an advisory role in scrutinising CFSP decisions, national parliaments therefore have a key role to play in ensuring that any foreign policy actions are taken in an open and transparent manner. The Committee welcomes the increased commitment to the scrutiny process shown by the FCO recently and hopes the same culture of scrutiny will be adopted by the MoD. The report makes recommendations including the need for improved procedures for the deposit of documents; early warning of important new initiatives and proposed actions; and the deposit of significant non-legislative documents for scrutiny.

Book The Cumulative Impact of Statutory Instruments on Schools

Download or read book The Cumulative Impact of Statutory Instruments on Schools written by and published by The Stationery Office. This book was released on 2009-03 with total page 104 pages. Available in PDF, EPUB and Kindle. Book excerpt: This inquiry was prompted by the finding that in the 2006-07 session schools were the subject of around 100 different statutory instruments made by the Department for Children, Schools and Families (DCSF). Evidence from schools' representatives has convinced the Committee that the Department need to overhaul their approach, and actively to manage the planning and production of secondary legislation and guidance. Too many regulations are currently introduced piecemeal, throughout the school year. The Committee concludes that DCSF should bring schools-related instruments into force on a single date - 1 September is recommended - and give schools at least a term's notice to prepare to implement them. The Government should, moreover, adopt a less heavy-handed approach in its relationship with schools, and shift its focus away from the regulation of processes through statutory instruments towards establishing accountability for the delivery of key outcomes. This approach would leave greater room for the professionalism of practitioners to deliver the objectives of improving education. The Committee has also found that DCSF rarely reviews the effect of the regulations that it imposes. As a consequence, the Department does not know whether a statutory instrument has achieved its policy objective. The Committee calls on the Department to review the implementation of all significant regulations.

Book Legal Accountability and Britain s Wars 2000 2015

Download or read book Legal Accountability and Britain s Wars 2000 2015 written by Peter Rowe and published by Routledge. This book was released on 2016-04-20 with total page 286 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the manner in which Britain’s wars, which took place between 2000 and 2015, have interacted with the relevant principles of international law and English law for the purpose, primarily, of considering legal accountability. During a debate in the House of Lords in 2005 a former Chief of the Defence Staff commented that ‘the Armed Forces are under legal siege.’ The book will discuss the major legal issues which have arisen, ranging from the various votes in Parliament to go to war, the constitutional relationship between ministers and senior commanders, the right under international law to use force, the influence of human rights law, the role of the courts in England (including the coroners’ courts), to the legal regime applying to the conduct of UK military operations. It will assess critically whether the armed forces will now have to accept that operations conducted outside the UK are subject to greater legal scrutiny than previously and whether, if this is the case, it is likely to hinder their future military activities. This book will be of great interest to scholars of international law, the law of armed conflict, military studies and international relations, as well as to those with a professional or other interest in the subject matter.

Book Monitoring the Government s response to court judgments finding breaches of human rights

This book was released on 2007-06-28 with total page 158 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the UK's institutional arrangements for protecting human rights, both Parliament and the judiciary have a central role. When the courts give a judgement finding that a law, policy or practice is in breach of human rights, it is for Parliament to scrutinise the adequacy of the Government's response and in some cases decide if there needs to be a change in law. An important part of the role of the Committee is to help Parliament in this function. This report brings together all their monitoring work in relation to both judgements of the European Court of Human Rights and declarations of incompatibility given by UK courts under the Human Rights Act.

Book The EU s Global Approach to Migration and Mobility

Download or read book The EU s Global Approach to Migration and Mobility written by Great Britain: Parliament: House of Lords: European Union Committee and published by The Stationery Office. This book was released on 2012-12-18 with total page 92 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report considers the Commission's 2011 Communication on the Global Approach to Migration and Mobility and the UK's participation in EU asylum and immigration measures. As countries in Europe face an ageing population and a declining birth rate, legal third country immigration into the EU will be needed to keep the economy on track and retain Europe's competitiveness in a global market. While Member States should retain primary responsibility for their own migration policies, the EU also has a role to play. As the majority of irregular migrants enter the EU with authorisation and then overstay their visas, rather than crossing the EU's external border by boat or land routes illegally, the EU should adopt a more effective approach in preventing irregular migration. The EU also has a role it can play in refugee management and building capacity in the asylum systems of countries of origin and transit. Moreover, migration policy cannot and should not be the sole concern of interior ministries and a more integrated approach with development and foreign affairs ministries - at the national and EU level - would help maximise the EU's development aims. The reduction of trade barriers with non-EU countries and measures to facilitate remittances, mitigate the effects of brain drain and assist diasporas to contribute to their countries of origin would also be beneficial. The Committee also considers the position of international students in the UK: they should not be subjected to the Government's policy objective of reducing net migration.
