Book Challenge of Child Welfare

Download or read book Challenge of Child Welfare written by Kenneth L. Levitt and published by UBC Press. This book was released on 2011-11-01 with total page 326 pages. Available in PDF, EPUB and Kindle. Book excerpt: 'I think this book, in assembling the views of a distinguished group of professionals, can have a profound effect on child welfare theory and practice. These practitioners, critics and academics have much to say. I for one am grateful that their views are now conveniently available to all of us in this book.' -- from the foreword by Thomas R. Berger, Chairman, the British Columbia Royal Commission on Family and Children's Law The first Canadian text on child welfare, this work examines a number of issues which represent the state of the art of child welfare in Canada. Among the contributors are practitioners as well as academics from the fields of social work, child care, law and medicine. Important government studies and reports in the 1970's did much to define existing problems in child welfare and to provide directions for their solutions. The developments and research reported in this book add to their findings. Several main themes emerge in the book -- one being the lack of standardization of child welfare policy and practice in Canada since each province has its own regulations and policies. Other concerns common to many of the authors are the dismantling of social service programmes as a result of the current recession and the need for greater cooperation with the native Indian leadership in regard to the provision of child welfare services to the Indian community. Another important theme touched on by several authors concerns children in the care of welfare agencies. They discuss how adequate the range and quality of services are and how the effect of these services can be measured. The final theme centers on prevention and the early identification of families whose children may be at risk without certain support services. The point of view which transcends all the contributions supports an institutional approach, where a range of services is available to families to choose from, as opposed to the residual approach which regards government services as the last resort. While it is the latter view that is prevalent in Canda today, the authors argue that this represents a penny wise but pound foolish approach not only to child welfare but also to the broader field of social welfare.

Book Social Policy and Social Justice

Download or read book Social Policy and Social Justice written by Jim Harding and published by Wilfrid Laurier Univ. Press. This book was released on 2006-01-01 with total page 497 pages. Available in PDF, EPUB and Kindle. Book excerpt: Social Policy and Social Justice looks concretely at the successes and failures of a social democratic government in Canada (1971-1982) in achieving social justice through its approaches to social policy. Social policy is analyzed widely, including day care, workers’ control, prescription drugs, social assistance, income distribution, legal aid and policing. Additional chapters review the NDP’s re-organization of bureaucracy and allocation of expenditures. Also included are an historical synopsis of the legislation pursued in the period and an analysis of the broader political, economic and sociological contexts in Canada. Social Policy and Social Justice is the first in-depth analysis of social policy at a provincial level. It is the product of the multidisciplinary scholarship of the authors, all of whom have extensive experience in policy-making, policy advocacy or policy research. This book will be an invaluable resource for comparative purposes, particularly since there are now three NDP governments across Canada, and the NDP is undergoing re-evaluation in the wake of the 1993 federal election. It will be of particular interest to those in government, university, community-based or political organizations wanting to re-examine mainstream assumptions about social democracy, social policy and social justice in Canada.

Book Justice Stanley Mosk

Download or read book Justice Stanley Mosk written by Jacqueline R. Braitman and published by McFarland. This book was released on 2012-12-11 with total page 287 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first biography of Stanley Mosk (1912-2001), iconic protector of civil rights and civil liberties during his 37 years as a justice of the Supreme Court of California (1964 to 2001). He had quickly risen as a well liked leader among Los Angeles reformers, as executive secretary to California governor Culbert Olson and then 16 years as a superior court judge. His 1958 election and service as state attorney general soon won national attention and the promise of likely election to the U.S. Senate, but an unexpected campaign twist augured a new course. This book frames Mosk's Supreme Court years and the landmark cases in which his opinions or biting dissents continue to resonate.

Book Rule of Law Justice and Interpretation

Download or read book Rule of Law Justice and Interpretation written by Luc B. Tremblay and published by McGill-Queen's Press - MQUP. This book was released on 1997-10-24 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: Tremblay's theory of the rule of law involves a set of practical principles that constitute the ideal type of a conception of law that is both constitutive and regulative of legal discourse and practice. Tremblay examines two competing ideal types, the "rule of law as certainty" and the "rule of law as justice." The former, a standard doctrine within contemporary legal, social, and political theory, is shown to be incoherent. Thus the "rule of law as justice," he shows, provides the best basis for understanding legal discourse in general and Canadian constitutional law in particular. Tremblay offers a coherent reconstruction of Canadian law from fundamental principles of the rule of law as justice and tests the theory through applications to key judicial decisions that have proven resistant to positivist interpretation. The Rule of Law, Justice, and Interpretation is both a stimulating work of contemporary legal theory and an innovative challenge to the traditions of Canadian constitutional law. Tremblay examines fundamental issues of legal epistemology and ontology and brings rigorous analytical jurisprudence to bear on interpretations and applications specific to Canadian constitutional law. Given the important implications of his theory for statutory and constitutional interpretation, especially with respect to the Canadian Charter of Rights and Freedoms and the potential crisis involving provincial rights of secession and partition, this book will be central to the practice of law in Canada.

Book The International Court of Justice in Maritime Disputes

Download or read book The International Court of Justice in Maritime Disputes written by Julio Faundez and published by Routledge. This book was released on 2018-09-03 with total page 165 pages. Available in PDF, EPUB and Kindle. Book excerpt: The origins of the maritime dispute between Chile and Peru go back to 1952, when these countries, along with Ecuador, asserted sovereignty over 200 nautical miles from their coasts. This maritime claim is widely regarded as one of the most important contributions by a group of developing countries to the law of the sea. Peru then asked the Court of International Justice to delimit its lateral boundary with Chile in accordance with principles of international law. Chile asked the Court to dismiss the request. The question before the ICJ Justice was whether the treaty concluded by the parties when they made their claim had also delimited their lateral boundary. This book provides a critical analysis of the approach to treaty interpretation by the International Court of Justice in Maritime Disputes. Focusing on the case of Chile and Peru, the book explores two main issues: the interpretation of the Santiago Declaration and its connected treaties; and the tacit agreement that established a lateral maritime boundary with a seaward extension of 80 nautical miles. Part I argues that the Court’s finding that the Santiago Declaration did not delimit the lateral boundary is mistaken because it ignores its context, as well as its object and purpose. Part II argues that the finding that the parties had entered into a tacit agreement is an unjustified legal inference derived from a hasty interpretation of the Special Agreement of 1954. It questions that the reliability of the evidence used to determine the seaward extent of the lateral boundary and argues that the Court failed to demonstrate the bearing of contemporaneous developments in the law of the sea on the content of the tacit agreement.
